Town Andrews in their remission request indicated remission justification under (b), violator promptly abated and (c), the violation was inadvertent; they did not indicate (e), payment of penalty will prevent funding of remedial action. Based on their remission request, staff found no basis to grant remission but we did elect to delay a decision on the remission until John H.'s group can discuss with you directly. They will setup a time to discuss and have me on the call as well. The Town has a total of $3,706.04 in outstanding penalties in addition to the $956.68 for the current case. One option is to not grant remission and attempt another settlement agreement to be inclusive of all outstanding penalties. The timing may be good for this as well as I understand the Town has now received approval to pursue DWI funding for a phase 2 remedial effort for the WWTP. This facility has a history of non-compliance and has been a project for several years now. The WWTP is the only trickling filter facility in our region, which is an older technology and not ideal for the setting. There have been other challenges as well in working with the Town's management structure and funding.
