The Wetlands Unit received your response to the request for additional information dated June 14, 2002. Staff reviewed
the information provided and determined that additional information is necessary to establish that the proposed culvert will
not result in destabilization of Country Line Creek.. The required additional information is as follows:
This Office agrees with your statement that the introduction man-made controls would interfere with the natural equilibrium
of this stable stream system. This is why more information and additional measures have been requested by this Office to
ensure that the placement of the proposed culvert that restricts the existing floodway will not destabilize the stream.
General Water Quality Certification No. 3375 Condition No. 9 states in part:
"Design and placement of culverts including open bottom or bottomless arch culverts and other
structures including temporary erosion control measures shall not be conducted in a manner that may
result in aggradation, degradation or significant changes in hydrology of wetlands or stream beds or
banks, adjacent to or upstream and down stream of the above structures. The applicant is required to
provide evidence that the equilibrium shall be maintained if requested to do so in writing by DWQ.
Additionally, when roadways, causeways or other fill projects are constructed across FEMA-
designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain
the natural hydrology of the system as well as prevent constriction of the floodway that may result in
aggradation, degradation or significant changes in hydrology of streams or wetlands."
The proposed changes to the stream morphology by the addition of the culvert may have a dramatic impact on the
stability of the stream, both up and downstream of the proposed impact, by changing the channel's ability to transport its
bedload in its current state of equilibrium. Your letter of June 14, 2002 does not include enough information for this Office
to determine or predict whether or not the stream's ability to transport its bedload without aggrading or degrading can be
achieved with the current culvert design. This is of particular concern in waters classified as WSII ORW (water supply Il,
outstanding resource).
As such, you must demonstrate that the proposed culvert will not destabilize the stream and that equilibrium will be
maintained. In any event, I would like to suggest that we schedule a meeting to discuss this matter as similar situations
are likely to arise. The aim of this meeting would be to develop specific protocols to address this situation so that we do
not have to put these (and similar) projects on hold in the future.
Until this information is received, I will place this project on hold due to incomplete information (15A NCAC 2H .0507(a)). If

Dear Mr. Mills:
The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for
making an informed permit decision. The permit application was deficient in the following areas:
• The project as presently proposed calls for replacing a bridge with a culvert. The waters being
impacted are classified as WS II HQW. At this time, and given the present design the NCDWQ
requires additional information prior to issuance if the 401 Water Quality Certification. The present
design will likely result in a destabilization of the stream. Please provide a design that incorporates a
downstream and upstream rock cross vane at this site, and provide the proposed design specifications
for the cross vane installation. If you believe the requested design changes are problematic, please
provide additional information detailing the engineering rationale, and provide an alternative design
that provides for stream stability.
Therefore, pursuant to 15A NCAC 2h .0507(a)(5), we will have to place the permit application on hold
until :we are supplied the necessary information. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place
the permit application on hold.

APPROVAL of 401 Water Quality Certification Modification with Additional Conditions

Dear Mr. Green:
You have our approval, in accordance with the attached conditions and those listed below, to place
permanent fill material in 115 linear feet of stream and temporary fill in an additional 20 linear feet of
stream for the purpose of constructing a new 3 barrel (10'X12') reinforced concrete box culvert to replace
Bridge Number 23 of SR 1146 in Caswell County. The project should be constructed in accordance with
your modification request dated September 17, 2003 (receivedSeptember 26, 2003). In addition to the
aforementioned impacts, additional fill of 380 cubic yards (3735 square feet of surface waters) of fill is
authorized to construct a wing deflector to divert low stream flows through a single barrel of the box
culvert. This aspect of the project shall be constructed in accordance with your submittal dated July 18,
2002. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification No. 3404 corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14.
In addition, you should acquire any other federal, state or local permits before you proceed with your
project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. This approval will expire with the accompanying §404 permit unless otherwise
specified in the Water Quality Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us in writing, and you may be required to
send us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, or if stream impacts exceed 150 linear
feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For
this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT March
1997) and Sedimentation and Erosion Control Guidelines for Sensitive Watersheds [15A NCAC 4B
.0124(a)-(d)] must be implemented prior to any ground-disturbing activities to minimize impacts to
downstream aquatic resources. Temporary or permanent herbaceous vegetation shall be planted on
all bare soil within 10 days of ground-disturbing activities (due to the presence of High Quality
Waters) to provide long term erosion control
2. NCDOT shall adhere to the requirements for High Quality Waters [15A NCAC 2B.02241.

