Fullwood, Executive Director MEMORANDUM TO: Doug Huggett Major Permits Processing Coordinator Division of Coastal Management FROM: David Cox, Highway Project Coordinator Habitat Conservation Program DATE: November 27, 2000 SUBJECT: NCDOT request for a CAMA/ Dredge and Fill permit for the Smith Creek Parkway. TIP No. U-92A/B. We have reviewed the information included in the package received from the Division of Coastal Management. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act (G.S. I I3A-100 through I I3A-128). We do not object to the issuance of the CAMA permit for this project provided that the following conditions are include in the CAMA Permit: 1. Bridges should be constructed with driven piles or drilled shaft construction, specifically piles should not be jetted. 2. Any pile driving or drilling activities should be enclosed in turbidity curtains. 3. If temporary access roads or detours are constructed, they should be removed back to original ground elevations immediately upon the completion of the project. Disturbed areas should be seeded or mulched to stabilize the soil and native tree species should be planted with a spacing of not more than 10'x10'. If possible, when using temporary structures the area should be cleared but not grubbed. Clearing the area with chain saws, mowers, bush-hogs, or other mechanized equipment and leaving the stumps and root mat intact, allows the area to revegetate naturally and minimizes disturbed soil. 4. No drill slurry or water that has been in contact with uncured concrete should be allowed to enter surface water. This water should be pumped onto barges or directly to high ground and disposed of properly. The Northeast Cape Fear River and Smith Creek supports anadromous fish and potentially the Shortnose sturgeon, therefore, we request that NCDOT use the anadromous fish moratorium include in the NCDOT official policy entitled "Stream Crossing Guidelines for Anadromous Fish Passage (May 12, 1997)". No in-water work should occur from February 1 to June 15. NCDOT use Best Management Practices for the protection of Surface Waters and sedimentation and erosion control measures sufficient to protect aquatic resources. SECRETARY SUBJECT: Environmental Agency Coordination Field Review Meeting, October 10, 1996 for Smith Creek Parkway, TIP No. U-92AB The meeting convened at the COE offices in Wilmington, NC. The specific goal of the meeting was to obtain agreement from the agencies as to the selection of the alignment location for Sections A and B of Smith Creek Parkway, and to initiate discussions related to avoidance and minimization efforts. Issues discussed included: 1. Jimmy Norris identified the area just west of McRae Street. It might be possible to reduce wetland impacts here by up to 0.8 acres by slightly shifting the roadway alignment to the north along the side of the existing US 117 (Castle Hayne Road) embankment. 2. Eric Galamb stated that for the project to receive Section 401 Certification from the state; wetland creation/restoration within the Smith Creek watershed itself will, as a minimum, be set at a 1:1 ratio irrespective of cost, with other mitigation allowed outside the watershed. (9 3. NCDOT is currently undertaking detailed geotechnical site assessment investigations to identify subsurface conditions which will help determine design options. Issues include: depth of muck, content of fill, presence of hazardous materials, subsurface stability, depth to freshwater aquifer. 4. Issues related to cumulative project impacts were raised. The meeting also identified possible areas/sites of agency concern. Four areas/sites of agency concern were identified which were then visited. These areas/sites are discussed below: Station 31+00 South flowing canal located just west of the Wilmington Waste Water Treatment Plant and the Recycling Center west of 23rd Street. * A culvert was proposed for this location. The agencies felt that this area should be bridged NCDOT noted that it may be possible to use a pile supported roadway at this location. The cost of this type of structure should be less than a bridge. It may also be possible to shift the Smith Creek Parkway westbound entrance ramp from 23rd Street, slightly to the north to reduce wetland impacts. However, complications at this canal crossing were noted by NCDOT. These complications are related to the connection of this entrance ramp to Smith Creek Parkway. If both the mainline and the ramp are built on bridged structure the design will become very complex and costly. Shifting the ramp location could also result in inadequate merge/weave distance due to the closeness to the next exit to the west (US 117 Connector). NCDOT will examine options here once geotechnical data for the area is received. Station 198+00 The US 117 Connector/Smith Creek Parkway Interchange area (near American Skin Company Waste Water Treatment Facility) * Agencies had no comments regarding this location. Station 180+00 Corbett Mill Property * Agency personnel were shown the location of the proposed parkway and proposed mitigation area further to the south and adjoining an oxbow along Smith Creek. The presence of fill was noted. A geotechnical investigation has been conducted in this area. Smith Creek will be bridged at this location. Station 165+00 McRae Street Crossing * At this location, the proposed roadway may be able to be shifted north to slightly reduce wetland impacts. * Agency personnel expressed concern for this tidally influenced marsh wetland One culvert currently connects this area with the marsh and Smith Creek to the east of McRae Street. The agencies would recommend that this marsh be bridged and that additional culverts be placed under McRae Street to enhance the hydrologic connection. McRae Street remains heavily traveled and illegal dumping continues along the roadside here as demonstrated by newly dumped tires observed during the field visit.
