The North Carolina Department of Transportation (NCDOT) proposes to widen NC 43 from
US 264 to US 13/NC 11 (Demorial Drive) near Greenville in Pitt Count}. The purpose of this
application is to request permit approval for unavoidable impacts that will occur to jurisdictional
resources. Impacts will occur to wetlands and riparian buffers associated with Harris Mill Run from
removal of vegetation for an aerial electric utility line easement. Table 1 provides a summary of the
permanent impacts to jurisdictional wetland and riparian buffer resources. Temporary impacts will
occur from clearing vegetation using mechanized and hand operated equipment without grubbing
or raking to remove roots.

will also widen the existing two lane section of NC 43 to a four-lane divided roadway with a
shoulder section along this section of the project. The U-5018A section covered by this permit
application is approximately 0.4 mile long and is scheduled for letter in 2010. Improvements for
the phase identified as U-501813, from B's Barbeque Road to Memorial Drive, were let in June 2009
and will not impact jurisdictional surface water resources. The entire project qualifies under
National Environmental Policy Act (NEPA) guidelines for review under a Minimum Criteria
Checklist (MCC). A copy of the approved MCC was previously submitted on February 23, 2009
with a N\VP 14 and 27 permit application package for unavoidable impacts to streams, wetlands,
and riparian buffers from removal of the existing culvert and construction of the new bridge.
Mitigation is not required for riparian buffer impacts created by aerial electric utility lines.
Mitigation for permanentwedand impacts will be provided onsite through restoration of the culvert
removal site. A restoration planting and monitoring plan was submitted with the February 23, 2009
permit application package previously submitted for N\VP 14 and 27.
This permit application package consists of the cover letter, Pre-Construction Notification (PCN)
form, a project vicinity map (Figure 1) and topographic map (Figure 2); permit drawings and impact
summary tables; and adjacent property owners list. The on-site stream restoration planting and
monitoring plan; half-size plan sheets; bridge hydraulic design report; and Minimum Criteria
Checklist submitted on February 23, 2009 have not changed and remain as previously submitted.

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
NC 43 is an existing 2 lane road from US264 to approximately Paladin Drive and is a 5 lane curb and gutter roadway
from Paladin Drive to the project terminus at NC 11 (Memorial Drive). There is an existing double box culvert under NC
43 at Harris Mill Run. Existing right-of-way on all sections is 100 feet and aerial electric utility lines are located in a
permanent utility easement on the north side of the roadway and culvert. Current land use in the study area is a mix of
undeveloped property land land developed for residential, commercial, industrial, and agricultural uses. The primary land
use in the project location is commercial development and residential housing.

The project purpose is to widen an existing two lane section to four lanes; make turning movement improvements
along the existing four lane section; and provide additional paved shoulder width for bicyclists and pedestrians.
3e. Describe the overall project in detail, including the type of equipment to be used:
The project is separated into two phases of work, U-5018A and U-5018B. There are no jurisdictional resource impacts
on the U-50188 section.
This application is for permanent and temporary impacts to Tar-Pamlico River Basin riparian buffers and wetlands in
U-5018A. Existing aerial electric lines will be relocated by Greenville Utilities Commission (GUC) from the north side of
the existing NC 43 roadway to the south side of the proposed new bridge over Harris Mill Run. Relocation of the utility
lines requires clearing of riparian buffer vegetation between the new NC 43 road right-of-way (ROW) limits to the new
permanent utility easement (PUE) on the south side of the roadway and new bridge. These impacts are in addition to
impacts previously permitted by NWP14, 27 issued as Action ID SAW 2009-00960 (see 5.b below for details).
Clearing will be done using mechanized equipment and hand tools with no grubbing or root raking allowed.

Emergency repairs were made in 1999 at the Harris Mill Run culvert under NW3 following Hurricanes Floyd and Dennis.

The U-5018B section of the roadway does not create any jurisdictional surface water or riparian. buffer impacts.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Avoidance Measures: Six perennial streams, one open water pond, and four wetlands were delineated in the project
study area. Project construction will avoid impacts to five streams and all open waters. Bridge piers will be installed using
a crane located on fill material and will not be located in stream or wetland areas. The project will replace the existing
culvert on Harris Mill Run by building a new bridge on new location that completely spans the stream.
Minimization Measures: Wetland impacts have been minimized to the extent feasible, with fill impacts occurring only
where bridge bents and piers are required to support the structure. Stream channel impacts on Harris Mill Run will occur
from removal of the existing culvert. However, impacts will be minimized by restoring and stabilizing the channel to match
existing upstream and downstream elevations.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Minimization includes use of the existing roadway to maintain traffic on-site during construction of the new bridge.
Additional measures to minimize potential stream impacts include, but are not limited to, provisions for waste materials
and storage, stormwater management measures, and appropriate road maintenance measures. Silt fencing will be
constructed around the wetlands in order to protect them during construction. Riparian buffer clearing impacts do not
include grubbing or root raking.

NC Natural Heritage Program Virtual Workroom and Agency seeping letter comments from the US Fish and Wildlife
Service. In addition, a mussel survey was conducted on April 17, 2007 and results show suitable habitat does not exist at
the project site for protected mussel species.
