Thorp 7849 Clark Station Road Severn, MD 21144 Subject Property: Dove Landing Lot 9 in Youngsville, NC UT to Little River [030406, 27-57-(1), WSII, HQW, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Thorp: On February 27, 2007, the Division of Water Quality (DWQ) received your application dated February 25, 2007 to impact 5,154 square feet (ft2) of Zone 1 protected riparian buffers and 2,842 square feet (ft2) of Zone 2 protected riparian buffers to construct the proposed pond. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject properly. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: Water Quality Certification Please verify with the U.S. Army Corps of Engineers (USAGE) if a permit is required for this activity. Please state which Permit (Nationwide, Regional or General) number you intend to use if applicable. 2. Preconstruction Notification (PCN) Form You have submitted your information on an old version of the PCN form. Please resubmit 3 copies your information on the March 2005 PCN form. You can download this format the following web address: http~//h2o enr state nc us/ncwetlands/rel;cert.html Buffer Impacts In the table of uses in the Neuse Buffer Rules (15A NCAC 02B.0233(6}) ponds in a natural drainage way are considered allowable if diffuse flow is provided through the buffers and a Zone 1 and Zone 2 planted buffer is established around the newly created pond. • Please submit a detailed planting plan (which shall include a plan sheet showing the location of the vegetation to be planted, a list of species to be used and when your one-time fertilization in the buffers will occur). Thorp Page 2 of 2 March 28, 2007 Also, please include details on the diffuse flow measure you will use at the site to ensure stormwater is directed as diffuse flow through the newly created buffers. Be sure to include all applicable worksheets and operation and maintenance agreements. If you do not plan on replanting a buffer around the proposed pond, mitigation will be required. You must submit a mitigation plan if you choose this option. If you plan to pay into a mitigation bank for the buffer mitigation, you must submit an acceptance letter from the mitigation bank that states they have the credits available. Please respond within three weeks of the date of this letter by sending this information to me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
