The Sedimentation Pollution Control Act (hereinafter "Act") states that this plan must be filed a minimum of 30 days (15 days for revised plans) prior to the activity and the approving authority must approve or disapprove the submitted plan within 30 days (15 days for revised plans) of receipt of G.S. I I3A-54.1. The Act further states that if the approving authority fails to approve or disapprove the submitted plan within the 30-day (15 days for revised plans) period, the plan will be deemed approved. The Modifications Required for Approval are listed on the attached page. The enclosed Certificate of Approval must be posted at the job site. This plan approval shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCGO10000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the $100 annual permit fee. After the fee is received, you will receive the COC via email. You MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form maybe accessed at decnc.s?ov/NCG01. If the owner/operator of this project changes in the future, the new responsible party is required to apply for his/her own COC. Title 15A NCAC 413.011 S(a) requires that a copy of the approved erosion control plan be on file at the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute l 13A-51 through 66), this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. This permit allows for a land -disturbance, as called for on the application plan, not to exceed the approved acres_ Exceeding the acreage will be a violation of this permit and would require a revised plan and additional application fee. Provide a legend with symbolslicons to identify all proposed erosion and sedimentation control measures. Measures are to be to scale. Use the symbols to identify the proposed location of the structures on the plan. (GS113A-57(3), 15A NCAC 04B .0105,15A NCAC 04B .0106(5)) • Identify and label temporary diversion ditches on the plan sheet. • Include the baffles, skimmers, and spillways within the footprint of each basin. 2. Provide identifiers for the proposed ESC devices (basins, ditches, etc.) on plan sheets that correspond with supporting calculations. (113A-57(3), 15A NCAC 04B .0105, 15A NCAC 04B A 106(5), and NCGO I Part 11 Section A (4)). 3. Include the elevations associated with the contours on the plan sheets. (GS113A-57(3), 15A NCAC 04B .0105, 15A NCAC 04B A 106(5)) 4. Provide the location of the site, to scale as near as possible, on a USGS quad map and on the most recent paper -bound version of the Natural Resources Conservation Service (MRCS) soil survey map. Delineate the project limits on these maps. (GS 113A-57.4(c), 15A NCAC 04B .0105, 15A NCAC 04B .0106(a)(1) and (a)(3)) 5. Per the topo map provided it appears there is a stream within the limits of disturbance and a pond adjacent to the limits of disturbance. Identify the streams and and wetlands on the plan sheets. Include any additional measures needed to protect these areas. (GS 113A-54.1(a), 15A NCAC 04B .0106) 6. If applicable, provide a copy of the USACE 404 permit and DWR 401 certification for the office file. Submit documentation with maps showing location and extent of impacts to streams and wetlands with any special conditions pertaining to erosion and sediment control and restoration of affected areas. Identify the streams and wetlands on the plan sheets. Identify the permitted impacts and impact areas on the erosion and sedimentation control plan sheets to correspond with the USACE and DWR documents. Include any additional measures, construction specifications, maintenance requirements and construction sequencing as required by the 404/401 on the plan sheets. Provide a detailed/specific construction sequence that coordinates the timing of land -disturbing activities with the installation and removal of all proposed erosion and sedimentation control measures. (15A NCAC 04B. 0106(5)) • Note that construction activities that have an E&SC Plan approved on or after April 1, 2019 are required to fill out and submit an electronic Notice of Intent (e-NOI) form. All construction activities are required to follow the new NCGOI permit regardless of when they were approved. • The NCGO1 Ground Stahilization and Materials Handling Plan Sheet must be added to the plans. A pdf and an AutoCAD version are located at deq.nc_gov/NCG01.. • The NCGOI Inspection, Recordkeeping, and Reporting Plan Sheet must be added to the plans. A pdf and an AutoCAD version are located at dgq.nc.gov/NCGOl. • Add the following statement to the construction sequence: "Erosion and Sediment Control (E&SC) permit and a Certificate of Coverage (COC) must be obtained before and land disturbing activities occur." The COC can be obtained by filling out the electronic Notice of Intent (e-NOI) form at dcq.nc.gov/NCGO1. Please note, the c- NOI form may only be filled out once