Operating a treatment facility, discharging wastewater or discharging specific types of
stormwater to waters of the State without valid coverage under an NPDES permit is against
Federal and state laws and could result in fines. Ifsomething changes and your facility would
again require stormwater or wastewater discharge permit coverage, you should notify this office
immediately. We will be happy to assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would
inform the new or prospective owners of their potential need for NPDES permit coverage.

Golder Associates NC, Inc. (Golder) is submitting the enclosed rescission request form on behalf of the
above -referenced facility. This form is being submitted following a site visit on March 23, 2017, with
representatives from Golder, the Winston-Salem 1 Forsyth County Utility Commission (the Commission),
and Glen White of the North Carolina Department of Environmental Quality.
Upon inspection of the facility, it was determined that no point source discharges representative of the
industrial activity (I.e., composting) occur on the property, nor are there any on -site point source discharges
to waters of the state. Therefore we are requesting rescission of the general permit coverage for this facility.
A facility map has been included for your reference.

Glen,
Based upon the following two findings during your recent site visit and our pending permit rescission
request (attached), we are suspending Stormwater runoff sampling at the Forum 52 Compost
Facility until after a final ruling from DEMLR on the request.
1) The two fabriform down chutes from which we have been sampling according to our SWPP
are not outfalls
2) The rip -rap channel which is an outfall is inaccessible and Stormwater runoff from it is not
representative of the of the industrial activity occurring on the property
We will continue to perform all other activities such as training, outfall certification, site inspections
and rain data collection, required in the General Permit, COC and SWPPP until after a final ruling by
DEMLR on the rescission request.

In accordance with your application for an NPDES stormwater discharge permit received on .tune
27, 2012, we are forwarding herewith the subject certificate of coverage to discharge under the
subject state — NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Based on your representation in the permit application that the Forum 52 Composting Facility is a
Type 1 compost facility, the provisions of the recently enacted Session Law 2012-200 pertain to
the facility. Consistent with the provisions of SL 2012-200, DWQ will permit all the composting
discharges from your Type I facility under the stormwater discharge provisions of the permit, and
the General Permit requirements related to process wastewater dischar_es do not apply to the
composting discharges from your Type 1 facility.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Energy Mineral and Land Resources, or any other federal, state, or local
governmental permit that may be required.
Please note that this certificate of coverage is not transferable except upon the specific action of
the Division of Energy Mineral and Land Resources.

have a NPDES permit for discharge of process wastewater. Notwithstanding any contrary provisions
in the General Permit, all discharges of stormwater, including stormwater which comes into direct
contact with or results from the production or use of any raw material, intermediate product, finished
product, byproduct, or waste product are authorized which comply with the stormwater pollution
management requirements, monitoring requirements, reporting requirements, and other conditions set
forth in Part I, Part II A - D, Part IV, Part V, Part VI, and Part VII of General Permit No. NCG240000.
In accordance with the provisions of Session Law 2012-200, the process wastewater management
requirements do not apply to the composting discharges from this Type I facility; and all composting
onrratinn r1kr1inroes are mithnri7erl when the facilily complies oniv with the stormwater nrovisions of
the General Permit. "To the extent any provisions may be read to impose the process wastewater
standards in the General Permit to discharges from the permittee's facility, the provisions are
suspended and do not apply.
This Certificate of Coverage is an enforceable part of General Permit NCG240000, and shall become
effective for the permittee on April 22, 2014,
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

DWQ has created a new, NPDES Stormwater general permit for composting facilities. The Solid Waste department
operates 3 composting facilities: one on Old Milwaukee Lane (near Rexam); another one just off of Reynolds Park Road
(immediately adjacent to the old rock quarry); and the third one at the Forum 52 Industrial Park in Rural Hall. What we
do here is compost leaves and grass.
A Notice of Intent (NOI) is due to NCDENR July 1. This NOI consists of 6 pages and one of the questions asked is: If there
are sewers within one mile of the site (in our case there is, in all three cases), will the wastewater treatment plant accept
the stormwater/wastewater discharge?

Please find the enclosed Notice of Intent application package for the composting facility located at
180 North Star Drive in Rural Hall, North Carolina. This facility is a Type 1 composting facility
operating under Division of Waste Management Pert -nit No. SWC-34-23, which receives easily

(i.e., untreated wood, pallets, etc.) for mulching operations in a separate area north of the composting
area. Finished products produced at this facility include mulch, compost, soil alnendlnellt, and boiler
fuel: The entire facility comprises approximately 17 acres, with the composting operations occurring
on approximately 2.5 acres.
The City composts the leaves utilizing windrows to compost wastes over an approximate three to
nine month period until it is utilized by the City or offered to the public. Therefore, both `finished
compost' and raw feedstocks are stored on site during various tines of the year, and both process
wastewater and stormwater discharges occur and are co -mingled. The City currently utilizes earthen
berms and a vegetated Swale as best management practices for this facility.
We understand that there is a bill presently making its way through the State legislature (S13 229) that
may affect out- decision on applying under this new General Stornhwater Permit. Our decision will
certainly be dependent on the bill's final wording.

wastewater discharges, delineation of drainage divides between the various subdrainage areas feeding each
discharge point, delineation of the 100-yr floodplain if present, and a notation of the water quality classification
of the receiving water that site waters eventually discharge to.

manufacturing sequence at the applicant's site, the general feedstocks, the determination of whether the
site's final product qualifies as `finished compost' as referenced in the General Permit text (NCG240000) and
