Wilson, Environmental Engineer Subject: Pisgah National Forest — Prescribed Burn Environmental Review Record Comments Project No.: 11-0296 Yancey County The Appalachian Ranger District of the Pisgah National Forest proposes to perform a prescribed burn in the Seven Mile Ridge area in Yancey County (approximately 400 acres). The Division of Water Quality has the following concern: 1. The USDA should ensure that all Forestry Practice Guidelines are met/maintained after completion of the prescribed burn, so that sediment due to exposed soils does not enter surface waters. Skvarla, III Governor Director Secretary October 18, 2013 David and Debbie Wheeler 22 Red Barn Lane Burnsville, North Carolina 28714 Subject: Notice of Violation - Illegal Discharge of Wastewater Catbird Lane Mobile Park Yancey County Dear Mr. and Mrs. Wheeler: On October 17, 2013, staff from the Division of Water Resources observed wastewater running from your mobile park property on Catbird Lane and into nearby Pine Swamp Branch designated as class C; Trout waters. This letter is to advise you that this discharge is a Violation of North Carolina General Statute 143-215.1(6). The discharge of wastewater, as described above, must be stopped immediately. REQUIRED RESPONSE To prevent further action by the Division you must take appropriate steps to eliminate the illegal discharge. This Office also requests that you respond in writing by November 1, 2013 and address the following items: • Actions taken to eliminate the discharge • Actions taken to prevent the occurrence of such an event in the future Your response should be sent to the attention of Jeff Menzel, Division of Water Quality, 2090 US HWY 70, Swannanoa, NC 28778 or jeff.menzel@ncdenr.gov. Wilson, Environmental Enginee Subject: Pisgah National Forest — Yancey County (Appalachain Ranger District) Accessible Hunter Access Site Project No. 11-0034 Yancey County The USDA/National Forest Service/Appalachian Ranger District is seeking comments on the proposed accessible hunter access site near Flat Top Road in the Pisgah National Forest). DWQ offers the following general comments (which may, or may not, apply to the proposed project): NPDES Construction Stormwater Permit NCGO 10000 — This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If the proposed project will disturb greater than one acre, an NCGO 10000 permit is required. 2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers, a 401 Water Quality Certification is necessary. Depending on the amount of impact to streams and/or wetlands at the proposed site — written concurrence from this office may be required. The DWQ is unsure if jurisdictional waters or wetlands will be impacted by the proposal (or if the Forest Service may be exempt from this requirement) — this should be confirmed prior to impacts to the site. 3. If the disturbance is. near Classified Trout streams, a 25 foot undisturbed buffer is required to be maintained. Thank you for the opportunity to comment.
