PROGRAM January 12, 2007 Mr. David Timpy US Army Corps of Engineers Wilmington Regulatory Field Office Post Office Box 1890 Wilmington, North Carolina 28403-1890 Dear Mr. Timpy: Subject: Revised EEP Mitigation Acceptance Letter: R-2245, Second Bridge to Oak Island), Brunswick County, Lumber River Basin (Cataloging Unit 03040207); Southern Outer Coastal Plain Eco-Region References: NCDOT Mitigation Request Letters dated January 17, 2006 and September 14, 2006 The purpose of this letter is to notify you that the Ecosystem Enhancement Program (EEP) will provide the riparian wetland, non-riparian wetland and stream mitigation required for the subject project. The impacts associated with this project are located in Cataloging Unit 03040207 of the Lumber River Basin in the Southern Outer Coastal Plain eco-region. As indicated in the NCDOT's mitigation request letter dated January 8, 2007, the impact amounts to both stream and non-riparian wetland has changed and impacts to riparian wetlands are now included. The impacts associated with this project are as follows: Stream 15 feet Riparian Wetland 0.026 acre Non-Riparian Wetland 21.442 acres There remains no coastal marsh wetland impact associated with this project. This mitigation acceptance letter replaces the mitigation acceptance letters issued on March 1, 2006 and October 9, 2006. Compensatory stream and wetland mitigation associated with this project will be provided in accordance with Section X of the Memorandum of Agreement between the N. C. Department of Environment and Natural Resources, the N. C. Department of Transportation, and the U. S. Army Corps of Engineers signed on July 22, 2003 (Tri- Party MOA). If the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from EEP. Based on the information supplied by you in letter dated January 8, 2007, the impacts are located in CU 03040207 of the Lumber River Basin of the Southern Outer Coastal Plain Eco-region (SOCP), and are as follows: Riparian Wetlands: 0.026 acre Non-Riparian Wetlands: 21.442 acres Stream: 15 feet This mitigation acceptance letter replaces the mitigation acceptance letters issued on February 28, 2006 and October 9, 2006. EEP commits to implementing sufficient compensatory wetland and stream mitigation to offset the impacts associated with this project by the end of the MOA Year in which this project is permitted, in accordance with Section X of the Memorandum of Agreement between the North Carolina Department of Environment and Natural Resources, the North Carolina Department of Transportation, and the U. S. Army Corps of Engineers, signed on July 22, 2003.
