Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. OLSON Buncombe County FOR THE Construction and operation of a pump and haul sewerage system to serve 8 Dimora Drive with no direct discharge of wastes to the surface waters, pursuant to the application received on June 22, 2009 and in conformity with.the project plan, specifications, and other supporting data filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until December 23, 2009 and shall be subject to the following specified conditions and limitations: This permit shall become voidable unless the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for a change in facility ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. No type of wastewater other than that from the residence at 8 Dimora Drive shall be included in the pump and haul activities. 6. The permit shall become voidable unless the agreement between Paul R. Olson and Able Septic Tank Service for the collection, transportation, and ultimate disposal of the wastewater is in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities and take such immediate corrective action as may be required by this Division. 8. This Pump and Haul Permit shall not be renewed. 9. The sewage and wastewater collected by this system shall be treated in the Metropolitan Sewerage District of Buncombe County Wastewater Treatment Plant prior to being discharged into the receiving stream. 10. The Permittee is liable for any damages caused by a spill or failure of the pump and haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 12. The Permittee or his designee shall inspect the collection facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the direct release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for as long as the pump and haul activities are being conducted and shall be made available upon request to the Division of Water Quality or other permitting authority. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter -and inspect any property, premises or place related to the collection facilities at any reasonable time for the purpose of determining compliance with this permit; inspect or copy any records that must be kept under the terms and conditions of this permit; and may obtain samples. 14. An accurate record of the monthly pump and haul activities must be maintained by the Permittee, indicating: a) date wastewater is removed from the facility, b) name of facility from which wastewater is removed, c) name of facility receiving wastewater, d) volume of wastewater removed, and e) status of permanent disposal option... These records shall be submitted to the Asheville Regional Office on or before the fifteenth (15) day of the following month. 15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division.of Water Quality in accordance with North Carolina General Statute 143-215.6. 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. 17. The Permittee shall provide for the installation and maintenance of an audible and visual high-water alarm. 18. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the project. 19. Non -Compliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, at telephone number 828/296-4500, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failure of pumps. aerators, compressors, etc. b. Any failure of a pumping station, sewer line, etc. resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. ALTURA Utility Current Situation 2/28/09 Electric According to Progress Energy as of this date the underground electrical plan has been approved and they are waiting on a Joint Trench Agreement from the gas company PSNC before they will release the plan for installation. There currently is no Temporary power service available for home construction. It was stated in late March of 2008, by the developer representative, that temporary power would be provided to the building site for the construction of homes within 6 weeks. Lot 25 construction has been stopped until power can be received at the site. Greenstone Construction received a cost estimate for the service to the Lot 25 site of $18,000. This service could serve approximately 8 homesites in the same general area until such time permanent power was installed. No action on the temporary service installation has been taken by the developer: Gas As per a conversation on 2/20/09 PSNC stated that they spoke with someone about Altura in August and provided the developer with a list of information need to evaluate the project. They stated that they had heard nothing since then about the development until February 3 when they had a conversation with Jack Shrode of Alexander Reagan. They explained again that they would require a specific list of information so they could do an analysis of the subdivision to evaluate the financial viability of providing gas service to Altura. When the gas company was asked the current status of a joint trench agreement their response was "we know nothing of a proposed joint trench agreement, since no one has followed up with us, we thought Altura was dead". They also said that they are willing to look at providing service if someone would provide them with the information that was requested in the August and again February meetings. After a conversation with them and as per a phone conversation on 2/25/09, PSNC had received the information requested from the developer and are proceeding to evaluate the financial viability of the project. It was -indicated that they could have that process complete within the next 30 days and arrive at a joint trench agreement with Progress Energy for installation. Sewer According to MSD, the metropolitan sanitary district, the pump station required for Altura to receive sanitary sewer service has been approved. MSD requires a fee representing 20 years of maintenance cost, (it is estimated by an engineer to be approximately $300k), be paid prior to commencement of construction by the developer. It is estimated by engineers that the sewer installation should take 3 to 4 months and that installation be completed by a licensed and MSD approved installation company. Landscape, Streetscape, Roads The landscape entrance features have been completed. There has been no additional landscape installed in any of the Heights of Altura. The visual appearance would indicate that the development is still in early stages of development or has stopped. Key areas features that were planned to be landscaped at the junction of Dimora Drive and the Altura Parkway have not been completed. There are no streetlights; road signs or other plantings