Your agencies were the last three that commented regarding the April 29 mitigation proposal. I am starting my decision
document and would like to close the loop and get your agency’s thoughts on this latest mitigation proposal to off set
the unavoidable impacts associated with R 3300 B.

The purpose of this letter is to revise the mitigation proposal that was submitted in our original
application dated April 7, 2020 and revised mitigation proposal dated April 29,2020. As stated in the
previous mitigation proposal,the Department received correspondence from the Division of Mitigation
Services (DMS)that there are no riparian or non-riparian wetland mitigation credits available in White
Oak HUC 03020302. Therefore,the Department proposed that all mitigation required for this project,
except for the remaining non-riparian mitigation credits(78.43 acres)that were purchased from the
Northeast Cape Fear Umbrella Mitigation Bank in conjunction with U-4751, be provided by DMS in
Cape Fear HUC 03030007 (CF-07).
After assessing the locations where DMS has available mitigation credits and considering their proximity
to the project location and agency comments regarding the previous mitigation proposal,the Depaitinent
has decided to reserve all non-riparian migration credits required for this project from the Northeast Cape
Fear Umbrella Mitigation Bank due its close proximity to the project. The Department has also reserved
all available riparian credits from the Northeast Cape Fear Umbrella Mitigation Bank,which is currently
25.6 credits. The remaining riparian mitigation credits required for this project, approximately 9.51
credits,will be debited from DMS sites within HUC CF-07 consistent with the MOU. Email

available credit is attached and an official reservation letter from the Northeast Cape Fear Umbrella
Mitigation Bank will be provided when it is received.
Due to the lack of existing mitigation sites and opportunities for new mitigation sites within White Oak
HUC 03020302,the Department believes that this revised mitigation plan is the best proposal the
Department can offer for impacts associated with this project. The Department also believes that this
proposal provides the best overall ecological benefit by mitigating for all impacts with the closest
mitigation site to the project that has available credits. Based on the circumstance described above and
efforts taken by the Department,we would like for your agency to consider only requiring the standard
2:1 mitigation ratio for all project impacts.

Good talking with you this afternoon. Thanks for forwarding the letter from the Corps. I had the chance to review with
Cal, and he is good with reserving the credits for R-3300 through September.
If you can send an email request, I will prepare a formal reservation letter that will hold the credits in place for this
project.
