4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The majority of the site consists of a maintained meadow. An unnamed stream with perennial flowtransects the central portion of the site from west to east. A wooded corridor is located
along the stream. Palustrine forested (PFO) wetlands are located along the stream corridor, and palustrine emergent (PEM) wetlands extend south into the meadow. An existing access
road extends south from Camp Burton Road along the western boundary. An existing culverted stream crossing is located on the western portion of the site.
A dwelling is located on the northeastern portion of the site. The site in a rural peripheral of Greensboro. The surrounding properties are occupied by dwellings and wooded land.

SAW-2019-01884. Verbal approval obtained from Mr. Dave Bailey with the USACE. The final signed JD is pending. Sue Homewood of DWR issued a buffer determination for the site on
December 9, 2019. The perennial stream is subject to Jordan Lake Buffer rules.

4h. Explain the purpose of the proposed project:*
The proposed project includes development of a cell tower on the southwestern portion of the site. The cell tower Will aid in providing reliable cellular coverage to the rural areas
surrounding Greensboro.
There is an existing gravel access road and culverted stream crossing at the site. The cell tower pad is situated south of the stream. In order to access the cell tower for construction
and maintenance a culverted stream crossing is needed. The existing access road and stream crossing will be improved. Currently, the culvert is perched (1-2") above the ordinary
highwater mark. As such, water is seeping under the pipe. There is flow in the stream above the pipe and flow in the stream below the pipe, but no flow in the pipe.
The existing culvert is to be removed and replaced with an 18" reinforced concrete pipe (RCP) pipe. Installation of the RCP shall insure adequate flowand circulation patterns of the
stream are restored. Additional impacts to the buffer that are not already impacted by the existing gravel road shall not occur. There are no wetland impacts proposed with this project.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
A proposed cell tower will be built on the southern portion of the site in an existing upland meadow. An existing access road extends south from Camp Burton Road along the western
boundary. The proposed project will improve the access road and replace the stream crossing to allowfor improved flow of the perennial stream. The road and culvert improvements
are necessary to accommodate for the construction and maintenance of the cell tower.
The access easement will be 20' wide to accommodate for underground wiring and a 12' gravel access road. The existing 12" concrete culvert will be replaced with 40'x1.5' RCP. A
temporary inlet protection Will be installed to prevent downstream sedimentation during construction.
The proposed cell tower will be a 220' self-support tower located within a 50'x50' fenced compound. Gravel will be placed Within the fenced compound. A double rowof silt fencing will be
placed along the stream and Wetlands to protect against sedimentation during construction.
Various equipment will be used during construction and may include bulldozers, backhoes, trenching equipment, dump trucks, a crane, pile drivers, and pickup trucks. Noise impacts are
to be expected during construction and will be limited to daylight hours. Existing tree lines will provide a noise and visual buffer to surrounding areas. After construction, typical day-to-
day operation of the cell tower will not generate excess noise. Pickup trucks are expected to be used to access the site for general maintenance of the facility.

The proposed project is utilizing an existing access road that is cleared and routinely mowed by the property owner. Additional encroachment into the
buffer is not anticipated with the proposed project. See project drawings from section C4j.

The proposed project is utilizing an existing access road, and stream crossing, that extends south from Camp Burton Road. The access road is
routinely mowed and maintained by the property owner. The cell tower placement was strategically placed outside of the wetlands on the southern
portion of the site. Wetland impacts have been avoided by utilizing the existing access road. The need for tree clearing has also been minimized by
utilizing the existing access road. Utilizing the existing stream crossing location, additional impacts to the stream are avoided.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The proposed access road and area beneath the cell tower will consist of gravel. Gravel was chosen because it doesn't add any impervious surface to
the site. A double row of silt fencing will be placed on the upland side of the perennial stream to reduce sedimentation during development. A
temporary inlet protection device will be installed into the stream to reduce sedimentation during the culvert replacement and improvement of the
existing stream crossing. Additional potential impacts to aquatic resources or respected buffers on site from construction activities are not anticipated.

maintain permeability.