the plans have been approved. A copy of the E&SC permit, the COC, and a hard copy of the plan must be kept on site, preferably in a permits box, and accessible during inspection. • Add a requirement to the construction sequence to contact the DEMLR Raleigh Regional Office at least 48 hours prior to commencing the land -disturbing activity. The contact number is (919) 791-4200. (15A NCAC 04B .106(b)) • Provide a detailed site -specific construction sequence the removal of the basins. Basins may not be removed until all upland areas are permanently stabilized. Detail the use of silt bags in the construction sequence. (GS 113A-57(3), 1 SA NCAC 04B .0113) • Add the following statement to the construction sequence: "The contractor shall conduct self -inspections of the erosion and sedimentation control measures and compete the following combined self -inspection form found on the DEMLR website https://files.nc v-ov/ncdeq/ ncray%2OMincral°/a20and°/a2OLand°/`2OResources/Storm wwater/NPDES%20General%2OPermits/DEMLR-CSW-Monitoring-Form-Rev- August-8-2019.pdf . Twelve months of complete inspection forms shall be kept on -site and available for inspection at all times. It is recommended a copy be kept in a permits box." (GS 113A-54.1 (e), 15A NCAC 04B.0131, NCGO1 Part Ill Sections A and B) • Add the following statement to the construction sequence, "When the project is complete, the pennittee shall contact DEMLR to close out the F.c4tSC Plan." After DEMLR informs the permittee of the project close out, via inspection report, the penruttee shall visit deq.nc.gov/NCGOI to submit an electronic Notice of Termination (e-NOT). A $100 annual general permit fee will be charged until the e-NOT has been filled out. • Add the following statement to the construction sequence: "Self -inspections for erosion and sedimentation control measures are to be performed at least once every seven calendar days and within 24 hours of every rain event of greater than 1 inch. Any needed repairs shall be trade immediately to maintain measures as designed. All ESC measures shall be maintained as specified in the construction details on this plan." Letter of Approval with Modifications ATTN: Virginia Rand Bowman June 16, 2020 Page 5 of 7 Provide stockpiletstaging areas, concrete washouts, and dedicated areas for demolition, construction, and other wastes. These areas are to be within the limits of disturbance and should be located at least 50 feet away from storm drain inlets, temporary diversions, channels, and surface water bodies. Identify the location of these areas and structures on the plan sheets. Provide adequate measures around the stockpile areas. A revised Financial Responsibility/Ownership Form and additional fee may be necessary, if the total disturbed acreage exceeds the original submittal. (GS113A-57(3), 15A NCAC 04B .0105, 15A NCAC 04B .0106(5), GS 113A-57(4), NCGO 1 Section H.F) 9. Provide a structure/device for dewatering the temporary basins prior to removal. Silt bags are typically used for this purpose. Provide a plan detail, construction specifications, and maintenance requirements for this device. Include a symbol/icon on the legend for this structure. Detail the use of this device in the construction sequence. Include the location of the sediment filter bag on the plan sheets. (GS 113A-57(3), 15A NCAC 0413.0113) 10. Identify and label temporary diversion ditches on the plan sheet. Diversion ditches must have a stable conveyance as they enter basins/traps. Show the stable conveyance on the plan sheet. Provide a plan detail, construction specifications, and maintenance requirements for the stable conveyance. (GS 113A-57(3), 15A NCAC 04B .0113) 11. Drainage areas exceeding one acre must have a properly designed surface dewatering device (Basins 9 and 10 are to be designed as skimmer basins). It is recommended that areas that have less than one acre of drainage area utilize sediment traps. Identify baffles and spillways on the plan sheet. Provide a plan detail, construction specifications, and maintenance requirements for the sediment traps. Provide calculations for sediment traps. See attached spreadsheet. (GS 11 3A-57(3),15A NCAC 0413.0113) 12. Check dams with weirs may be better suited for drainage areas with drainage areas less than 0.5 acres. These devices off sediment storage capacity but do not require baffles. If check dams are being utilized, identify on the plan sheets. Provide a plan detail, construction specifications, and maintenance requirements for the check dams with weir. Provide calculations for the sediment storage area and include the dimensions of these areas on the plan sheets. (GS 11 3A-57(3),15A NCAC 04B .0113) 13. If skimmer basins are being utilized, please identify baffles, skimmer orientation, and emergency spillway on the plan sheet. Provide silt fence