Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).

All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number is no
longer effective. Therefore, the exclusive authority to operate and discharge from this facility

A. (3) ENGINEERING ALTERNATIVES ANALYSIS EXPANSION
Prior to the Division final approval to expand above 0.002 MGD, the Permittee is required to submit an
Engineering Alternative Analysis (EAA) as outlined in the Division EAA guidance, and demonstrate no
other alternatives are feasible. Any expansion must be in accordance with the Lake Wylie Management
Plan.
If this facility is built in phases, plans and specifications for the next phase shall be submitted when the
flow to the existing units reaches 80% of the design capacity of the facilities on line. At no time may the
flow tributary to the facility exceed the design capacity of the existing units.
A. (4) ALTERNATIVE ANALYSIS FOR CONNECTION TO RIVERPOINTE WWTP
The Permittee shall investigate and submit a report six months from the effective date of this permit for
connecting to the Riverpointe WWTP, an adjacent private tiomestic treatment facility. The report should
include a summary of actions, _an estimated timetable to complete the connection, and list any
anticipated issues. If Riverpointe will not accept The Hideaways domestic wastewater then a letter from
Riverpointe WWTP must be obtained by the Permittee and submitted in lieu of the report. Any
questions should be directed to the Mooresville Regional Office/Surface Water Protection.

BACKGROUND
GoGo Properties, LLC a property management company and current owner, has applied for
renewal of a private WWTP package plant that treats the domestic waste for three residences
currently used as rental property. Only one of the rental home was occupied when the renewal
application was received. The property was sold and transferred to the current owner in 2006.
Domestic wastewater from one residence gravity feeds directly into the treatment plant, the other
two residences domestic wastewater is collected in a common sump and then pumped to the
treatment unit. Wastewater influent enters the rotating biological contact unit and flows to a
settling/clarifier basin. The next treatment step is filtration via a sand filter. The filtered
wastewater then flows through a tablet chlorinator followed by a tablet dechlorinator and
discharges into Lake Wylie.
A contractor, Biotech, Inc. removes and disposes of the accumulated solids in the rotating contact
unit as needed.
The discharge is into a segment of the Catawba River that is considered one arm of Lake Wylie,
downstream of Mountain Lake. Stream flows are defined according to the control release from
Mountain Lake. The current stream class WS-V, B was established in 1992.

The current permit has two effluent tiers, orie approved for the current operation -and a second for _•
a previous requested expansion with conditional approval. The Division had determined the
existing treatment system met the criteria for a sand filter -based system and was assigned a
Facility Class I designation. However, the primary treatment technology in the expansion tier will
be biological -based and will result in the automatic re -class of the expanded facility to Facility
Class II. The permit has a condition that requires an Engineering Alternative Analyses (EAA) be
completed and approved by the Division prior to allowing expansion to 0.200 MGD.
As part of an agreement with Mecklenburg County the county inspects waste treatment systems
in their county and. provides a report to the Division. The last county inspection was conducted in'
March 2010, significant items sited in the report were:
1) Build up of solids in the influent pipe
2) Mechanical noise believe to be from worn bearings
3) Floor of treatment building wet, suspect source from treatment facility
4) Roof of building housing treatment works is damaged, allows outside exposure
5) Effluent pipe stops 100 yards from lake, suspect joints have not been sealed
6) Flow meter had been removed, using manual method to determine flow
The operator was present and agreed to report these concerns to the owner.
The region also inspected this facility in April 2010. The physical condition of the equipment and
anticipate treatment inconsistency were areas of concern. It was noted a lifting station for
Riverpointe WWTP is in close proximity. In an informal discussion between the region and
Riverpointe WWTP, they would consider taking GoGo Properties domestic wastewater.
In May 2010 a fire occurred in the one occupied residence served by the WWTP. Subsequently,
the electrical service was cut off to the residence. At the same time, the treatment system ceased
operation and at some later point the collection sump overflow, discharging its contents to the
immediate area. It was determined that the same electrical service that was terminated for the
house damaged by fire also supplied electrical to the treatment plant and sump. Also, a water
source originating from the house damaged by fire was adding water to the sump. The plant
operator located and terminated the water source, and was working with the local utility to install
electrical power to the treatment facility. The Mooresville Regional Office surveyed the site and
worked with the operator to resolve any clean up issues.
An Authorization to Construct a dechlorination system was approved and began operation in
October 2007. The deadline to be compliant with the permit TRC limit was December 2006.
COMPLINACE & REGION RECOMMENDATIONS
The facility delayed installation and start up of a dechlorination system resulting in non-
compliance with its TRC limit for 11 months. Besides the TRC violations there were 5 other
parameter limit violations and 7 other parameter frequency violations. From 2007 through 2010
this facility has paid $12,037 in penalties accessed for compliance violations.
There is another private WWTP facility lift station in the vicinity (Riverpointe NC0071242) that
the regions recommends as an alternate for domestic waste disposal thus retiring this system. The
region recommends adding a condition in the permit requiring the Permittee to investigate
connecting to the local private WWTP facility and to provide a written report to the region

