APPROVAL of 401 Water Quality Certification

Dear Ms. Slaughter:
You have our approval, in accordance with the attached conditions, to place fill material in 142 linear
feet of streams for the purpose of replacing a bridge at SR 1375 over North Deep Creek, as you
described in your revised application dated January 26, 2001. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3289. This Certification
allows you to use Regional General Number 14 when the Corps of Engineers issues it. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification. This approval shall expire when
the corresponding Nationwide Permit expires or as otherwise provided in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

The NC Department of Transportation is proposing to grade, drain, base, and pave SR 1375
(Casstevens Road) in Yadkin County. This project will require the replacement of a substandard
bridge that crosses an unnamed tributary of North Deep Creek (DEM Class - C) at or near station
29 + 45. The new stream crossing will consist of one 142" x 91" arched pipe and will be located
approximately 50 feet upstream from the current bridge. The stream crossing has been moved
upstream in order to remove a curve at the crossing location. Please note that the roadway will
also be elevated several feet at the new crossing location. Due to the proposed work, we are
requesting a 404 Nationwide Permit #14.
During the course of reviewing the project, it was noted that the Old Center (Mackie-Vestal)
Cemetery is located on the west side of SR 1375, between stations 57 + 85 and 58 + 90. This site
is currently on the state study list of historic properties and is considered potentially eligible for
the National Register of Historic Places. As a result, we have shifted the alignment of the road
away from this site.
I am sending a PCN application form, straight-line sketch with proposed erosion control
measures, general notes on erosion control, information pertaining to the Old Center Cemetery, a - v

to comment directly to you concerning the 404 Nationwide Permit request with a copy sent to
me.
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality, 401/Wetland Unit, for her review. A
$200.00 check is enclosed for the 401 certification processing fee. It is requested that comments
pertaining to the 401 Water Quality Certification be forwarded directly to the Corps.
We would like to begin construction when the necessary permits are obtained. If addition
information is required, please let me know. Your early review and consideration will be greatly
appreciated.

NCDOT Plan of Work for SR 1375 at Old Canter Comotory
Yadkin County
NCDOT plans to grade, drain, base and pavo SR 1375 (Casstevens Road) in
Yadkin County during the 2000-2001 paving program. On the west side of SR
1375, between project stations 57+85 and 58+90, sits the Old Center (Mackie-
Vestal) Cemetery. The Old Center Cemetery has been placed on the state study
list of historic properties and is considered potentially eligible for the National
Register of Historic Places. NCDOT has accordingly relocated the right-of-way
and centerline of the road adjacent to the cemetery to the east, thus avoiding any
disturbance of both the sloped and level areas of the site. If this design revision
is carried out, there will be no effect to an historic property.
