Subject: Revised Modification Request for Section 404 Individual Permit, Section 401 Water
Quality Certification and Neuse Riparian Buffer Authorization for Interstate 40 Widening
and Improvements from I-440/US 64 (Exit 301) to just north of SR 1525 (Cornwallis Road),
including improvements to NC 42 and SR 1010 (Cleveland Road) in Wake and Johnston
Counties, Federal Aid Project No. IMNHF-040-4(139)301; TIP Numbers I-5111 and I-4739,
Division 5. Debit$570 from WBS Element 42346.3.1.
Dear Mr. Alsmeyer:
As you are aware, the North Carolina Department of Transportation (NCDOT) applied for permits for
the subject project on May 7, 2019 and a modification on both December 20, 2019 and May 28, 2020.
The Corps of Engineers issued the Section 404 permit for the project on September 6, 2019 and
modifications on February 11 and June 11, 2020, respectively. The North Carolina Division of Water
Resources issued the 401 Water Quality Certification for the project on July 10,2019 (NCDWR Project
No. 20190593) and modifications on January 22 and June 3, 2020, respectively. This current
correspondence replaces our July 24, 2020 request with updated information regarding modifications to
Site 44 and 17.
Site 44
A field revision is being requested at Site 44. Currently, stream SEQ is piped from the east side of I-40
to the west side, travels along the west side of I-40 for approximately 80 feet, then is piped back to the
east side. The original design kept this drainage pattern by boring a new 54" steel pipe to the west side
of I-40 and then extending the existing 60"pipe to convey SEQ back to the east side. The new design
proposes to install a 54"pipe along the east side of I-40 that outlets to the same 60"pipe,thus eliminating
the need to bore a new 54" steel pipe. The 60"pipe will still be extended to convey any drainage from
the west side to the east as well as to act as an equalization pipe. For construction sequencing, stream
SEQ be placed in the relocation channel,as currently authorized,for approximately 3 months. However,
this will be a temporary diversion and shown as temporary excavation in wetlands on Permit Drawing
Sheet 124. Once the 54"pipe is installed along the east side of I-40, this channel will be backfilled to
preexisting elevations,vegetated, and restored as a wetland.

This modification will result in the following:
• 0.043 ac of permanent wetland excavation becoming temporary
• +765 ft2 of impacts to Buffer Zone 2 through abandoning the channel
When recalculating the impacts for Site 44, it became apparent that the wetland impacts had been
inadvertently under reported in the initial application. These numbers have been corrected on the attached
revised impact summary sheets. Permanent wetland fill increases by 0.04 acre to 0.78 acre total.
Temporary wetland increases by 0.03 acre to 0.17 acre total. A cross-section of Site 44(Permit Drawing
93A)is also included as that had been omitted from the initial permit application.

Site 17
During a recent review, it was noted that the swale running along -Y5RPA-21+00-23+00 LT (near Site
17 in the permit drawing detail B) was closer to the ramp than depicted in the permit drawings. As a
result, it is funneling water behind the new 60" RCP headwall as opposed to beyond it and causing
erosion. It was determined that the least invasive solution would be to install an open-ended pipe to
receive the flow and discharge to Stream SOE. An elbow will be installed at the base of the slope to
direct the flow towards the channel. This will prevent flow in Stream SEO from entering the proposed
pipe during higher flow events. Based on the drainage area,a 15"CSP is required.
Installing the 15" CSP will not result in additional surface water impacts since this section of the SEO
channel was being riprapped and considered fully impacted. However, this modification does increase
buffer impacts:
• +606 ft2 Buffer Zone 1 impacts
• + 1,165 ft2 Buffer Zone 2 impacts
Attached are revised permit drawings depicting the affected area, all of which have a revision date of
either 8/3/2020 or 8/11/2020:

Compensatory Mitigation

if necessary.
REGULATORY APPROVALS
Section 404: NCDOT requests modification to the USACE Individual 404 Permit for the project as
required for the above described activities.
Section 401: We are also requesting modification of the Section 401 Individual Water Quality
Certification and Neuse Riparian Buffer Authorization from NCDWR. We are providing this request to
NCDWR, for their approval. Authorization to debit the$570.00 Permit Application Fee from TIP No. I-
5111/I-4739/WBS 42346.3.1 is hereby given.
