SAW-2011-00377 Mr. Cal Miller Shaw Hwy Properties, LLC 3907 Bowen Road Canal Winchester, Ohio 43110 wet Iandsresource(a)aol.com Dear Mr. Miller: This letter serves to confirm our evaluation of the February 2020 Year 6 monitoring report for the Northeast Cape Fear Umbrella Mitigation Bank (Bank) Holly Shelter Tract located northeast of Shaw Highway and NC Hwy 210 intersection, in the headwaters of an unnamed tributary to the Northeast Cape Fear River, near Rocky Point, Pender County, North Carolina. Also, please reference the Mitigation Banking Instrument (MBI) executed on June 5, 2013 and our June 26, 2019 credit release letter. In review of the vegetation data, the results show that the success criteria have been met for the sixth year of monitoring. However, data is absent on the height conditions of the planted stems. This information must be included in next year's monitoring report in order to verify that the vegetation success criteria #3, planted stems "must average 10 feet in height in each plot at Year 7", is being met. In addition, and as stated in the June 26th letter, please continue to monitor the off -road vehicle use at Zero Order Valley "A" (or North Valley) to ensure no degradation is occurring within the restored valley. It has been determined that Task 8.0 in Table 4A of the MBI has been fulfilled, resulting in in the mitigation credit release of 10% (or 0.1 credit) of riparian non-riverine wetland credits. To date, this brings the cumulative total release in Table 4A to 0.9 credits of riparian non-riverine wetlands. Please be reminded of your obligations pursuant to the June 5, 2013 MBI; and to continue maintenance inspections of the armored ditch plugs, check dams, and encroachment in order to evaluate the stability of each structure and overall condition of the Bank for perpetuity.