Based on the information provided in the inspection reports the component list was updated. The
influent sump/pump and dechlorinator descriptions were added.
Lake Wylie Nutrient Strategy
All nutrient requirements remain the same and will continue.
Effluent page 0.200 MGD
The expanded flow effluent page 0.200 MGD was reviewed for consistency with policies for
Facility Class II dischargers in this segment of Lake Wylie. During its original development, the
current effluent page was assigned a year round armnonia as nitrogen maximum monthly average
limit in lieu of a toxicity test. To be consistent with Division guidance for establishing parameter
limits, ammonia as nitrogen will be assigned an additional daily maximum limit, 5 times the
maximum monthly average limit. The monitoring frequency for fecal coliform was reviewed and
increased to weekly. The EAA special condition remains applicable, for clarity the special
condition narrative was edited.
Region recommendation
The region recommendation requiring the Permittee to investigate and report its findings on
connecting to Riverpointe WWTP will be incorporated into a special condition with a due date
six months from the effective date. The Division promotes regionalization and elimination of
discharges when available.
Permit review and approval
Since this discharge is into a water supply class stream, the DEH regional engineer approval is
required. A copy of the draft permit and the DEH approval form will be sent to the DEH regional
engineer. As the result of being a Lake Wylie discharge, a copy of the draft permit and of the fact
sheet will be sent to South Carolina Department of Health and Environmental Control for
comment. Mecklenburg County will also be sent a copy of the draft for comment. Copies of the
final permit will be sent to South Carolina and Mecklenburg County.
SUMMARY OF PROPOSED CHANGES
In keeping with Division policies the following will be incorporated into the permit:
• Component list updated. Influent sump/pump and tablet dechorinator added.
• TRC footnote was revised. Expired compliance date replaced with measurement
protocols.

Last week I told the oRC that additional information was required for the permit
application and to
check with the owner for correspondence from the state. The oRC and myself was
unaware of a lift
station that pumps to the plant (6/7/2010). The owner appeared to unaware that the
lift station did
not -have power. Apparently the lift station that is two houses down from the one
that caught fire is
tied into the same power as the treatment plant. I assume this to be the case since
there was no
power on the lift station. I spoke with Susan Rosenblatt and told her to have the
lift station vacuumed
out and power would need to restored to the lift station in order for the sewage to
reach the
treatment plant. The treatment plant does not appear to be receiving any flow.
Based on this, I
believe the house that caught fire may have been gravity fed (possibly) and the
other houses are on
the lift station.

schematic was needed before we could process their NPDES renewal application. The
owner has not
responded. Any thoughts on how or what to include as the equipment included in this
System? I
would suggest that the ORC be asked to provide a hand drawn schematic with the
important details ,
such as where the electrical power originates, how electrical outrages are handled,
how is emergency
contact conducted, etc. You also mentioned as a better option to get the owner to
connect his
wastewater to an adjacent private WWTP. Any progress on moving towards this option?

