Dear Mr. Mills:
You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact 48 linear feet and to incur 20 linear feet of temporary impacts to an unnamed tributary to Tickle
Creek in order to upgrade SR 2737 (Ludgate Road) in Guilford County. The project should be
constructed in accordance with your application dated January 9, 2003 (received March 3, 2003). After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Nos. 3366 and 3375 corresponding to the U.S. Army Corps of Engineers Nationwide Permit
Numbers 33 and 14. In addition, you should acquire any other federal, state or local permits before you
proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge
and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit
unless otherwise specified in the Water Quality Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us, in writing, and send us a new
application. If the property is sold, the new owner must be given a copy of this Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, or if stream impacts exceed 150 linear feet, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions
listed below.
1. The impacted waters are classified as Nutrient Sensitive Waters. Therefore, NCDOT shall use
Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A NCAC 4B .0124) to
minimize impacts to downstream aquatic resources. Additionally, storm water should be directed to
buffer areas or retention basins and must not be routed directly into streams unless the applicant
provides evidence that this is not practicable or feasible.
2. Mowing of existing vegetated buffers is strongly discouraged, so that they may be'utilized for storm
water diffuse flow.
3. All work shall be performed during low flow (below bankful) conditions.
4. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
5. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.

6. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank stabilization
and to minimize the use of rip rap.
7. The pipe required for this project shall be installed in such a manner that the original stream profile is
not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed).
Existing stream dimensions (including the pattern and profile) are to be maintained above and below
locations of each culvert. The culvert shall be designed and installed to allow for fish and other
wildlife movement as well as prevent headcutting of the streams. If any of the existing pipes are
perched, they shall be removed and replaced, and installed correctly.
8. NCDOT must submit a plan for written DWQ approval to address any headcutting that will occur as a
result of this project.
9. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If rip-rap is necessary, it must be limited to the stream bank below the high water
mark, and vegetation must be used for stabilization above high water. Rip rap shall not be placed in
the stream bottom.
10. The presence of equipment in the channel must be minimized. Under no circumstances must rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culvert.
11. Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The North Carolina Department of Transportation (NCDOT) proposes to upgrade Ludgate Road
(SR 2737) from an unpaved to a paved secondary road to reduce future maintenance needs and
increase traffic safety. This activity will result in impacts to a stream due to the replacement and
extension of a crossline pipe to facilitate travel lane and shoulder widening. The NCDOT
anticipates that the pipe replacement activity will be authorized under Nationwide Permit (NWP) 14
and the dewatering operation will be authorized under NWP 33. This application is intended as a
request for formal written authorization from the USACE for dewatering activities occurring under
NWP 33. This application is also intended as request for written authorization from the NC
Division of Water Quality to replace the pipe under General Water Quality Certificate # 3375 (NWP
14). The following information is being provided to satisfy Nationwide Permit Condition 13
(Federal Register January 15, 2002) and Condition 1 of General Water Quality Certificate # 3375.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

NC 61passing through Gibsonville. After you go through Gibsonville you will come to
the intersection of Frieden Church Road and NC 61; make sure you bare right staying on
NC 61. Ludgate Road will be the third road on the right off of NC 61.

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Pipe replacement and placement of fill are necessary to increase travel lane and shoulder width
to current construction standards. Impacts will be minimized by strict enforcement of Best
Management Practices for the protection of wetland and surface waters restrictions against the
staging of equipment in or adjacent to waters of the US and coordination (including a pre-
construction meeting) with the Division Environmental Officer.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetIands/strmgicle.htm1.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

Construction Sequence and Erosion Control Plan for Replacement of
Pipe with Pipe Using a Pump Around - Guilford County, SR 2737
Ludgate Road
Work to begin as soon as practicable following authorization.
Construction is anticipated to take 4 weeks.
1. Install a rock silt dam downstream of the work area to prevent incidental sediment
loss.
2. Install ABC aggregate or a less intrusive dewatering device to allow dewatering of
the work area.
3. Install pumps to divert flow around the work area.
4. Remove one existing line of 32' long 42" CM pipe.
5. Excavate to sufficient depth to allow 20% burial of the pipe, place base stone, and
single line of 60' long 48" CM pipe.
6. Backfill the new line of pipe and place rip rap only as needed.
7. Starting from the downstream end, remove the dewatering structure and restore the
natural stream contours.
8. Notify landscape department for final seeding.
9. Silt fences to be placed as site conditions require.
10. A 10' X 15' dirt bag will be used to remove excess water in the hole where the new
pipe is being replaced.
11. Site conditions and weather may alter these plans.
12. A method less intrusive than a pump around system may be utilized if site conditions
allow.

The NCDOT Historic Architecture Section has received your county commission-approved 2002-2003
Secondary Roads Rural Paving Program. We have map-checked all submitted roads at the NC Historic
Preservation Office (HPO) for the following currently designated historic property types: National
Register (NR), Study List (SL), and Determined Eligible (DOE) properties. Based on the map-check
reviews, we are writing (t) to inform you of the current historic compliance status for your SR Rural
Paving Program; (2) to notify you of the SR projects that definitely will require our fieldwork; (3) to
provide you with information that can be included (or attached) in your cover letter for a Pre-Construction
Notification.
If coordination is required, the NCDOT staff architectural historian will notify the DivisionlDistrict
Maintenance Engineers to start a mitigation effort involving environmental commitment agreeable to all
parties, Documentation will be coordinated by the staff architectural historian with the Division
Environmental Officer.
When additional SR projects are added to a Program, individual updates will be sent to the
Division/District Maintenance Engineers and the DEO. All status updates can be tracked on the Division