3. Where practicable, storm water should be directed to buffer areas or retention basins and must not be
routed directly into streams. Mowing of existing vegetated buffers is strongly discouraged, so that
they may be utilized for storm water sheet flow.
4. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
5. Upon completion of the project, the NCDOT shall complete and return the enclosed
"Certificate of Completion" form to notify NCDWQ when all work included in the §401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The North Carolina Department of Transportation (NCDOT) proposes to replace a structurally
deficient bridge with a Reinforced Concrete Box Culvert (RCBC) with headwall on Camp Springs
Road. The replacement is necessary in order to maintain traffic safety and reduce maintenance costs.
Permits from the US Army Corps of Engineers (NW 14 and 33) and the NC Division of Water Quality
(DWQ Project No. 020480) have already been obtained. However, this PCN is being submitted to
request a modification to the dewatering method that will be used during construction of the new
RCBC.
NCDOT is requesting to utilize a pump around method of dewatering the stream rather than the
diversion channel that was submitted with the application. The construction sequence and drawings
are attached with this application. All other aspects of the permit are to remain as permitted. Please
refer to the drawings and plats originally submitted for all other information concerning this project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The structurally deficient bridge must be revlacesd to ensure safety. Impacts will be minimized
by burying the culvert one foot below streambed elevation and placing Class H riprap, 2 to 3 feet
above the streambed in one of the barrels to facilitate high water flow and aquatic life
movement. Secondary impacts will be minimized by strict enforcement of Best Management
Practices for the protection of wetland and surface waters, restrictions against the staging of
equipment in or adjacent to waters of the US, and coordination (including a pre-construction
meeting) with the Division Environmental Officer.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
hqp://h2o.enr.state.nc.us/ncwet]ands/stnngide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,

Dear Mr. Mills:
You have our approval, in accordance with the attached conditions and those listed below, to place permanent fill
material in 115 linear feet of streams and temporary fill in an additional 20 linear feet of streams for purposes of
constructing a new 3 barrel (10'X12") reinforced concrete box culvert to replace Bridge Number 23 on SR 1146 in
Caswell County. The project shall be constructed in accordance with your application dated March 25, 2002. In
addition to the aforementioned impacts, additional fill of 380 cubic yards (3735 square feet of surface waters) of fill
is authorized to construct and wing deflector to divert low stream flows through a single barrel of the box culvert.
This aspect of the project shall be constructed in accordance with your submittal dated July 18, 2002. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number
3375. This certification corresponds to the Nationwide Permit 14 issued by the Corps of Engineers. In addition,
you should acquire any other federal, state or local permits before you proceed with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval
will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified below).
Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying
with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total
impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as
described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the
conditions listed in the attached certification.
1.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The
responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of
Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an.adjudicatory hearing. You must
act within 60 days of the date that you receive this. letter. To ask for a hearing, send a written petition that conforms

A field survey of Bridge 23 and Country Line Creek was made 15 July 2002, to obtain
additional information requested by Division of Water Quality. The additional
information included bankfull determination and associated geomorphic properties. The
stream reach in vicinity of the bridge has an abnormally high water depth making
bankfull determination near the bridge impractical. Investigation further downstream
(+/- 400') found that beavers and/or humans have dammed up the natural channel.
Therefore, bankfull determination and cross section data were taken approximately 200'
below this dam (approximately 600' downstream of the bridge).
The bankfull information is attached. Maximum depth was found to be about 4.1 feet
with a bankfull width of 26'. The bankfull mean depth was calculated to be 2.7'. The
entrenchment ratio was found to be 1.65 or moderately entrenched. The stream slope for
Country Line Creek is 0.004 feet/foot. Due to the entrenchment ratio and mild stream
slope, it is felt that Cross Veins are not warranted or appropriate at this site.
Attached please find sketches for riprap bankfull bench to be used to insure that bankfull
dimensions will remain stable in the vicinity of the proposed culvert. These riprap
bankfull benches located outside the culvert should not adversely affect the hydraulic
performance of the culvert during higher frequency flood events.
It should be noted that as long as the dam is in place downstream, the culvert and stream
will be flooded with about 5 feet of water.

