I am recirculating a supplement to the Public Notice initially issued on April 7,
2020 (https://www.saw.usace.army.mil/Missions/Regulatory-Permit-Program/Public-Notices/ \[saw.usace.army.mil\]) for
the modification of TIP R-3300, section B, Hampstead ByPass in Pender County. As stated in the attached from the
applicant the initial mitigation plan was to utilize DMS for impacts not covered by leftover credits already purchased
from a private mitigation bank in the Cape Fear HUC. DMS has reported a shortfall of credits in a the White Oak HUC
which comprises a small amount of the project area closest to Highway 17 near the proposed northern interchange.
DMS has reserved credits in the Cape Fear HUC as a replacement for the White HUC shortfall. This letter represents the
final mitigation proposal for the requested modification.
I’m requesting any comments regarding this aspect of the project to be within the Public Notice comment period which
closes on May 8, 2020. If additional time is necessary please advise.

The purpose of this letter is to revise the mitigation proposal that was submitted in our original
application dated April 7,2020. The Depai Inient has received correspondence from the Division of
Mitigation Services(DMS)that there are no riparian or non-riparian wetland mitigation credits
available in White Oak HUC 03020302. Therefore,the Department would like to propose that all
mitigation required this project, except for the remaining non-riparian mitigation credits(78.43
acres)that were purchased from the Northeast Cape Fear Umbrella Mitigation Bank in conjunction
with U-4751, be provided by DMS in Cape Fear HUC 03030007 (CF-07). We have contacted
DMS and they have informed us that they have adequate credits available in CF-07 to satisfy the
mitigation requirements. The Department would also like to request that the agencies consider only
requiring the standard 1:1 mitigation ratio for the impacts outside of CF-07. The Department
believes that there is overall ecological benefit by mitigating for all impacts associated with this
project in CF-07 where the impacts and effects of the project are more prevalent. A revised
acceptance letter from DMS is attached.

Subject: Mitigation Acceptance Letter: Division 3 Project:TIP R-3300B,Hampstead Bypass—South of
NC 210 to North of SR 1563,Pender County
The purpose of this letter is to notify you that the Division of Mitigation Services(DMS)will provide the
compensatory stream and wetland mitigation for the subject project. Based on the information supplied by you on April 7,
2020 and additional correspondence received on April 29,2020,the impacts are located in CU 03030007 of the Cape Fear
River basin and in CU 03030001 of the White Oak River basin in the Southern Outer Coastal Plain(SOCP)Eco-Region,
and are as follows:

NCDOT provides DMS with annual stream and wetland impact projections for all anticipated projects in February
of each year and had planned on providing all of the wetland mitigation for this project and requested DMS provide all of
the stream mitigation. Upon review of the NCDOT's available wetland mitigation bank credits,additional wetland credits
were needed from DMS that were not anticipated and have not been included in the DMS annual mitigation needs. DMS
has reviewed the current inventory of wetland mitigation credits in these cataloging units,and based on discussions with
your office,DMS plans to offset all of the wetland impacts associated with this project with available wetland credits from
Cape Fear 03030007.
This mitigation acceptance letter replaces the mitigation acceptance letter issued on April 9,2020. If the
above impact amounts are revised,then this mitigation acceptance letter will no longer be valid and a new mitigation
acceptance letter will be required from DMS. If you have any questions or need additional information,please contact Beth
