A reply or explanation for each comment issued by your office is provided below in bold and follows the original format of your emailed memorandum. 1. Please complete Part 11.2 of the SWU-101 application form specifying the type of project. The Stormwater Management Permit Application Form has been updated and the type of project is specified as "High Density" 2. The project density in Part IV.8 of the SWU-101 application form does not match the project density shown in the table under Part IV.10. Based on the calculation in Part IV.7 the total project area is 74.11 Ac. However in performing the revised calculations for a high density project an area of 7.87 Ac. was used since that was the receiving drainage area for the development of outparcels #2 & 3. Outparcel #1 will permit and treat any impervious area that is developed at that time. The current project will only account for the buildout for Street "A" and "B" as well as the Bojangles outparcel and Outparcel #3. Any future development on the total property area will be permitted. 3. Please submit a Supplement EZ form for the project. The Supplement EZ form can be found here: https://deg.nc.gov/about/divisions/energy-mineral-land-resources/energy- mineral-land-permit-quidance/stormwater-bmp-manual. The Supplement EZ form has been completed and attached for this project. Because the individual who signed the application is not listed on the Secretary of State's website, further verification that this person is authorized to sign the application is required. This could be either a signed letter from one of the individuals listed by the Secretary of State confirming that this person is authorized or other official documentation from the LLC. Both a letter of consent signed by managing member Cameron McRae and a Certification of Delegation of Authority from It's Farm Time have been provided authorizing Brad Mercer to sign on behalf of It's Farm Time. 5. The project does not meet the goals of the low density regulations, which are to spread out built upon area and promote sheet flow over pervious areas. Although the project density over the whole property is less than 24%, most of the pervious area is outside of the project area. According to the deed restrictions and site plans, the actual BUA percentage on the three subdivided lots will be approximately 75.1 %, 76.2%, and 75%, with further BUA in the rights -of -way. Also, very little flow over pervious surfaces is provided. The Division will consider the project high density. As stated in response #2 the application for development now includes only Street "A" & "B" as well as the Bojangles site and Outparcel #3 at 75% impervious. Outparcel #1 will no longer be included and this is noted on sheet CE-01. A Wet Pond has been designed to treat runoff from the impervious area and the pond is detailed on Sheet CE-10. A signed and notarized O&M Agreement has been included and the attached calculations and Supplement EZ Form reflect this. 6. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https://edocs.deg.nc.gov/Forms/SW Project Submittal Two copies of the plan set have been included showing all modifications.
