I have reviewed the 401 Certification Application for the proposed grading and paving of
NCSR 1311, Rock Branch Road, in Madison County. An on-site visit was conducted on April 2,
2002, and it was determined that additional information is needed before a 401 Water Quality
Certification can be issued. The stream, Rock Branch, Class C waters, is located within the road
right of way and parallels the existing road from approximately Station 10+80 to Station 15+00,
Station 33+0 to Station 38+40, and from Station 48+70 to 51 +10. The application did not indicate
how these stream sections of Rock Branch would be protected during road construction. Also,
between Station 35+70 and Station 37+00 aquatic organisms were found to be living and
reproducing in an area noted on the straight line drawing as a wet ditch. Because of the
presence of these organisms it was determined that this is a perennial stream and resultant
impacts to this area may require mitigation.
It is requested that you look at these sites and provide the necessary information regarding
these stream impacts. Also, by copy of this letter was are asking the Corps of Engineers to place
this project on hold and this project will be placed on hold for our processing due to incomplete
information (15A NCAC 2H .0507 (h)).

APPROVAL of 401 Water Quality Certification with Additional Conditions

Dear Mr. Bryan:
You have our approval, in accordance with the attached conditions and those listed below, to impact
115 linear feet of Rock Branch and its unnamed tributaries in order to improve SR 1311 (Rock
Branch Road) in Madison County. The project should be constructed in accordance with your
application dated February 27, 2002 and additional information received on April 22, 2002. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification No. 3375 corresponding to the U.S. Army Corps of Engineers Nationwide Permit
Number 14. In addition, you should acquire any other federal, state or local permits before you
proceed with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit unless otherwise specified in the Water Quality Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us, in writing, and send us a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre or stream impacts exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For
this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. The NC Division of Water Quality has determined that the wet ditch between Sta. 35+70 and Sta.
37+00 is a perennial stream. DWQ recommends that the stream be relocated and that NCDOT
submit plans for the channel relocation to DWQ for approval.
2. To the extent practicable, storm water must be directed to buffer areas or retention basins and
must not be routed directly to streams.
3. All work shall be performed: during low flow conditions.
4. All mechanized equipment operated near surface waters must be regularly inspected and
maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or
other toxic materials.

5. The presence of equipment in the channels must be minimized. Under no circumstances must
rock, sand or other materials be dredged from the wetted stream channel under authorization of
this permit, except in the immediate vicinity of the culverts.
6. Existing vegetated buffers shall not be mowed in order to utilize it for storm water sheet flow.
7. Riparian vegetation must be reestablished within the construction limits of the project by the end
of the growing season following completion of construction. Native trees and shrubs shall be
placed in the vegetated buffer adjacent to the stream to the extent practicable.
8. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate
of Completion" form to notify NCDWQ when all work included in the §401 Certification has
been completed. The responsible party shall complete the attached form and return it to the NC
Division of Water Quality, 4011Wetlands Unit when construction has been completed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

I have enclosed a straight-line diagram with erosion control plan, a PCN application for
NWP #14, and a vicinity map relative to the proposed project on SR 1311, Rock Branch
Road, Madison County, NC.
Rock Branch Road is currently a 12-14 feet wide gravel road. Division of Highways
plans to pave the road 18 feet wide and increase the typical section. Grading will be light
to moderate.
We propose to extend six existing culverts on Rock Branch and UT's. Total culvert
extensions will be 115 linear feet with no more than 65 feet on a single stream. No
stream relocation will be performed for the project. Existing channel morphology will be
maintained upstream and downstream of the culverts. The culverts will be placed below
existing streambed elevation. Riparian vegetation will be reestablished along disturbed
areas associated with the culvert extensions. Stormwater will be diverted through grass-
lined ditches or vegetated buffers prior to entering streams.
A property owner has performed a stream relocation on Rock Branch between Station
11+00 and 15+00. The activity may not have been authorized by the Corps and DWQ
and may warrant investigation by these agencies.
No significant effect on federally listed species (threatened or endangered) or their
habitats is anticipated.

Commission Mountain Region Coordinator, to comment directly to the Corps concerning
the permit request.
By copy of this letter, we are asking Ed Ingle, Area Roadside Environmental Engineer, to
comment on the above project. Temporary encroachment into the buffer zone of the
Rock Creek will be required throughout the project (Stations 10+00 to 18+00, 26+00 to
27+00, 33+00 to 37+00, and 48+00 to 54+00). The stream is classified as trout. A buffer
variance will be required.
By copy of this letter, I am forwarding seven (7) copies of the application package to
Cynthia Van der Wiele, NC DENR, Division of Water Quality, 401/Wetland Unit for
review and comment. Please charge the application processing fee of $200.00 to work

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

4. Pond Creation
If construction of a pond is proposed, associated wetland and stream impacts should be
included above in the wetland and stream impact sections. Also, the proposed pond should

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
littp://li2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that

The existing compacted gravel roadway acts as an impervious surface. Paving of the roadway
should eliminate sedimentation from fines associated with gravel surface treatment. The
roadway surface will be 40% of right of way acreage. Stormwater will be diverted through
settling basins or grass lined buffers prior to entering the streams.

PIPE INSTALLATION NOTES
1) Install erosion control devices. In streams, where necessary, rock silt
screens will be used.
2) Remove material and existing pipe while limiting, as much as possible,
material and sediment from entering the stream and/or escaping from the
project.
3) Prepare pipe foundation while again taking care to limit, as much as
possible, material and sediment from entering the stream and/or escaping
from the project. Where possible, new grade will be below the existing
streambed. If needed, bedding material will be clean stone.
4) Place the new pipe and compact backfill.
5) Install slope protection on outlet and inlet ends of pipe. Also complete
installation of erosion control measures and perform maintenance as
needed on existing measures.
6) Establish permanent vegetation as soon as possible.

Silt fences and temporary silt ditches shall be installed after clearing and
before grading.
Temporary stone ditch checks shall be installed as soon as ditch-line is
established.
Pipe outlet and inlet protection will be done as soon as the pipe is installed.