To Whom It May Concern:
The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

web site often for updated information or changes
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.
Guidance for minimizing impacts to migratory birds for projects including communications
towers (e.g., cellular, digital television, radio, and emergency broadcast) can be found at: http://

Not all Threatened and Endangered Species that occur in North Carolina are subject to section 7
consultation with the U.S Fish and Wildlife Service. Atlantic and shortnose sturgeon, sea
turtles,when in the water, and certain marine mammals are under purview of the National Marine
Fisheries Service. If your project occurs in marine, estuarine, or coastal river systems you should
also contact the National Marine Fisheries Service, http://www.nmfs.noaa.gov/

9-Step Process

Step 1: Action Area
To determine the action area, mark the project footprint on a topographic map. Identify the range
of impacts such as; ground disturbance, changes in water quality and quantity, air quality, lighting
effects, and noise disturbance.
The proposed cell tower will be located on the southern portion of the site. An existing stream
crossing will be improved as part of the project. A stream is located within a wooded area on the
central portion of the site. A wetland surrounds the stream and extends south into the grassy field.
Silt fencing shall be used to minimize sediment laden stormwater runoff during construction.
Therefore, adverse impacts to the streams or ditches are not anticipated.
Step 2: Species List
Use the USFWS Information, Planning, and Consultation (IPaC) system to determine if any listed,
proposed, or candidate species may be present in the action area.
Headwater utilized the IPaC system to obtain a copy of the federally listed threatened and
endangered species for Guilford County. A copy of the official species list is enclosed with this
report. Additionally, a query of the USFWS threatened and endangered species by county was
completed. Based on our assessment of the on -site conditions, Headwater did not identify areas
of potential habitat for the federally listed threatened and endangered species.
Step 3. State Coordination
Determine whether a documented occurrence of any listed, proposed, or candidate species is
within the action area by contacting the NHP.
On January 2, 2020, Headwater performed a query of the NHP database. Headwater's query of
the NHP database indicated there are no records for rare species, important natural communities,
natural areas, or conservation/managed areas within the project boundary.
Step 4: Suitable Habitat
Determine whether listed/proposed/candidate species may occur based on the habitat present
within the action area for each species on the species conclusion table. Review the species
information provided in IPaC, and the information provided by NHP, to determine whether the
action area contains suitable habitat for each species.
A review of the federally listed threatened and endangered species is detailed on pages 3 and 4
of this report. Based on our assessment of the on -site conditions, Headwater did not identify areas
of potential habitat for the federally listed threatened and endangered species.
According to NHP, there are no biological occurrences mapped within the site boundary.
Step 5: Critical Habitat
There is no critical habitat present within the action area.
Step 6: Eagle Protection
The bald eagle (Haliaeetus leucocephalus) is protected by the Bald and Golden Eagles Protection
Act (the Eagle Act). The Eagle Act protects the bald from take and disturbance.
An adult bald eagle (Haliaeetus leucocephalu) has a white head, white tail, and large yellow bill;
the remaining plumage is dark brown. Immature individuals are generally dark brown with light
splotching. Bald eagles are a large bird of prey with a five to seven -foot wingspan. Breeding and
roosting habitat is generally located near large bodies of water; such as, coastal areas, bays,
rivers, lakes, etc. The bald eagle constructs large nests in tall mature trees or cliffs. Tree species
vary greatly and include pines and hardwoods. The same nest may be used year after year.
Winter roost sites vary in their proximity to food sources. Bald eagles are an adaptable species,
and their habitat can be found throughout the United States.
Headwater did not observe bald eagle roosts, nor is there sufficient feeding grounds for the bald
eagle within the proposed action area.
Step 7: Northern long-eared bat (NLEB)
The USFWS: Raleigh Field Office requires this species be taken into consideration due to
relatively recent rise of "white nose syndrome" in this bat population.
The northern long-eared bat (Myotis septentrionalis) is 3 to 3.7 inches long with a wingspan of
nine to 10 inches. They are dark brown, with a pale underside. As its name suggests, this bat
distinguishes itself by its long ears. In winter, the northern long-eared bats spend winter in caves
and mines. In summer, the northern long-eared bat roosts underneath bark and cavities of trees.
This bat has also been found roosting in barns and sheds. Northern long-eared bats emerge at
dusk to feed. They primarily fly through the understory of forested areas feeding on moths, flies,
leafhoppers, caddisflies, and beetles, which they catch while in flight using echolocation or by
gleaning motionless insects from vegetation.
According to USFWS records, the NLEB is not known to be present in Guilford County. Wooded
land is located on the central portion of the site. Potential roost trees are present within the
wooded area.

present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine

Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record

Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/

guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
