APPROVAL of 401 Water Quality Certification with Additional Conditions: MODIFICATION.

Dear Ms. Simon:
You have our approval, in accordance with the attached conditions and those listed below, to incur 15
linear feet of additional impacts to an unnamed tributary of Island Creek at Sta. 39+00 in order to upgrade
SR 1621 (Carl Fox Road) in Alexander County. The project should be constructed in accordance with
your application dated July 1, 2002 and additional information received on July 25, 2002. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification No. 3375 corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number
14. In addition, you should acquire any other federal, state or local permits before you proceed with your
project including. (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. This approval will expire with the accompanying §404 permit unless otherwise
specified in the Water Quality Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you-must notify us in writing, and you may be required to
send us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, or if stream impacts exceed 150 linear
feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For
this approval to be valid, you must follow the conditions listed.in the attached certification and any
additional conditions listed below.
1. All mechanized equipment operated near surface waters must be regularly inspected and maintained
to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic
materials.
2. The presence of equipment in the channels must be minimized. Under no circumstances shall rock,
sand or other materials be dredged from the wetted stream channel under authorization of this permit,
except in the immediate vicinity of the culverts.
3. Existing vegetated buffers shall not be mowed in order to utilize it for storm water sheet flow.
4. Riparian vegetation must be reestablished within the construction limits of the project by the end of
the growing season following completion of construction.
5. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted
when practical. If rip-rap is necessary, it must be limited to the stream bank below the high water
mark, and vegetation must be used for stabilization above high water.
6. Upon completion of the project, the NCDOT or its authorized agent shall complete and
return the enclosed "Certificate of Completion" form to notify NCDWQ when all work

included in the §401 Certification has been completed. This will fulfill the requirement of
Condition 16 in WQC 3375.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that

road in this area to eliminate a dangerous curve to provide safe passage for the travelling
public.

for excavation and placement of riprap.

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
This is a permit modification request for 15 feet of additional impacts at Station 39+00 on SR
1621 The previous permit issued was for 60 feet of impacts at Station 39+00. The USACE
Action ID Number, which authorized this, was Action ID 200130268 and the DWQ Project
Number is 00-1533 Along with the 60 feet authorized for the pipe replacement on an unnamed
tributary, to Island Creep 50 feet of impacts was authorized for a bridge replacement on Island
Creek on SR 1621 The construction of the road is currently in progress. The bridge
replacement has been completed and the pipe was originally installed on 4/02. It was discovered
during the construction of the new alignment in the area of the pipe location that additional
footage was needed , for proper slope and construction of the road.

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The realignment of the road at the pine was necessary to eliminate a dangerous hairin curve to
provide safe passage for the travelling public.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stringide.html.

and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)

Enclosed is a permit modification request for the PCN application submitted on 12/7/00
for additional fill impacts on SR 1621, Carl Fox Road in Alexander County, NC.
The project consisted of the grading and paving of SR 1621 with a bridge replacement at
Station 54+00 and pipe replacement at Station 39+00. Due to changes in road alignment
and road grade to construct a safer roadway for the travelling public, minimal additional
fill is required at the Station 39+00. Sixty feet of the originally permitted 72" CMP was
installed on 4/02, an additional 15 feet of 72" CMP is needed on the downstream side to
complete the construction of the roadway at Station 39+00. It is anticipated that the
additional pipe can be attached to the existing 72" CMP and be installed 6" below
existing streambed elevation.

The North Carolina Department of Transportation Bridge Maintenance Unit, proposes the
following project for your issuance of a Section 404 Permit. We believe this project can be
accomplished under NWP 414, Linear Transportation Crossings.

LOCATION: SR 1621
STREAMS: Island Creek & Unnamed tributary to Island Creek
PROJECT DESCRIPTION: Sta. 54+00- Bridge 9262: Replace existing 50' long x 20' wide
timber and steel bridge with a 50' long triple line of 142"x91" CMPA. Sta. 39+00: Replace
existing 42" CMP (40' long) with a 60' long line of 72" CMP. Class "C" waters involved. No
wetlands or HQW involved. Less than 1/2 acre will be affected at each site. The installment of the
CMPA on Island Creek and the CMP on the unnamed tributary to Island Creek will impact a total
of 70 linear feet of streams.
By copy of this letter, we are also requesting a concurrence letter from the Wildlife Resources
Commission, US Fish & Wildlife Service, and the State Historic Preservation Office.
By copy of this letter, I am forwarding seven (7) copies of the application package to John Dorney,
NCDENR, Division of Water Quality, 401/Wetland Unit for review. A $200.00 check is enclosed
for application processing.
I have conducted a survey for the bog turtle (Clemmys muhlellbergii) and its habitat in the project
area on November 21, 2000. I have also contacted Marella Buncick with the U. S. Fish and Wildlife
Service concerning bog turtle locations in Alexander County. She has concurred there are no
known bog turtle habitat areas in the project area vicinity. No significant effect on this species or
its habitat is anticipated.
A site location map and a sketch of planned activities are attached. A stringent erosion and
sedimentation control program will be implemented during the project construction, and every
effort will be made to complete the work in a timely manner.
Your earliest consideration for this request would be greatly appreciated. Our personnel are

