Kittrell Hill Bank Parcel Credit Release — Tasks 1,2 & 7
Dear Mr. Griffith:
On March 26, 2020, the Division of Water Resources (DWR) approved a Bank Parcel Development
Package (BPDP) from Eco Terra Partners, LLC (EcoTerra) for the above -referenced site under the
terms and conditions of the Kittrell Hill Buffer Mitigation & Nutrient Offset Mitigation Banking
Instrument (MBI). On July 15, 2020 and August 3, 2020, the DWR received a recorded conservation
easement and corresponding plat respectively for the subject site. Additionally, Eco Terra provided
confirmation that the conservation easement for the subject site has been successfully assigned to the
Southern Conservation Trust, Inc (SCT). SCT is a 501(c)(3) non-profit corporation and has been
approved by DWR as a long-term steward for this site.
On May 4, 2020, DWR received documentation from Eco Terra that the subject site had been
constructed in its entirety and monitoring plots had been installed. On June 16, 2020, Katie Merritt
with DWR, with assistance from staff with Eco Terra, inspected the site and confirmed that the
subject site had been completely planted, all monitoring plots were installed, sufficient conservation
easement placards had been installed along the entire easement boundary, and stream banks had been
seeded and stabilized where required.
In accordance with the MBI, signed on March 26, 2020, the following Project Milestones have been
met and the corresponding credits shall be released:

7) Item B (1) of Section X in the Instrument (assign the easement 5%
to stewardship) has been completed and approved by DWR

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and 45% of your Nitrogen nutrient offset credits
(0.45 x 21,147.061 lb-N = 9,516.177 lb-N) and 45% of your Neuse buffer Restoration credits (0.45 x
363,817 ft2 = 163,717.65 ft2) are now available for sale. Please note that the credits being released
reflect those provided in the draft As -Built Report and corresponding As -Built Survey provided by
Eco Terra on June 24, 2020. This As -Built Report has not been reviewed in its entirety, but credits
appear to be consistent with the As -Built Survey. Any credit adjustments that are deemed necessary
upon review of the As -Built Report will occur with the issuance of the credit release for Task 3.
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020203 of the Neuse River Basin pursuant to 15A NCAC 02B .0703, which became effective
on April 1, 2020. Additionally, the riparian buffer credits must be used for impacts in the
Neuse River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule,
15A NCAC 02B .0295, which became effective on November 1, 2015.
Please use the Credit Ledger Templates provided in your MBI to track and report credit availability
for the Kittell Hill Mitigation Bank. Upon receiving this correspondence, please submit two (2) credit
ledgers to DWR reflecting the available credits released for each mitigation type (Buffer Restoration
(in ft2), Nitrogen Nutrient Offset (in ft2 and pounds).
