In response to the above mentioned notice of violation & intent to issue civil penalty for the
SSO located at 7 McDowell Street, MSD would like to provide you the following information on
the cause of the SSO and remedial action taken to correct the problem. Below is a description
of the events, a timeline of work performed, and a copy of the press release.
This overflow Occurred several days after Hurricane Florence hit the area with the'w.ettest
tropical cyclone to ever hit the Carolinas. The area received heavy rains earlier in the week
causing increased flow to Town Branch. Heavy flows from the storm eroded away the stream
bank exposing MSD 's 21" interceptor and undermined old slabs of concrete and curbing which
had been placed in years past to stabilize the creek bank. The storm undermined the bank
dislodging a large piece of concrete, causing it to fall onto MSD 21" clay interceptor breaking the
line allowing sewer to flow into the creek. Below is'a list of work orders initiated and brief
summary of actions taken:
• W/O: 256140 9/21/2018 At 12;20 pm, customer called in a sewer leak on Amboy Road. At
1*00 pm, MSD staff discovered 21" main line was broken behind 7 McDowell Street and
pouring into Nasty Branch. Pipe #22-391302.
• W/O: 2561419/21/2018 —At 1:00 pm, emergency by pass was called. Crews started mobilizing
by-pass equipment. Construction manager was contacted. Construction equipment started
mobilizing to make necessary repairs. Town Branch was damned by 8:00 pm containing the spill
at Asheville Wastepaper. Pumps were installed at lower Town Branch at containment site and
all contaminated creek water was pumped back into sewer system continuously until clean
water samples were received and all clear given. Pumps were set up at spill location and
sewage was bypassed around the break in line by 10:00 pm. No swimming signs were posted at
designated locations. MSD's ORC contacted DWQ and county health officials reporting spill

•, W/O: 256142 9/22/2018 — Construction crews made three separate repairs on line.
• W/0: 256155/256148 9/22/2018 — CCTV cameras and vacuum truck assisted construction
crews pinpoint locations to repair and ensure no further breaks or issues.
• W/O: 256268/256149 9/22/2018 — Steam samples (am and pm) were taken at 6 designated
locations on the French Broad River.
• W/O: 256172 9/22/2018 — Creek clean up began. Crews swept creek with brooms, washed and
flooded the creek for the entirety of the day.
• W/O: 256159 9/22/2018 — Pumps were manned 24/7.
• W/O: 256169 9/23/2018 — Creek clean up continued.
• W/O: 256271/256154 9/23/2018 —Sewer samples (am and pm) were taken at 6 designated
locations on the French Broad River.
• W/O: 2562719/23/2018 — Pumps were manned 24/7.
• W/O: 256195 9/24/2018 —,Creek clean up continued.
• W/O: 256188 9/24/2018 - Crews mechanically removed roots.
• W/O: 256187/2561619/24/2018 - Stream samples (am and pm) were taken at 6 designated `
locations on the French Broad River.
• W/O: 256212 9/24/2018 - Pumps were manned 24/7.
• W/O: 256203 9/25/2018 - Creek clean up continued and was completed at about 3:0.0 pm.
•' W/0: 256180 9/25/2018 — Stream samples, (am and pm) were taken at 6 designated locations on the French Broad River. Also, two rounds of samples were taken at 4 designated locations
on Nasty Branch at the request of Linda Wiggs.
• W/O: 256281/256204/256205 9/25/2018 — Crews continued to hydraulically root cut and video
sewer line.
• W/O: 256200/256213 9/25/2018 — Crews broke down and pulled in all emergency pumps and
other equipment. Construction tore down dam at Asheville Wastepaper.
• W/O: 256259 9/26/2018 -Stream samples (am and pm) were taken at 6 designated locations
on the French Broad River.
• W/O* 256210 9/26/2018 —Stream samples (am and pm) were taken at 4 designated locations
on Nasty Branch.
• W/O: 256202/256948 9/26/2018 — Crews continued to hydraulically root cut and video sewer
line.
• W/O: 256215 9/26/2018 — Crews hauled in the last bits of bypass equipment.
• W/O: 256259 9/27/2018 - Stream samples (am and pm) were taken at 6 designated locations
on the French Broad River. Paid advertisement went into the Citizen Times.
• W/O: 256277/256272 9/28/2018 — Last two rounds of stream samples were taken at 6
designated locations on the French Broad River.
• W/O: 256399/257056 10/31/2018 - Crews completed root cutting and videoing line. Successful
video made.
• W/O: 256487 11/5/2018 — Interceptor cleaning completed from spill location all the way down
to Asheville Wastepaper/French Broad River. Approximately,5,000 feet.