Marcia, apparently there is a lift station that pumps to the treatment plant. Steve
Wrobleski
(CMU) got a call from a citizen about sewage going to the lake on Sunday. He could
not get
through to our ER person for some reason but he did get a hold of the ORC who said
he would
have a vacuum truck go and pump out the lift station. I was unaware of the lift
station and
from the comments the other day with the ORC, he mentioned a water line on the
burned
house was causing the lift station to feel up quickly until they made repairs. From
the
comments it would appear that burned house was gravity fed and the other two houses
were
pumped? Any way apparently the one house was powering the treatment plant and lift
station.

Ron,
I spoke to the ORC regarding the connection to an adjacent private wWTP, however, no
action has
been taken by the owner as of yet due to the ongoing issues with the electrical
service to the WWTP.
According to the ORC, the electrical issues should be resolved by no later than
tomorrow.
Per my SR on this facility, I would condition the NPDES permit to ask for an updated
EAA, which would
include an evaluation of the possibility of connecting to the adjacent Riverpointe
WWTP. That gives us
much more leverage to push them towards the eventual elimination of this discharge.
As a FYI, I spoke to the utility that owns the Riverpointe WWTP and asked them if
accepting the
Hideway's flow was something they would consider. The response I received was that
it was certainly
something they would look at, but they would have to route it through their
corporate office upon
receipt of an official request. For sure, it sounded like a plausible option to
them. Now all we have to
do is get the Hideways to pursue it.

C. Describe receiving stream features and pertinent downstream uses: Discharge enters a
cove of the lake just off the main channel. There are other homes surrounding the cove
that are not connected to the WWTP. The lake is used for primary and secondary
recreation.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

d. Description of existing or substantially constructed WWT facilities: The existing WWT
facilities consist of a rotating biological contactor (RBC unit) followed by a contact
(settling) chamber, a sand filter, effluent (tablet) disinfection, and tablet dechlorination.
e. Description of proposed WWT facilities: There are no proposed facilities at this time.
Dechlorination was added in 2009.
f. Possible toxic impacts to surface waters: Chlorine is added to the waste stream,
however, dechlorination is provided.
2. Compliance Background: This facility was assessed five civil penalties in 2008 for TRC
violations. The penalties have been paid.
PART III - OTHER PERTINENT INFORMATION
Special monitoring or limitations (including toxicity) requests. None at this time, however,
Part IV of the current permit should be removed prior to reissuance as it does not apply to this
facility.
PART IV - EVALUATION AND RECOMMENDATIONS
The permittee has requested renewal of the subject permit. There have been no changes to the
permit since the last renewal, however, dechlorination was added during the last permit term.
The technology used by this facility is prone to mechanical breakdowns and, at best can only be
expected to provide secondary levels of treatment. Many of the components are beginning to
deteriorate and repair is becoming more problematic. Although there are three (3) rental homes
connected to the WWTP at this time, due to the poor economy only one is currently being occupied. It
was learned during the site visit that there may be a lift station nearby that is connected to the WWTP
serving the adjacent Riverpointe development (NC0071242). Although the Riverpointe WWTP is
owned and operated by a private utility company, a quick review of self monitoring data indicates that
sufficient capacity may be available to accept the flow from the Hideways. Therefore, given the
current condition of the WWTP, the difficulty the operator has experienced in keeping this facility
operational, and the marginal degree of treatment that the existing facilities can provide, the Division
should request that the permittee re-evaluate options that might be available to eliminate this discharge,
including a potential connection to the Riverpointe WWTP. The request can be added as a condition
to the permit upon renewal and given a suspense date of six months from permit reissuance.
