The permit application has been modified to depict the proposed impacts to the buffer areas associated with the proposed road crossing. 2. It is the desire of the owner/developer at this time to secure wetland permits to install the access road to Station 5+00 as presented on the project plans. Beyond that, the extent of upland development for the remaining portions of the site are not known at this time. Therefore, no Stormwater Management Practices have been developed since design or permitting for the remaining portions of the site has not begun. It is the understanding of the owner/developer that a Coastal Stormwater Permit and stormwater design complying with this Coastal Stormwater Regulations will be required in order to properly develop the site. At the time the full extent of upland development is determined, a Coastal Stormwater design and permit application will be developed. The owner would like to secure the proper permits to install the road crossing only at this time. Revisions have been included on the enclosed project plans to indicate that a 50 linear foot long, flat vegetated Swale segment will be constructed at the ends of the roadside swale segments. The swales will act as level flow spreaders and ensure diffuse flow of any runoff that may occur from the small sections of roads to be installed prior to any runoff entering the buffer. See comments above. 4. Percent impervious for the site is not known at this time. See No.2 above. 6. See No.2 above. 7. Application form and narrative have been modified. It is requested that you consider this additional information and if deemed appropriate, issue the 401 Water Quality Certification for this project. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were. not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Access road designed to minimize impact to wetlands. Roads were designed to cross wetlands as perpendicular as possible to minimize impacts. Pavement width held to minimum. See attached narrative. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 9 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http://h2o.enr.state.nc.us/wrp/index.htm. A Stormwater Management Permit will be secured for upland development once a final site plan is determined. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. All sewage disposal will be to public sewer operated by City of New Bern. XIII. Violations (required by DWQ) Is this site in violation of DWQ Wetland Rules (ISA NCAC 2H .0500) or any Buffer Rules? Other Circumstances (Optional): It is the applicant's responsibility to submit the application sufficiently in advance of desired construction dates to allow processing time for these permits. However, an applicant may choose to list constraints associated with construction or sequencing that may impose limits on work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and Threatened Species, accessibility problems, or other issues outside of the applicant's control). Page 12 of 12 PROJECT NARRATIVE Proposed Wetland Impact Lot #6 -Craven County Industrial Park 201 Industrial Drive, Craven County, North Carolina The proposed project includes the construction of an access drive to access the upland areas of Lot #6 in the Craven County Industrial Park. Lot #6 fronts Industrial Drive, a State maintained road. This is the only area on the property not impeded by easements which the subject property abuts the public road system. Isolated wetland areas exist across the majority of the front of the subject property isolating access to the approximate 16.62 acre upland area on the southern side of the site. The owner of the property does not have any definitive plans for development of the upland areas of the site at this time. It is the desire of the owner/developer to obtain permits for the access drive construction only at this time. It is anticipated that on industrial/commercial type flex-space will be developed on the site. It is anticipated that additional permits will need to be secured once a final site design has been determined. These permits will include amongst others a Coastal Stormwater Permit. By regulation, the developer/owner will have to design a Stormwater management system to comply with the Coastal Stormwater Permitting requirements prior to proceeding with construction. At this time, it is the desire of the owner to construct the access drive across the wetland bottom. In order to provide access to the upland areas, the developer proposes to construct a 24 foot wide access drive extending from Industrial Drive. The access drive will cross a portion of the wetland area. In order to instal] this access road, a total of 7,379 square feet of wetland area will need to be impacted by fill. It is proposed that two 15-inch storm drain pipes be placed in the wetland bottom to maintain any natural flow that occurs in the wetlands. Wetland impacts have been minimized to the extent possible. Neuse Riparian Buffer areas exist on the subject property. These buffer areas must be impacted to accommodate the proposed road crossing. A total of 3,000 square feet of Zone 1 buffer area will be impacted. A total of 2,000 square feet of Zone 2 buffer area will be impacted. Total buffer impacts is 5,000 square feet, 0.11 acres. The proposed future development on the subject property will not have any cumulative impacts to downstream water quality. As a part of the final design for site improvements, a Coastal Stormwater application must be secured.
