Provide good photos of the shoreline and buffer. Provide a cover letter of an unauthorized project that will be removed and replaced with riprap and give the pertinent information. Clarification if working through the buffer. Note any trees required to be removed (these will have to be replaced with 3" diameter (at breast height, native species trees). Based on the photo it looks like there was some clearing. There should be a wooded 30 ft buffer measured from the wall landward. $240 fee Aerial Plat of property Photos Location map. Site address is 182 West Paces Rd., Iredell County. Its located in the Westview Subdivision off the Langtree Exit. In order to obtain the dock permit, Duke has requested that they remove an old segmental retaining wall that is falling down at the lake edge and stabilize the bank, picture attached. This wall was installed by a previous land owner and was not permitted. I've attached a copy of the Duke Energy letter for your reference. Does NCDENR need to permit this removal and bank stabilization or can it go directly through Duke Energy Lake Services for approval? Once the wall is removed we would need to lay the bank back at a 2:1 and stabilize, this would require removal of a few trees. Our plan would be to remove the wall once erosion control measures are in place, lay the bank back at 2:1 and stabilize with rip -rap or vegetation and replant trees to make up for trees removed. Does NCDENR have any special requirements for an issue of such? Thanks for your help, if there is someone else I need to speak with in regards to this matter please advise. Kothadia; Lot 21 Westview Subdivision (Iredell Plat Book 29, Pages 55-57) Dear Mr. Childers: Thank you for your correspondence dated September 13, 2019. I have had the opportunity to discuss with my clients. Duke Energy Lake Services has reviewed your correspondence and investigated the shoreline at the above -referenced parcel, and I write to provide you with their response to your inquiries. Duke Energy classifies the shorelines of its FERC reservoirs in the Shoreline Management Plan ("SMP') maps. Per the SMP maps, the shoreline classification of the one hundred thirty-six (136) feet of shoreline associated with Lot 21 is as follows: • Environmental — seventy-seven (77) linear feet • Future Residential — fifty-nine (59) linear feet New or expanded private facilities and shoreline stabilization are not authorized within the Environmental classification or the fifty -foot offset associated with the Environmental classification, as you also noted in your letter. Based on the requirements of the SMP, the nine feet of shoreline falling outside the Environmental offset would have been eligible for a private facility or shoreline stabilization. However, based on a September 19, 2019, inspection of the shoreline of Lot 21, all 136 feet of the shoreline have been stabilized without Duke Energy's approval. This is a violation of the SMP which means that the entire lot is currently ineligible for a lake use permit. Mr. Mark Childers Page 2 Duke Energy Lake Services, however, is willing to evaluate a request for a lake use permit for the nine feet of shoreline falling outside the Environmental offset, provided that your clients, as the property owners, agree to submit an Engineered Restoration Plan developed by a North Carolina registered engineer or a Certified Wetland Specialist detailing how the shoreline will be restored back to its original condition. The restoration plan must include the following: • A plan for removing the unauthorized shoreline stabilization; • The locations, species, and numbers of native woody trees and shrubs proposed for installation; • A timeline for completing the work. Please note that the property owners will be required to provide an annual report demonstrating that the plantings have survived for three years following installation. Failure to submit such a report will result in revocation of any lake use permit approval issued for this location. After the restoration plan is approved in writing by Duke Energy and implemented by the property owner, Duke Energy will accept a lake use permit application for the nine feet of Future Residential shoreline outside the Environmental offset.
