Director Division of Water Quality January 5, 2007 DWQ Project # 06-1931 Craven County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Rivershore Properties, LLC 240 Craven Street New Bern, NC 28560 Subject Property: Rivershore Neuse River [030410, 27-(104), SB, SW, NSW] REQUEST FOR MORE INFORMATION Dear Sir or Madam: On December 18, 2006, the Division of Water Quality (DWQ) received your undated application to fi110.17 acres of wetlandand 0.00 square feet of Zone 1 Neuse River basin protected riparian buffers and 0.00 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential subdivision at the subject property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide five copies of the following information so that we may continue to review your project. Additional Information Requested: Please show all wetland impacts including fill slopes on the site plan. Be sure to label your referenced "site 1" on your plans. A legend would be helpful. 2. Please indicate the location of the protected buffers as overlays on the site plan. Please be sure to break out the buffers as Zone 1 and Zone 2 clearly on the site plan. 3. Please locate all planned sewer lines on the site plan. 4. Please specify the percent of project imperviousness for pockets of high density (i.e., houses and roads, etc.) based on the estimated built-out conditions. 5. Please indicate all sformwater outfalls on the site plan. Please indicate the diffuse flow provision measures on your site plan. Be sure to include all applicable operation & maintenance agreements and associated worksheets. 7. Please advise if the ditch on the eastern side of the property is new or existing. Please describe how diffuse flow of this feature into the canal leading directly to the Neuse River will be assured. 8. Please consult with the USACOE regarding which 404 permit the USACOE would use to authorize this project. In our experience, NW18 has not been applied for impacts exceeding 0.010 acres of fill in 404 wetlands. The average lot size proposed is 0.20 acres. Note No. 4 on your plans states, "No 404 wetlands are to'be disturbed on any individual lot without proper permits." This implies that purchases of these small lots would be expected to apply for 404/401 permits for their own lots. Please note that this does not satisfy the need to avoid and minimize wetland impacts up front during the design stage. Specifically, Lots 1 (driveway access), 27, 30-38, and 40-43 all have substantial wetland cover. Please provide specific building envelopes, to include patios, which shows these lots will be developed without additional fill.:. If this is not possible, these lots will need to be re-designed. You should note that filling wetlands to create a high-ground back yard would not be allowed. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and will be providing the DWQ the requested information at a later date. Please contact me in writing and Kyle Barnes of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize -any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested. within your application are not authorized (at this time) by the DWQ.
