Please find attached the AJD completed for the non -jurisdictional wetlands on -site. We were actually also concerned about how DWR may be able to handle this one (and other now non -jurisdictional features with these new WOTUS definitions!) so I spoke with Sue Homewood for guidance. Sue indicated that since we were able to confirm this was a man-made isolated pond feature with fringe wetlands which developed over time we would fall under the exemption for these features from a while back (https://files.nc.gov/ncdeg/Water%20Quality/Surface%20Water%20Protection/401/FringeWetlandsOnIsolatedPondsPol icy-2020Citation U pdate. pdf). The delineation data was utilized during the designing of the site to avoid and minimize wetlands to the maximum extent practicable. We also worked with the design team to keep impacts only within a portion of the wetland area heavily dominated by invasive species and avoid the better quality portion of the wetland downslope (NCWAM form for portion of the wetland to be impacted is attached for reference). (If that is done great) Also, you will need to complete the dichotomous key/NCWAM to confirm if the non -JD wetland is a basin or a bog. If it is a basin or bog you will be permitted under the "Isolated Wetland" permit. HOWEVER, at this time, if the non-jd wetland is not a basin or a bog, the impact cannot be permitted, thus must be avoided. You should also provide information regarding avoidance of the other proposed wetland impact. A site visit in the meantime would be a good idea. Questions? Give me a call.