The North Carolina Department of Transportation (NCDOT) proposes to replace the existing
structurally deficient 1@17'5, 1@16'11, 1@17'1, 1@ 16'10, 1@17'8 timber Bridge with a 75-foot
long 3 @ 10' X 12' Reinforced Concrete Box Culvert (RCBC) with Headwall. The proposed RCBC
is the preferred structure due to cost constraints. Thee approximate cost for installation of the
RCBC is $180,000, whereas the approximate cost for installation of the alternate bridge structure is
$300,000. Furthermore, a culvert requires less long-term maintenance than a bridge.
Permanent impacts will result from enclosure of 75-linear feet of channel, placement of 10-foot wing
walls (to be located outside the channel), at each end of the culvert, and placement of 10-linear feet
of rip-rap energy dissipaters at each end of the structure. Total permanent impacts will equal 115-
linear feet. Temporary impacts will result from placement of ABC aggregate or a less intrusive
dewatering device within the stream to force flow into a diversion channel, and disturbance of stream
bank at the diversion channel entrance and exit. Temporary dewatering structures will extend a
maximum of 20-feet per end (within the confines of the rip-rap energy dissipaters) beyond the
footprint of the proposed structure. The temporary dewatering structures will be entirely removed
upon completion of the project. The diversion channel and entrance and exit will be graded to
natural stream contour and protected by Coir fiber immediately upon completion of the project.
Mitigation is not anticipated, as the impacts to any individual stream do not exceed 150 feet. The
project is located in a High Quality Water. The project will not impact an Essential Fisheries
Habitat. No Threatened or Endangered species were observed during a field survey conducted by
Len Smith or Tim Savidge for species known to occur in Caswell County (See the attached

Endangered Species Review Sheet for further information). Historic compliance work to be
scheduled and concurrence with the Historic Preservation Office will be obtained if required. Direct
impacts will be minimized by burying the culvert 1-foot below streambed elevation and placing a I-
to 2-foot sills on the each of the barrels (see the attached cross-section) to maintain low flow and
facilitate aquatic life movement. Secondary impacts will be minimized by strict enforcement of Best
Management Practices for Bridge Demolition Removal and Protection of Surface Waters,
restrictions against the staging of equipment in or adjacent to waters of the US, and coordination
with the Division Environmental Officer.
The NCDOT anticipates that the pipe placement will be authorized under Nationwide Permit (NWP)
14 and the dewatering operation will be authorized under NWP 33. This application is intended as a
request for formal written authorization from the USACE for dewatering activities occurring under
NWP 33. This application is also intended as request for written authorization from the NC Division
of Water Quality to place the RCBC in the channel under General Water Quality Certificate # 3375
(NWP 14). Enclosed please find the project site map and the pre-construction notification form for
the above referenced project. Construction is anticipated to begin fall of 2002 and take 4 months to
complete.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The structurally deficient bridge must be replaced to ensure safety. Direct impacts will be
minimized by burying the culvert 1-foot below streambed elevation and placing a 1- to 2-foot
sills on the each of the barrels (see the attached cross-section) to facilitate aquatic life movement.
Secondary impacts will be minimized by strict enforcement of Best Management Practices for
Bridge Demolition Removal and Protection of Surface Waters restrictions against the staging of
equipment in or adjacent to waters of the US and coordination with the Division Environmental
Officer.

Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o enr state nc us/ncwetlands/strmRide.htm 1.

