Thank you for taking the time to submit, an electronic Notice of Intent (eNOl) for the Atlantic Coast, Pipeline. 1 want to let,
YOU know, however, that, this project, is not required to obtain coverage under the NCGO1 permit,. This is because 40 C.E.R.
22 26.(c)(1)(iii) exempts the following permittees from the requirement to obtain NPDES permits:
(iii) The Q.22rator of an existing or new discharge composed entirely of 1D.rrn.
water__from an oil or gas exploration, production, processing, or ............................. rent operation,
or transmission facility y is not required to submit a ermit .. Iication in accordance
with paragraph -Lc 1 i of this section, unless the facility:
(A) Has had a discharge of 51D.rrri...._wat..r resulting in the discharge of a reportable
quantity for which notification is or was required pursuant to .:...._C FR...._1._1.7_,._2._1.. or .40
F_...._3.2_,._6. at anytime since November 16, 1987; or
( ) Has had a discharge of .t.r�.rrri...._.t..r resulting in the discharge of a reportable
quantity for which notification is or was required pursuant to .:0...._ .F ...._11.0_,._6. at any
time since November 16, 1987; or
() Contributes to a violation of a water quality standard.
This project, is still subject, to all of the requirements that, are included in the Erosion and Sediment. Control Plan approval
and the Post -Construction permit, that, have already been issued by the Division of Energy, Mineral and Land Resources.
1 am going to reject, the eNC II that, was submitted for the Atlantic Coast, Pipeline project, on the grounds that, it is not
subject, to the permit,. we have checked our database and we have not issued any Certificates of Coverage for Atlantic
Coast, Pipeline projects to date.