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Ms Simon:
You have our approval, in accordance with the attached conditions and those listed below, to incur
70 linear feet of impacts to Island Creek for the purpose of constructing Bridge 262 on SR 1621 in
Alexander County. The project should be constructed in accordance with your application dated 7
December 2000 (received 11 December 2000). After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3289. This certification
corresponds to the Nationwide Permit Number 14 issued by the Corps of Engineers. In addition, you
should acquire any other federal, state or local permits before you proceed with your project
including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply
Watershed regulations. This approval will expire with the accompanying 404 permit, unless
otherwise specified in the Water Quality Certification. The following additional conditions will be
required:
1. The culvert shall be installed in such a manner that the original stream profile_ is not altered (i.e.
the depth of the channel should not be reduced by a widening of the stream bed).
2. All work shall be performed during low flow conditions.
3. Care must be utilized such that live (wet) concrete does not enter the stream channel.
4. The presence of equipment in the channels must be minimized.
5. Rip-rap shall not be placed above the bank-full elevation.
6. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for
storm water sheet flow.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed
in the attached certification.

The North Carolina Department of Transportation Bridge Maintenance Unit, proposes the
following project for your issuance of a Section 404 Permit. We believe this project can be
accomplished under IWP #14, Linear Transportation Crossings.
COUNTY: Alexander
LOCATION: SR 1621
STREAMS: Island Creek & Unnamed tributary to Island Creek
PROJECT DESCRIPTION: Sta. 54+00- Bridge #262: Replace existing 50' long x 20' wide
timber and steel bridge with a 50' long triple line of 142"x91" CMPA. Sta. 39+00: Replace
existing 42" CMP (40' long) with a 60' long line of 72" CMP. Class "C" waters involved. No
wetlands or HQW involved. Less than 1/2 acre will be affected at each site. The installment of the
CMPA on Island Creek and the CMP on the unnamed tributary to Island Creek will impact a total
of 70 linear feet of streams.
By copy of this letter, we are also requesting a concurrence letter from the Wildlife Resources
Commission, US Fish & Wildlife Service, and the State Historic Preservation Office.
By copy of this letter, I am forwarding seven (7) copies of the application package to John Dorney,
NCDENR, Division of Water Quality, 401/Wetland Unit for review. A $200.00 check is enclosed
for application processing.
I have conducted a survey for the bog turtle (Clemmys muhlenbergii) and its habitat in the project
area on November 21, 2000. 1 have also contacted Marella Buncick with the U.S. Fish and Wildlife
Service concerning bog turtle locations in Alexander County. She has concurred there are no
known bog turtle habitat areas in the project area vicinity. No significant effect on this species or
its habitat is anticipated.
A site location map and a sketch of planned activities are attached. A stringent erosion and
sedimentation control program will be implemented during the project construction, and every
effort will be made to complete the work in a timely manner.
Your earliest consideration for this request would be greatly appreciated. Our personnel are

SUBJECT: Review of an application by North Carolina Department of Transportation
(NCDOT), SR1621, Carl Fox Road Permit Modification, Alexander County
NCDOT is requesting a letter of concurrence from the North Carolina Wildlife Resources
Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The
NCWRC has reviewed information provided by the applicant, and field biologists on our staff are
familiar with habitat values of the project area. These comments are provided in accordance with
provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The modification requested is due to changes in road alignment. Additional impacts are
requested for and additional fifteen (15) linear feet of 72" culvert at station 39+00. NCDOT
indicates that the extension can be installed 6" below existing streambed elevation.
Providing that the existing new pipe has been properly installed 12" below streambed grade, we
will not object to the extension. We recommend that the extension be placed 12" below
streambed grade. In the event that this is not practicable, NCDOT may consider instream grade
control structures, culvert baffles, or improved floodplain benching to enhance base flow depths
as aquatic passage issues increase with increased culvert lengths and reduced installation depths.
