Subject: Determination of Permit Type and Mitigation Ratios

The meeting was held via Webex to determine the appropriate permit being sought and mitigation
ratios for the permitting of U-5026 and R-5720. An agenda and mapping was provided prior to the
meeting. The following list details the discussion points of the meeting.
• Permit Type – The D-B Team has reviewed the Regional General Permit (RGP) 201902350 –
Bridges, Road Widenings, and Interchanges that was just authorized and would like to move
forward in that direction.
o Eric was in agreement if we meet the conditions.
o Eric also asked Rob if there was a General Certification to accompany the RGP 50. Rob
verified that GC 4135 would cover it.
• Mitigation Ratios
o Wetlands – no WAM forms were developed
Assume 2:1 for fill/excavation
Eric said a 1:1 would be appropriate for mechanized clearing. Chad shared that
those areas would likely return back after construction.
o Streams / Buffers
Stream relocations – request no mitigation required or a lower ratio – Eric said
he would want to see an ecological benefit of the relocation and mimicking the
existing channel. Vickie shared that the channel at Site 6 was very straight and
the new channel should be similar. No riprap in the bed and we are proposing
live stakes and planting where we can. Eric said to include the amount that was
in riprap at the end of the culverts and identify the existing linear feet vs the
relocated linear feet.
Streambank stabilization / channel improvements - no mitigation will be
required
Intermittent channels – Eric stated these are tributaries with minimal aquatic
function and no mitigation would be required.
• Permit Schedule (Assumes RGP 50 below)
o Draft to NCDOT 6/5 for DOT 10 day review – will be later due to changes made as a
result of the meeting
o Comments on Draft to HDR 6/19
o HDR corrects and sends final back by 6/26
o NCDOT verifies permit is corrected and submits to Corps July 1
o Eric stated that there isn’t a specific timeframe with the RGP 50; however, they try to
meet the same as the Nationwide permits if possible.
o Eric stated that when the draft is ready he would like to review it ahead of time in order
to make certain everything needed is included.
o Eric asked discussed the Developer’s project near the roundabout and Site 6. Vickie
shared that NCDOT was not including the Developer’s plans at this time and the
Developer would apply for his/her own permit.
• Other topics
o Rob mentioned to make certain we had our stormwater plan together and asked if we
had any questions on that to contact them to discuss.