Subject: Freshwater mussel survey report of South Country Line Creek for
proposed replacement of bridge # 71 on SR 1736, Caswell County;
TIP # B-3131.
The proposed action calls for the replacement of bridge No. 71 over South
Country Line Creek in Caswell County. A spinymussel was recently discovered in the Dan
River in Stokes County and more recently in the Mayo River in Rockingham County.
This species is similar in appearance to the James spinymussel (Pleurobema collina) as
well as the Tar spin}mussel (Elliptio steinstansanna), both of which are federally
Endangered. The US Fish and Wildlife Service (FWS) is considering the spinymussel
from the Dan River to be an Endangered species. The FWS has also listed this species for
Caswell County, because much of the county lies within the Dan River Basin.
Extensive surveys for mussel fauna have been conducted by NCDOT staff in the
Dan River in Stokes and Rockingham Counties. Personnel from the US Fish and Wildlife
Service, North Carolina Wildlife Resources Commission and NC State University School
of Veterinary- Medicine assisted at various times during these survey efforts. The apparent
range (r 30 river-miles) of the spinymussel in the Dan River extends from the North
Carolina/Virainia border near the first bridge crossing in North Carolina (Flippin Rd, SR
1416) in northwest Stokes County down to the town of Danbury in central Stokes
County-. The spinymussel has not been found in the Dan River in Rockingham or Caswell
County. The species has been found in the Mayo River in northwest Rockingham County,
near the NOVA border. More surveys are needed to determine the range of this species
in the Mayo River.
The subject project is located on South Country Line Creek, which flows into
Country Line Creek. which in turn flows into the Dan River in Halifax County Virginia,
approximately 18 miles downstream of the project crossing. The confluence of Country
Line Creek and the Dan River is approximately 78 river-miles downstream of Danbury
(furthermost downstream documentation of the spin}mussel in the Dan River). No

mussels were found during a survey (11-29-2000, by Tim Savidge and Logan Williams) of
the Dan River at the NC 57 crossing, approximately 1 mile upstream of the Country Line
Creek/Dan River confluence. NCDOT has a number of bridge replacement projects
occurring in the Country Line Creek subbasin (TIP 4s B-3130, B-3131, B-3317, B-3319,
B-3629). Because of the large number of projects impacting the same waterbody, a
comprehensive survey effort was made in the drainage from the NC 57 crossing of
Country Line Creek upstream to the SR 1146 crossing above Farmer Lake. Survey
methodology included wading using visual (Batiscope) and tactile methods. Surveys sites
between SR 1156 and US 158 were accessed using canoe. A total of 38 man-hours of
survey time were spent in the Country Line Creek watershed (Table 1.). Water depth and
clarity was sufficient for visual search methods at all of the locations sampled. No
spinymussels were located during these surveys. Mussel abundance and diversity was
greatest in the stretch below Farmer Lake (from SR 1156 to US 158) and slowly declines
down stream. Mussels appear to be absent in the creek above Farmer Lake. The
introduced Asian clam (Corbicula fluminea) is extremely abundant in the creek below the
lake, and present but not common above the lake. Atlantic pigtoe (Fusconaia masonry is
known from Country Line Creek (one individual found in 1998, John Alderman NCWRC
personal communication). The Atlantic pigtoe is a Federal Species of Concern (FSC).

Biological Conclusion: No Effect
Given the survey results. it is apparent that the spinymussel does not occur in the
project area. The spinymussel has not been found in the stretch of the Dan River
downstream of the project area. It can be concluded that project construction will not
impact this species.

CULVERT CONSTRUCTION SEQUENCE
1. Install a stilling basin or silt bag as directed by the NCDOT
representative.
2. Construct a diversion channel sized in accordance with NCDOT
Hydraulics Unit guidelines.
3. Line the diversion channel with poly-fabric to prevent sediment
loss.
4. Divert flow into the diversion channel.
5. Dewater the culvert construction area with discharge through the
stilling basin or silt bag.
6. Construct the box culvert.
7. Upon completion of the culvert, restore flow to the natural channel
and fill in the diversion channel.
8. Stabilize the diversion channel entrance and exit using Coir fiber
and seed unless otherwise directed by the NCDOT representative.
9. Cofferdams may be utilized in place of a diversion channel if
conditions allow.

