mixed use area of Winston Salem, North Carolina.

The purpose of the proposed project is to provide access to the Aspen Pointe apartment complex.

The overall project consists of development of the site with 3 apartment buildings that will comprise 72 units, associated
amenities including community center and playground, and parking areas. To provide access the eastern portion of the
site, a stream crossing is necessary. To facilitate development of the site, clearing and grading the site is necessary.
Graders, haulers, excavators and other heavy equipment will be used during site construction.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant has designed the apartment complex, community center, playground and parking areas to avoid impacts to
streams or wetlands. The applicant has designed the stream crossing in an area that avoids impacts to wetlands.
Additionally, the applicant is avoiding impact to wetland from mechanized land clearing/easement maintenance with proposed
sewer line extension.
The applicant has further demonstrated avoidance and minimization of stream impacts by proposing to construct
approximately 15 feet tall culvert head/end walls. Furthermore, the Applicant has designed rip -rap stabilization measure to be
keyed into existing grades of beds and banks to 32 linear feet of stream channel, thus resulting in not net loss.
The remaining approximate 2,664 linear feet of stream and 0.25 acres of wetlands are being avoided.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence/other BMPs will be used. A temporary coffer dam will be installed up -gradient
of the proposed culvert. During construction, water will be pumped around the construction footprint. Appropriate stream bank
protection will be provided in the channel during construction and all excess excavated material will be immediately removed
from the stream bank crossing area. Upon completion of the culvert installation, the temporary sand bag coffer dam will be
removed and flow will be diverted through the culvert. Following construction, disturbed banks will be restored to similar pre -
construction conditions, matted and seeded/live staked.

Pilot consulted the USFWS list of federally protected species known to occur in Forsyth County. The USFWS list of
protected species includes the bald eagle (BGPA), Northern Long Eared Bat (NLEB) (T) & Small-Anthered Bittercress
(E). Based on our observations, we have made the determination the proposed project will not disturb the bald eagle and
will have no adverse affect to NLEB or Small-Anthered Bittercress.

Dear Mr. Raab:
Pilot Environmental, Inc. (Pilot) is pleased to submit this report of the wetland delineation for the
approximate 13.78-acre tract located south of Stafford Village Boulevard in Winston-Salem,
Forsyth County, North Carolina.
Background
Wetlands are defined by the United States Army Corps of Engineers (USACE) and the United
States Environmental Protection Agency (EPA) as "those areas that are inundated or saturated
by surface or groundwater at a frequency and duration sufficient to support, and under normal
circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil
conditions." In order for an area to be classified as a wetland, hydrophytic vegetation, hydric
soils, and wetland hydrology indicators must be present.
Section 404 of the Clean Water Act (CWA) regulates the discharge of dredge and fill materials
into waters of the United States (lakes, rivers, ponds, streams, etc.), including wetlands. Waters
of the United States include the territorial seas, navigable coastal and inland lakes, rivers and
streams, intermittent streams, and wetlands. The EPA and the USACE jointly administer the
Section 404 program. Section 401 of the Clean Water Act grants each state the authority to
approve, condition, or deny any Federal permits that could result in a discharge to State waters.
Jurisdictional features include wetlands, open waters, ponds, lakes and perennial/intermittent
streams. Jurisdictional features are regulated by the USACE and North Carolina Department of
Environmental Quality -Division of Water Resources (NCDEQ-DWR). Permits are required priorto
impacting any jurisdictional feature. Stormwater management plans and/or mitigation for
proposed impacts could be a requirement of the permit approval process.

