This was for violations that occurred in February 2020: Aqua's Response: Original NOV Response: The Beau Rivage wastewater treatment plant effluent does not have a recurring issue or typically high ammonia concentration. With the fully functional fixed film process, an elevated ammonia concentration cannot be reasonably explained. There was no known slug discharge into the facility and no known upset. The ORC will complete more frequent ammonia process testing and check the process to determine if this is an emerging problem.July 2018 was the last occasion when we received an ammonia lab result greater than 10 mg/I at the Beau Rivage WWTF. Page Two Mr. Morella Sanchez King December 28,2017 Additional Response: The likely cause for the Beau Rivage plant ammonia exceedance was due to a higher than normal influent ammonia concentration and failure by the certified contracted lab to notify AQUA of the exceedance as required per laboratory regulation and procedure. AQUA notified the lab of this oversight and was told the "report's NH3 alert not being sent was simply an oversight", and "the action limits are in our database" further noting that"The alert should have been mailed prior to you receiving the final report." They have assured us that they will strive to be more diligent. Further instances will result in AQUA reviewing future opportunities with the lab. If we had received the alert prior to the end of the month, AQUA would have been able to assess the situation quicker and at a minimum been able to take additional samples to further assess impacts. All other samples taken in the month of February were compliant indicating that there were not significant issues at this facility. Additionally,the permitted average ammonia loading for the plant at 0.200 MGD capacity, is 6.67 lbs of ammonia per month; however, based on the monthly average flow of 0.107 MGD at a monthly average ammonia concentration of 6.625 mg/I,the resulting loading for the month of February was 5.91 lbs which is less than the permitted allotment. Based on the determination of penalty contained in G.S. 143-215.6A(c), Aqua requests remission of the$1,147,83 penalty as the degree and extent of harm to the resource was de minimis, the follow up sampling did not indicate that this exceedance was ongoing or significant in duration, there was minimum impact to the surface water, the violation was not committed willfully or intentionally and would have been rectified had Aqua received proper notification from the certified laboratory, nor was there any savings to the company for failure to comply with regulation. This assessment is based upon the following facts: a review has been conducted of the Discharge Monitoring Report (DMR)submitted by Aqua North Carolina Inc for the month of February 2020. This review has shown the subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit No. NC0065480. The violations, which occurred in February 2020,are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that Aqua North Carolina Inc violated the terms,conditions or requirements of NPDES WW Permit No. NC0065480 and G.S. 1 43-215.1(q)(6) in the manner and extent shown in Attachment A. I43-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and Conclusions of Law and the factors set forth at G.S. 143B-282.1(b), which are: (1) The degree and extent of harm to the natural resources of the State,to the public health, or to private property resulting from the violation; (2) The duration and gravity of the violation; (3) The effect on ground or surface water quantityor qualityor on air quality; 9 ty (4) The cost of rectifying the damage; (5) The amount of money saved by noncompliance; (6) Whether the violation was committed willfully or intentionally; (7) The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority; and (8) The cost to the State of the enforcement procedures. Within thirty(30)days of receipt of this notice,you must do one of the following: (1) Submit payment of the penalty, OR (2) Submit a written request for remission, OR (3) Submit a written request for an administrative hearing Option 1: Submit payment of the penalty: Payment should be made directly to the order of the Department of Environmental Quality (do not include waiver form).
