The project site is located within the Neuse River Basin (HUC 03020201). The southeast corner of the property is within the Durham Watershed Overlay Protection District F/J-A (approximately 9-acres), while the remaining acreage is located within the Durham Watershed Overlay Protection District F/J-B. The proposed development will be built around the existing golf course and proposes the construction of 378 single-family homes, force-main utilities, and stormwater management facilities (Falls Village -Overall Proposed Site Plan). The entire project was designed to avoid and minimi~.e impacts to wetlands, streams, and riparian buffer areas while utilizing the remaining areas outside of these areas for development. In addifion, the proposed development has been designed as a low density development option (13.23% impervious surface area). To minimise run-off, detention of stormwater is proposed at two existing ponds located on the property in compliance with City of Durham Standards (see Temporary Stormwater Detention section below). Proper sedimentation and erosion control measures will be implemented during the construction of the project. PROPOSED IMPACTS: RnA1~S~ There is a network of roads to access the 393-acre project site; however, the development plan proposes only one new impact. There is a current service road in place from the original golf course that crosses a jurisdictional stream feature which will serve as the main access road from the south. The development plan proposes to expand the existing road and golf cart path crossing at an isolated stream that has 50-foot Neuse River Buffers associated with it (Sheet 1). The total isolated stream impact is 62 linear feet and the total buffer impact is 0.09- acres (total Zone 1 is 0.05-acres, total Zone 2 is 0.04-acres). FORCE MAIN/SEWER: The sewer line and force main have been combined in to one construction easement to avoid impacts and limit site disturbance. Because the two utility lines are combined there is a 40' wide construction corridor proposed to temporarily impact the two stream locations. The two proposed utility corridor impacts are designed to cross close to 90 degrees, have construction corridors of 40', and a maintenance corridor of 40'(sheets 2 -3). These are all temporary impacts. The sewer line will be installed by excavating, burying the line, backfilling, and returning to grade. Mr. Ian McMillan Falls Village FVD-06000 March 28, 2007 Page 3 of 4 TEMPORARY STORMWATER DETENTION: Temporary stormwater detention for the project site entails utilizing two existing ponds located on the property. The first existing pond (Pond 1) to be used for detention purposes is located in the northeast section of the property and has been determined to be a jurisdictional pond (see Sheet 2). There is an existing dam structure that is in degraded condition. The existing dam structure is to be re-constructed, which will meet North Carolina Dam Safety Design Standards, and designed for the 1, 2, and 10 year storm events at elevation 306. During storm events the normal pool of Pond 1 will rise to a maximum height at elevation 306. This fluctuation will result in a maximum temporary impact of 480 linear feet of stream channel, upstream of the normal pool and temporary jurisdictional pond impacts of 2.38-acres during peak storm events. However, the stream above pond 2 is currently impounded by beaver activity and the existing pond. There will be 107 linear feet of permanent stream impact and 0.05-acres of permanent wetland impact as a result of retrofitting the dam structure. The second non-buffered existing pond (Pond 2) to be used for detention purposes is located in the western section of the property and has been determined to be an isolated man-made feature (see Sheet 3). This existing pond retains water by an earthen dam structure. A new dam structure will be graded and adraw-down valve will be installed in accordance with the North Carolina Dam Safety Design Standards, and designed for the 1, 2, and 10 year storm events at elevation 320. There will be 0.03-acres of permanent isolated wetland impact as a result of constructing the new dam structure and dissipater pad. There are no jurisdictional features upstream of pond 2. NEUSE RIVER BUFFER -DIFFUSE FLOW There are a total of 8 drainage outlets on the Falls Village site. There are 7 pre-formed scourholes, and 1 stormwater detention pond dissipater located at pond 2 in order to diffuse the flows into the Neuse River stream buffers. All outlets are located in areas of low slope, outside of zone 1 and 2 of the stream buffers. All have signed and notarized operation and maintenance agreements. IMPACT SUMMARY: Falls Village Development, LLC proposes a residential development on the existing 393-acre Falls Village Golf Course. The proposed development entails constructing single family homes, force-main utilities, and stormwater management facilities. Since 1979 THE JOHN R. McADAMS COMPANY, INC. There is also 87 linear feet of temporary stream impact associated with the utility line installations. Compensatory mitigation is not proposed for the temporary impacts. Permanent: Permanent impacts associated with constructing the new dam structure at the pond in the northeast corner are 107 linear feet of jurisdictional stream and 0.05-acres of jurisdictional wetlands. In addition, 0.03-acres of permanent isolated wetland impacts are proposed as a result of retrofitting the dam structure at pond 1 within the western section of the property. There is also 62 linear feet of isolated stream impacts associated with the construction of a road and golf cart path. Therefore, total permanent impacts are as follows: 107 linear feet of jurisdictional stream, 0.08-acres of jurisdictional wetland, and 62 linear feet of isolated stream. Neuse River Buffers: With regard to Neuse River Basin Buffer impacts, there are 0.30-acre of proposed new "allowable" buffer impacts associated with the roadway expansion and sewer/force-main installation. As well, there is 0.65- acre of proposed temporary impacts associated with dam re-construction of pond 1. Measures to avoid and minimize impacts to natural resource areas have taken place. The remaining streams, wetlands, and stream buffers are to be placed into deed restrictions with the Falls Village Golf Course. As a result, compensatory mitigation is not proposed at this time. If compensatory mitigation is required, the applicant proposes to make an in-lieu payment to the North Carolina Ecosystem Enhancement Program. Consideration of this project is greatly appreciated. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.}, and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Compensatory mitigation is not proposed at this time• however if compensatory mitigation is required the applicant proposes to make an in-lieu payment to the North Carolina Ecosystem Enhancement Program 2.