To summarize, MSD received a call in regard to possible sewer in Nasty Branch near
Amboy Road at 12:20 pm on Friday, September 21 st. Crews found the problem at 1:00 pm at 7
McDowell Street and initiated an emergency code red calling all needed crews into action.
Nasty Branch was damned at the convergence of the French Broad River and pumps were
constructed to pump sewer back into the collection system by 8:00 pm. The location of the
sewer line break was by-passed by 10:00 pm. MSD crews worked non-stop 24/7 for 5 days
containing the spill, reducing the spills impact, and making necessary repairs to the sewer line
which was originally constructed prior to 1904. MSD field crews worked a total of 349.7 regular
hours at a cost of $11,500.33 and 511.6 overtime hours at a cost of $19,865,14. Total labor cost
excluding overhead, equipment, fuel, food, and materials was in excess of $31,000.00 spent on
the above overflow remediation. l have included copies of work orders, stream sampling data,
press release, BIMS report and all supporting documentation. If you have any questions,

If an SSO is ongoing, please notify the appropriate Regional Office on a daily basis until SSO can be stopped.
Per G.S. 143-215.1C(b), the responsible party of a discharge of 1,000 or more of untreated wastewater to surface waters
shall issue a press release within 24-hours of first knowledge to all print and electronic news media providing general
coverage In the county where the discharge occurred. When 15,000 gallons or more of untreated wastewater enters surface
waters, a public notice shall be published within 10 days and proof of publication shall be provided to the Division within 30
days. Refer to the reference statute for further detail.
The Director Division of Water Resources may lake enforcement action for SSOs that are required to be reported to
Division unless It is demonstrated that:
1) the discharge was cause by sever natural conditions and there were no feasible alternative to the discharge; or
2) the discharge was exceptional, unintentional, temporary and caused by factors beyond the reasonable control of the
Permittee an owner, and the discharge could not stave been prevented by the exercise of reasonable control.

High water levels in Nasty Branch eroded creek bank exposing 21" clay sewer line. Concrete slabs and old curbing had
been placed on the creek bank for stabilization. Once the edge of the stream bank eroded away it undermined these
concrete slabs. It appeared that one of these concrete slabs slid from the top of the slope and busted the 21" clay line
allowing sewer to escape.

How was the SSO remediated (i.e. Stopped and cleaned up)?
MSD received a call at 12.20 PM in regards to sewer odor at 408 Depot ST Crews arrived on site at 12:25 PM and
investigated• finding the 21" clay sewer line broke and running into the creek Code red was intuited. Crews set up bypass
pumps to bypass the sewer leak dammed up creek at confluence of Nasty Branch and French Broad River, and pumped
the creek into the sewer system The creek was dammed and all flow was diverted into the sewer system at 8:00 PM on
9-211=2018a The sewer line was bypassed and sewer flow was diverted back into the sewer system at 10:00 PM on
9-21-2018 Construction crews were on site on 9-22-2018 making repairs to the sewer line. MSD crews were on site 24
hours a day manning two bypass pumps until repair was made MSD crews continued to pump the creek in its entirety into
the sewer system while the creek was manually flushed and swept removing all residuals and pumping back into the sewer
system Crews flushed and cleaned creek from 9-22-2018 to 9-25-2018. The dam in nasty branch was removed at 4:30 PM
on 9-25-2018.
