The North Carolina Department of Transportation (NCDOT) is currently constructing this project
in Wake County. The Department previously applied for a NCDENR-DWQ Section 401 Water
Quality Certification and Neuse Buffer Authorization on March 11, 2009. Three permit sites
involving impacts to jurisdictional streams and regulated riparian buffers were presented in the
permit application. Two construction issues have been determined since submittal of this permit
application. These issues are addressed below:
ISSUE 1
New Permit Site Number 4 (Station 70+00 Rt and Station 73+50 Lt -LREV-)
Widening of the I-40 west-bound bridge over east-bound Wade Avenue requires installation of
new drilled piers. Installation of a pier at this location inadvertently came into contact with an
existing 54 inch corrugated metal pipe conveying a jurisdictional stream. The existing metal
pipe is damaged and must be repaired. The Department proposes to repair the damaged portion
of the pipe with a 48 inch sleeve. This will involve the following activities that impact the
stream and regulated riparian buffers: 1) Install any necessary erosion control devices, 2) Set up
bypass pump and dewatering devices (i.e. sand bags) in stream at outlet of pipe, 3) Set up
rigging/winch system at inlet of pipe, 4) Pull sleeve to point of necessary repair, 5) Conduct any
necessary rip rap stabilization along the streambank and 6) demobilize.
Impacts to Waters of the United States
The repair will result in impacts to an unnamed tributary to Richlands Creek (NCDENR-DWQ
Index No. 27-33-1, Best Usage Classification C NSW, 8-digit HUC 03020201) in the Neuse
River Basin (see New Permit Drawing 3 of 4).

Temporary Impacts
Construction activity will result in impacts to an unnamed tributary to Richlands Creek. This
impact is summarized below:
• 58 linear feet of stream impact associated with dewatering of the stream for
approximately our days.
Permanent Impacts
Activities associated with the repair at this pipe structure may result in impacts to the banks of
Richlands Creek. All efforts will be made to stabilize the streambank with matting. However,
the site conditions may warrant stabilization with rip rap. Note that any rip rap installed on the
streambank will be conducted within the limits of the temporary stream impacts noted above and
will not exceed 58 linear feet.
Riparian Buffer
Construction at this site involves the road crossing of a stream that is subject to the Neuse River
Buffer Rules. The stream is approximately depicted on the most recent version of the Raleigh
West topographic quadrangle (USGS, 1968, 1988) (New Permit Drawing 1 of 4) and is depicted
on the Soil Survey of Wake County (U DA-SCS 1970 (New Permit Drawing 2 of 4 .
Construction impacts at this site total , 88 square feet in o 1 and 534-square feet in Zone
(totaling 58 linear feet of riparian buffe See Ne it Drawr ased n
the impacts to the riparian buffer at this site, this crossing is ALLOWABLE. Temporary erosion
control measures will be installed as required within the permitted buffer footprint.
ISSUE 2
Permit Site Number 2 (Station 230+10 Lt -LREV-)
A field review at this location by the design-build contractor revealed that the field conditions
were not accurately depicted on roadway plan sheets 20 and 21. The purpose of this information
is to provide revised stream and riparian buffer impacts at this site and to provide Revised Permit
Drawing 6 of 9). This information is provided below:
Impacts to Waters of the United States
The repairs will result in impacts to an unnamed tributary to Walnut Creek.
Permanent Impacts
Construction activity will result in impacts to an unnamed tributary to Walnut Creek. These
impacts are summarized below:
• 8 linear feet of stream impact associated with installation of the replacement pipe
structure (fill in surface water)
• 14 linear feet of bank impact (addition of rip rap on the streambank) at the inlet of the
structure.
Temporary Impacts
The NCDOT proposes to temporarily dewater the stream in the work zone during construction
for approximately four days. This will be done within the limits of the stream impacts noted
above.
Riparian Buffer
Construction impacts at this site total 1,440 square feet in Zone 1 and 1,120 square feet in Zone 2
(totaling 22 linear feet of riparian buffer impacts). Based on the impacts to the riparian buffer at
this site, this crossing is ALLOWABLE. Temporary erosion control measures will be installed
as required within the permitted buffer footprint.
Summary
The Department requests modification of the Section 401 Water Quality Certificate and Neuse
River Buffer Authorization previously issued by your office on March 13, 2009. The NCDOT
proposes to use Department of the Army Section 404 Nationwide Permit (NWPs) 3 and 13. An
automated payment procedure has been implemented between the NCDOT and NCDENR-DWQ.
This procedure will enable the Division to apply for the 401 WQC modification without
submitting a check. This procedure will provide payment to the NCDWQ by charging the permit
application fee directly to the appropriate NCDOT WBS Element No. 36597.3.GV 1. If you have
