The Division of Water Quality (DWQ) 401 Oversight and Express Review Permitting Unit has
received a response to our letter dated February 2, 2010 via e-mail from Bob Zarzecki of Soil &
Environmental Consultants, PA (S&EC).
The General Water Quality Certification issued for the project on October 3, 2006 states "For
this approval to be valid, compliance with the conditions listed below is required".
As stated in Condition 6 of the 401 Water Quality Certification dated October 3, 2006,
"Mitigation must be provided for the proposed impacts as specified in the table below". Under
the column "Compensatory Mitigation Required" in the table, the mitigation specified is "19.6
(acres) combined restoration, creation, enhancement and preservation".
DWQ acknowledges that additional wetland areas may develop in the wetland creation areas on
the site, as stated in your consultant's e-mail response to our February 2, 2010 letter. At the
conclusion of the monitoring period (and assuming that the remainder of the site meets
performance standards), if additional wetland acreage has not developed that satisfies Condition
6, additional mitigation may be required.
