Steve Tedder It appears that Union County is heating up not only on the discharge side (Crooked Creek - letter advising them that it is zero flow and that we likely would not approve any expansion at that location unless a low flow study determined that there was flow), but also on the nondischarge side. Steve has suggested that we start putting together a fact sheet on the Union County situation, for when the 14th floor starts calling. Carla, we may need to ask for some assistance from you guys in pulling this all together. Since this area is an area that Susan originally handled as a modeler (I think) and Dave worked on the most recent letter, I'd like to ask that they provide Randy assistance in pulling together some of the discharge issues (as needed). I don't know how quickly this thing is going to heat up and I don't think that it will require everyone to spend a tremendous amount of time on it. I'd like to ask that everyone put a little time into over the next several days so that we can be prepared to handle the questions that may arise. This guy represents a developer that put in sewers in one of 12 subdivisions that is hooked to the Dry Fork Plant that never got a permit. He has correspondence indicating that they submitted the application to Union County and the county issued a letter to them indicating that it was ok to construct. Now, a newspaper in Union County has written an article that named his subdivision and the other 11 that are constructed and have been since 1991 without a permit. He indicated that the MRO had a meeting in Union county sometime this week and wanted Page 2 information on that and how he could be implicated. I told him the best thing to do would be to talk to Rex and he should be able to bring him up to speed on what has happened so far. He is concerned that even though Union county was supposed to apply for the permit and they didn't, he went to construction and completed and now it has been done without a permit. I can understand his concern and I guess this is in reference to the one subdivision for Judy Overhutz that Mike Shaliti was involved with back in 1991 and 92 and then earlier this year, wrote them a letter indicating that Union county had the permit, when in fact, the permit application had not been submitted to us. This ought to be good. He was refered to talk to you by other State agencies.