outlets adjacent to skimmer outlets. (GS 11 3A-57(3),15A NCAC 04B .0113) 14. Identify silt fence outlets on the plan sheet. Provide an icon/symbol for the silt fence outlets. (GS 11 3A-57(3),15A NCAC 04B .0113) 15. It appears basins 3 through 10 are located within fill material. Basins are to be installed before clearing and grading and may not be removed until permanent stabilization has been established. Provide a plan detail, construction specifications, and specific maintenance requirements for all proposed sediment and erosion control structures included on the plan (i.e. temporary diversions, permanent roadside ditches, check dams with weir, sediment trap, skimmer, porous baffles, pipe inlet protection). Recommend placing maintenance requirements with the associated construction detail. (GS I I3A-57(3), 15A NCAC 04B .0113) 17. Provide a plan detail and construction specifications for the silt fence and silt fence outlet that complies with the skirt trench requirements per the Erosion and Sediment Control Planning and Design Manual. The skirt is to be trenched in, at a minimum, 8 inches vertically and 4 inches horizontally. (GS 113A-57(3), 15A NCAC 0413.0113) 18. Provide a plan detail and construction specifications for the construction entrance that complies with the requirements per the Erosion and Sediment Control Planning and Design Manual. The minimum width of the entrance is to be 12 feet. (GS 113A-57(3), 15A NCAC 04B .0113) 19. Construction specifications for the skimmer basin are to include the excavation, embankment construction, spillway construction, and skimmer basin installation. Specify on the plan detail that an impermeable liner is to be installed on the spillway. The emergency spillway is to be installed in undisturbed ground (not over the skimmer pipe). Include a stone pad for the skimmer to rest upon and a rope attached to the skimmer for maintenance in the plan detail. Include the basin surface area dimensions, depth, side slopes, dam height, embankment width, length of emergency spillway, skimmer size, skimmer orifice size, and dewatering time on the plan sheets. (GS 113A-57(3), 15A NCAC 04B .0113) 20. Provide design calculations for cross sections and method of stabilization for the planned channels and the temporary diversions. Include appropriate permissible velocity and/or shear stress data. Provide a plan detail to include the swale dimensions (bottom width, side slopes). (GS 113A-57(3), 15A NCAC 04B .0113) 21. Provide liners/matting to aid the stabilization of planned channels and temporary diversions when the runoff velocity will exceed 2 ft/sec on bare earth during the 2-year rainfall event that produces the peak runoff. The product(s) selected must have a permissible shear stress that exceeds the shear stress of the design ntnoff event. If liners/matting is to he installed, provide a plan detail, construction specifications, and maintenance requirements. Include the installation of liners in the construction sequence. (GS 113A-57(3), 15A NCAC 04B .0113) 22. This plan approval is for streets, utilities and sediment and erosion control measures only. Land disturbing activity on individual lots is not approved with this plan review. Before house construction begins on the lots, a plan showing the individual lot measures will be required. Provide a note to this effect on the plan sheet. Consideration should be given to avoiding Sericia Lespedeza as it is considered an invasive species, per NC State University/AT&T University Cooperative Extension. The Extension recommends the following alternative native species: Switchgrass (Panicum virgatum), Splitbeard Bluestem (Andropogon ternarius), Partridge Pea (Chamaecrista fasciculata). 24. Consideration should be given to avoiding Tall Fescue as it is considered an invasive species, per NC State University/AT&T University Cooperative Extension. The Extension recommends the following alternative native species: Switchgrass (Panicum virgatum), Big bluestem (Andropogon gerardii), Little bluestem (Schizachyrium scoparium), Indian grass (Sorghastrum nutans), Beaked panicgrass (Panicum anceps), Purpletop (Tridens flavus), Broomsedge (Andropogon virginicus), Deer tongue (Dicanthelium clandestinum), Canadian wildrye (Elymus canadensis), Virginia wildrye (Elymus virginicus), Sensitive partridge pea (Chamaecrista nictitans), and Partridge Pea (Chamaecrista fasciculata). 25. Provide two copies of the plan set (one full-size and one half-size), showing the modifications required for approval prior to initiating land disturbing activity. To facilitate DEMLR review, bubble, highlight, or otherwise identify the changes to your resubmittal. Provide one copy of additional items (such as design calculations). Provide a cover letter referencing the project name, project ID, and purpose for submittal.
