Dear Mr. Malone:
This office has reviewed the subject erosion and sedimentation control plan. We find the
plan to be acceptable with modifications and hereby issue this letter of Approval with
Modifications. The Modifications Required for Approval are listed on the attached page. This plan
approval shall expire three (3) years following the date of approval, if no land -disturbing activity
has been undertaken, as is required by Title 15A NCAC 4B .0129.
As of April 1, 2019, all new construction activities are required to complete and submit
an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the
NCG010000 Construction Stormwater General Permit. This form MUST be submitted and COC
issued prior to the commencement of any land disturbing activity on the above -named project.
The NOI form may be accessed at deq.nc.gov/NCG01. Please direct questions about the NOI form
to Annette Lucas at Annette.lucas@ncdenr.gov or Paul Clark at Paul.clark@ncdenr.gov. After you
submit a complete and correct NOI Form, a COC will be emailed to you within three business days.
Initially, DEMLR will not charge a fee for coverage under the NCG01 permit. However, a $100 fee
will soon be charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff
in Raleigh.

MODIFICATIONS REQUIRED FOR APPROVAL
Project Name: 4689 Ellisboro Road

Modifications pursuant to applicable North Carolina General Statutes and or Regulations:
1. Additional measures may be required - The applicant is responsible for the control of
sediment on -site. If the approved erosion and sedimentation control measures prove
insufficient, the applicant must take those additional steps necessary to stop sediment from
leaving this site. [15A NCAC 4B .0115]
2. Any off -site borrow and waste required for this project must come from a site with an
approved erosion control plan, a site regulated under the Mining Act of 1971, or a landfill
regulated by the Division of Solid Waste Management. Trash/debris from demolition
activities or generated by any activities on site must be disposed of at a facility regulated by
the Division of Solid Waste Management or per Division of Solid Waste Management or
Division of Water Resources rules and regulations. [15A NCAC 413.0110]
Additional Comments:
Be advised, the North Carolina Sedimentation Pollution Control Act allows the Land Quality
Section to address the downstream erosion of property. This is outlined within 15A NCAC
0413.0109. If downstream erosion is observed after grading commences, corrective actions
and a revised plan may be required to address decreasing the water's flow velocity to the
maximum allowable value as outlined in 15A NCAC 04B.0109(d).
2. Be advised that any party initiating any further land -disturbing activity on the property
and/or proposed tracts shown on the plan would be required to obtain an approved erosion
control plan and coverage under the NCGO10000 General Permit as part of this common
plan of development. [GS 113A-54.1, NCGO10000]
3. Be advised, the 7/14-day soil stabilization requirements apply to any section of the project
where land -disturbing activities have temporarily or permanently ceased and shall
supersede any less stringent stabilization requirement on the plans. [G.S. 143-215.1]