that would indicate that the development is ready for occupancy. The access road to the housed behind lots 101 —113 has not been completed nor has the landscape barrier to the older houses behind those lots been planted. This needs to be done for construction of the homes on that side of the road to begin. A preliminary road surface and storm drains has been installed on the Altura Parkway and Dimora Drive. Page 2 Altura Utilities Current Sittion 2/28/09 Cable & Phone The Charter Communication development services rep. for the Woodfin area had not been contacted by Altur. He was willing to do a financial analysis and could put the cable in the same trench as the electric and gas. They need a drawing of the site from Altura. Charter could be used for phone, internet & TV. Issues 1. Lot 25 construction is scheduled to be completed in June, at which time a Certificate of Occupancy must be obtained for the construction financing to convert to permanent financing. June is 3 months away and there is no published schedule for completion of the utilities. October 8, 2008 was the published completion date provided by the developer to the General Contractor at the time of the commencement of construction of the lot 25 home. Based upon the current status of the above utilities there seems to be little chance that the installation will be complete prior to the completion of the home. 2. Lot 145, 115 & 105 are all scheduled to begin construction this .spring. The plans are complete and the construction loan applications submitted. The financing sources have indicated that loan approval will be contingent upon completion of all the utilities. Completion of the 3 items above will solve this issue with the exception of lot 115 which requires an entire sewer connecting line be installed at the lower side of lots 114 through 144 to provide a pathway for connection to the sewer main and the pump station. 3. Presently areas referred to as the valley and the town center has had major land disturbance and visually appear that everything has stopped. This along with the lack of landscape or horizontal construction activity would raise questions with potential home and lot buyer as well as the local banking and realty community. In the present state clients may drive away thinking it is would be better to wait and see Altura when is has more done. I have made application for Water, Sewer, Electric and Gas service to the Lot 25 House and have been informed by all of the above utilities that the installation and completion of these services have stopped and none of them will be able to provide permanent service to the home. Below is the response from each of the utilities individually. City of Asheville Water: The water department cited a number of issues that had to be completed by the developer prior to water service being available. Some of those that they mentioned are: 1. As built drawings of installed lines not submitted 2. Fees not paid 3. Health Department sign off not completed Municipal Sanitary District (MSD) - Sewer Service: MSD indicated that sanitary sewer service would not be available anytime in the near future. The issues that need to be resolved before service can be provided are: 1. A pump station needs to be constructed, inspected and approved. The plans have been approved by MSD, but construction can not start until a future maintenance fee is paid by the developer. 2. Some of the connector lines to the pump station location have not been installed 3. As built drawings of sanitary lines that have been installed still need to be submitted 4. A stretch of main line needs to be installed along riverside road connecting the pump station to the MSD plant. Apparently no timeline for completion of the above items had been provided to MSD. Progress Energy - Electric Service: Progress Energy was contacted to trench and run power to lot #25. This representative of Progress said that he had grown tired of trying to contact the appropriate people at the development. When he did finally get a return call, he was told that all activity in the Heights Of Altura was placed on hold until further notice. There is now a temporary service installed adjacent to lot 25, but cannot serve as permanent service to the home for C/O. PSNC - Natural Gas Service: A request for natural gas service had been submitted to PSNC in February. They indicated at that time that they had not yet been contacted by the developer for service to Altura. Stan and Kevin said that ALTURA had not been a concern of theirs since (i) Their most recent meeting was in March and Jack Shrode told them at the meeting that Alexander Reagan had purchased the home from me, and (ii) The developers usually drive the process, and had not been contacted MSD since the March meeting. They said that they were not the authority for a pump and haul permit. They had no policy on this, but their thought was that this would be problematic because every two days or so the sewage would need to be hauled out, or else there would be an odor issue. They wondered how the developer could be policed and monitored to haul the sewage out every two days. Maybe for a temporary period, say five months or so, it would be possible, but the pump station construction would take six months to construct so how could it be thought that the pump and haul was temporary??. Also, the whole sewage distribution system was not yet constructed to the location where the pump station would be constructed. They said that the agency to contact was NC DENHR, out on Swannanoa Road. Rick agreed to go and contact them. They said that the septic system idea seemed to be the best and most workable idea to get the C of 0. Paul R. The feedback from each is as follows: Buncombe County Health Department: Will approve a septic if the soils are acceptable for the primary and repair sites. There will have to be right of ways recorded for the septic lines that cross property lines and a long term use of land agreement for the Owner of Lot 25 to use the septic site indefinitely or until the sewer system is in place and connected to the house. MSD: Nothing they can do at this point until sewer system is completed. This includes additional gravity lines and the pump station. NCDENR: Can approve a pump and haul for circumstances where a previously approved sewer permit is not completed due to unavoidable circumstances. A letter needs to be written to Roy Davis explaining what the unavoidable circumstances are and then he will render an opinion as to whether they qualify for a pump and haul permit.