Dear Mr. Mills:
The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for
making an informed permit decision. The permit application was deficient in the following areas:
The project as presently proposed calls for replacing a bridge with a culvert. The waters being
impacted are classified as WS II HQW. At this time, and given the present design the NCDWQ
requires additional information prior to issuance if the 401 Water Quality Certification. The present
design will likely result in a destabilization of the stream. Please provide a design that incorporates a
downstream and upstream rock cross vane at this site, and provide the proposed design specifications
for the cross vane installation. If you believe the requested design changes are problematic, please
provide additional information detailing the engineering rationale, and provide an alternative design
that provides for stream stability.
Therefore, pursuant to 15A NCAC 2h .0507(a)(5), we will have to place the permit application on hold
until we are supplied the necessary information. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place
the permit application on hold.
Hopefully, we can work together to expedite the processing of your permit application. If you have any

The Wetlands Unit received your response to the request for additional information dated June 14, 2002. Staff reviewed
the information provided and determined that additional information is necessary to establish that the proposed culvert will
not result in destabilization of Country Line Creek. The required additional information is as follows:
This Office agrees with your statement that the introduction man-made controls would interfere with the natural equilibrium
of this stable stream system. This is why more information and additional measures have been requested by this Office to
ensure that the placement of the proposed culvert that restricts the existing floodway will not destabilize the stream.
General Water Quality Certification No. 3375 Condition No. 9 states in part:
"Design and placement of culverts including open bottom or bottomless arch culverts and other
structures including temporary erosion control measures shall not be conducted in a manner that may
result in aggradation, degradation or significant changes in hydrology of wetlands or stream beds or
banks, adjacent to or upstream and down stream of the above structures. The applicant is required to
provide evidence that the equilibrium shall be maintained if requested to do so in writing by DWQ.
Additionally, when roadways, causeways or other fill projects are constructed across FEMA-
designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain
the natural hydrology of the system as well as prevent constriction of the floodway that may result in
aggradation, degradation or significant changes in hydrology of streams or wetlands."
The proposed changes to the stream morphology by the addition of the culvert may have a dramatic impact on the
stability of the stream, both up and downstream of the proposed impact, by changing the channel's ability to transport its
bedload in its current state of equilibrium. Your letter of June 14, 2002 does not include enough information for this Office
to determine or predict whether or not the stream's ability to transport its bedload without aggrading or degrading can be
achieved with the current culvert design. This is of particular concern in waters classified as WSII ORW (water supply II,
outstanding resource).
As such, you must demonstrate that the proposed culvert will not destabilize the stream and that equilibrium will be
maintained. In any event, I would like to suggest that we schedule a meeting to discuss this matter as similar situations
are likely to arise. The aim of this meeting would be to develop specific protocols to address this situation so that we do
not have to put these (and similar) projects on hold in the future.
Until this information is received, I will place this project on hold due to incomplete information (15A NCAC 2H .0507(a)). If

Your letter of 29 April 2002 requested that rock cross vanes be installed both up and
down stream of the proposed culvert. The stream hydraulics are controlled by flat bed
gradient of less than 0.3% and high natural tailwater elevations across a wide spectrum of
storm frequencies. Culvert conveyance is restricted by this hydraulic regime thereby
posing no stability problems for this reach of the stream.
The stream exhibits very stable conditions and introduction of man-made controls where
no channel degradation exist would interfere with the natural equilibrium of the system.
If NCDOT is required to install the requested cross vanes, the Department requires from
DENR (DWQ) a letter of indemnification which will "hold harmless" the Department
from any future claim of damage or demand for corrective action as result of the
requested action.
NCDOT's proposal for replacement of Bridge No. 23 Caswell County stands as on file in
your office under DWQ 020480. Thank you for the opportunity to address this situation