The findings and conclusions in this report are our opinions based on field conditions
encountered at the time of the site visit. Changes including, but not limited to, regulations,
weather, timber/vegetation removal and usage/development of the site or nearby properties
can alter the findings and opinions presented in this report. We recommend that this report only
be used for preliminary planning purposes. Agency verifications, followed by a survey of
jurisdictional features, are required to determine the exact extent and locations of jurisdictional
features and are valid for a period of up to five years following issuance of a USACE Jurisdictional
Determination (JD) and/or NCDEQ-DWR Site Determination Letter.
Scope of Services
Pilot was contracted to perform a wetland delineation for the approximate 13.78-acre tract
located south of Stafford Village Boulevard in Winston-Salem, Forsyth County, North Carolina.
The site is identified on the Forsyth County Geographic Information System (GIS) as Parcel
Identification Numbers (PINS) 6823-42-9009, 6823-51-5704, and 6823-51-5917. The scope of
services included a delineation of jurisdictional features (streams, wetlands and other surface
waters) on the site. The site boundary was not marked at the time of our field delineation.
Pilot was contracted to perform a Phase I Environmental Site Assessment (ESA) in conjunction with
the wetland delineation. Details of the Phase I ESA are included in separate reports.
Literature Review
We reviewed the U.S. Geological Survey (USGS) Topographic Map, the U.S. Department of
Agriculture (USDA) Soil Survey of Forsyth County, the U.S. Fish and Wildlife Service (USFWS)
National Wetland Inventory (NWI) Map and the Federal Emergency Management Agency (FEMA)
Flood Insurance Rate Map (FIRM).
• The USGS Topographic Map (Drawing 1) depicts Sides Branch and an unnamed tributary to Sides
Branch crossing the central and eastern portions of the site. Other surface waters or wetlands
are not depicted on the site. Drainage swales that could contain additional surface waters or
wetlands are located on the site.
• The USDA Web Soil Survey of Forsyth County (Drawing 2) identifies the following mapping units
on the site: Casville sandy loam (CaQ Codorus loam (CoA), Fairview fine sandy loam (FaB),
Fairview clay loam (FeE3), Gullied land (Gu), Siloam sandy loam (SmF), and Toast -Devotion
complex (TdC and TdD). The Casville series consists of well drained, moderately slowly
permeable soils that occur on ridges. The Codorus series consists of moderately well to
somewhat poorly drained, moderately permeable soils that occur on nearly level floodplains.
The Fairview series consists of well drained, moderately permeable soils that occur on hills,
ridges and interfluves. Gullied land occurs in areas where the soils are eroded and the topsoil
and other soil properties are absent or altered. The Siloam series consists of well drained,
moderately slowly permeable soils that occur on hills, interfluves and ridges. The Toast series

consists of well drained, moderately permeable soils that occur on hills, ridges and interfluves.
The Devotion series consists of well drained, moderately rapidly permeable soils that occur on
hills and ridges. The Codorus (CoA) soil mapping unit is identified on the Forsyth County Hydric
Soils List. The other soil mapping units are not identified on the Forsyth County Hydric Soils List.
Pilot also reviewed the last published USDA Soil Survey of Forsyth County (Drawing 2A). The
published soil map depicts a tributary to Sides Branch on the central portion of the site and
depicts Sides Branch crossing the eastern portion of the site, generally consistent with the USGS
Topographic Map. Other surface waters or wetlands are not shown on the site.
• The USFWS NWI Map (Drawing 3) depicts riverine features crossing the central and eastern
portions of the site, generally consistent with the USGS Topographic Map. Other surface waters
or wetlands are not depicted on the site.
• The FEMA FIRM (Drawing 4) identifies the site as Zone X, areas outside of the 100-year and 500-
year floodplains.
Field Delineation
Pilot conducted the field delineation on November 6, 2019. The site contains undeveloped
wooded land and fields. Two ponds are located on the central portion of the site. Structures are
not located on the site.
Streams are located on the central and eastern portions of the site. The streams contain defined
beds and banks, meanders, strong substrate sorting, and indicators of an ordinary high-water
mark. The streams contained flowing water at the time of our site visit. Based on our
observations, the streams are perennial. The stream origins, confluence points and approximate
points where the streams cross site boundaries were marked in the field with blue and white
striped surveyor tape. The stream limits are well defined and should be located by a NC licensed
surveyor to determine their exact extents and locations.
Wetlands are located adjacent to the several of the streams on the site. The wetlands are
separated from surrounding uplands by topographic, vegetation and/or soil breaks. The wetland
boundaries were marked in the field with red and white striped surveyor tape and geo-located
with a handheld Trimble GPS unit. USACE Wetland Determination Data Forms, supporting our
opinions, are included as attachments.
Drawing 5 shows the locations of the streams, wetlands and data points on the site. The locations
and designations of features shown on Drawing 5 are subject to change during the verification(s)
by the regulatory agencies.

Watershed Classification
According to the NCDEQ-DWR, the site is located in the Yadkin River Basin. An unnamed tributary
to Sides Branch and Sides Branch cross the site. The NCDEQ-DWR has classified Sides Branch as
Class C waters. We recommend consultation with the local zoning authority to determine if the
proposed development on the site requires development buffers/setbacks from surface waters for
compliance with local requirements.
Agency Verification
The delineation has not been verified by the USACE or the NCDEQ-DWR. We understand that
our flags will be surveyed to determine the exact extent and location of jurisdictional features
and applicable surface water buffers. The delineation, including locations and designations of
features shown on Drawing 5, are subject to change during agency verifications.
