Good Morning, Martin:
On September 30, 2015, the USACE met at Umstead Subdivision/Cox Woods in Johnston County, North
Carolina to review the boundaries of the aquatic resources delineation submitted by Wyatt Brown, Brown's
Environmental Group, Inc.
We have reviewed the information provided by you concerning the aquatic resources, and our internal notes
from that visit, and by copy of this e-mail, are confirming that the aquatic resources delineation has been
verified by the Corps to be a sufficiently accurate and reliable representation of the location and extent of
aquatic resources within the identified review area. The location and extent of these aquatic resources are
shown on the attached delineation survey, labeled Cox Living Trust, Clayton Township, Johnston County and
dated February 3, 2016.
Regulatory Guidance Letter (RGL) 16-01
https://usace.contentdm.ocic.org/utils/getfile/collection/p1602lco119/id/1256 provides guidance for
Jurisdictional Determinations (JD) and states "The Corps generally does not issue a JD of any type where no JD
has been requested". At this time we are only verifying the delineation. This delineation may be relied upon
for use in the permit evaluation process, including determining compensatory mitigation. This verification does
not address nor include any consideration for geographic jurisdiction on aquatic resources and shall not be
interpreted as such.
This delineation verification is not an Approved Jurisdictional Determination (AID) and is not an appealable
action under the Regulatory Program Administrative Appeal Process (33 CFR Part 331). However, you may
request an AID, which is an appealable action.
If you wish to receive a Preliminary Jurisdictional Determination (PJD), or an Approved Jurisdictional
Determination (AJD) please respond accordingly, otherwise nothing further is required and we will not provide
any additional documentation.

This is the project we discussed Wednesday, where there is a subdivision built without potential permits. It is currently
being developed as Umstead Subdivision; however, the AID may be named Cox Woods.
Very brief history:
9/30/1015: David Shaeffer met Wyatt Brown on site to verify delineation flagging; David agreed with delineation.
No concurrence issued in writing.
1/4/2017: Delineation survey maps sent to David Shaeffer and Samantha Daily; Samantha said she would agree
with David send concurrence when possible.
No concurrence issued in writing.
At some point, the site plans were approved by Johnston County or Town of Clayton. Lots were recorded and
construction started. From what I understand, the Town is holding up individual lot approvals based on potential
wetland impacts.
I have attached the delineation map sent to David and Samantha.
I would like to see if we can meet out there prior to any submittals. I can send you more detailed info in the coming
days, and if you get a chance, check your file AID.
Let me know a good time meet, and I'll coordinate with everyone.
