As you are aware, Brunswick County's NEWWTP was at 101%for an average daily flow
through June 23`d. The NEWWTP permitted hydraulic capacity is 2.475 MGD. To bring their
daily average to 100% by month's end, the County needed to operate the NEWWTP between
90% and 95% for the final week of June.
At 10:00 a.m. on June 23�d, H2G0 was notified by Jolul Nichols that the County would be
restricting bypass flows from the Belville WWTP to the County's Clairmont LS. Not only were
flows restricted by throttling a valve, but the valve was closed on more than one occasion
between 6/23/20 and 6/26/20.
-12GO was forced to either, 1) knowingly exceed our permit limitations, both hydraulic and
treatment capabilities of the Belville WWTP, which would have caused wash -out of the clarifiers
and probable violation of discharge limitations for TSS — and possibly BOD, DO, and ammonia;
and/or 2) implement emergency pump -and -haul operations to transfer raw sewage from the
Belville WWTP to the County's Rice Creek LS.
On Wednesday, June 24, it was my decision to implement emergency pump and haul operations
without permit in -hand in lieu of probable wash -out of the Belville WWTP and significant
environmental impacts resulting from overflows and discharge of partially treated wastewater.
Flow tlu•ough the County's NEWWTP was 2.23 MG on 6/26/20. So, while the County ran their
plant at 90% on 6/26/20, H2G0 pumped and hauled nearly 288,000 gallons to the County's Rice
Creek LS.
The County's actions to reduce flows from the Belville WWTP to the NEWWTP, including
closing the valve at the Clairmont LS, restricting our ability to transfer flows in excess of the
Belville permitted capacity is creating serious operational problems and potential environmental
consequences.

Our fear is that these actions will be forced upon H2G0 every wet weather month where the
County's monthly daily average nears 100% - until such time the NEWWTP expansion project is
complete and operational.
Pump and haul operations are necessary to avoid exceedance of the Belville WWTP operating
permit; to avoid potential system overflows; and to avoid discharge of partially treated
wastewater to the Brunswick River.
For compliance purposes, please find attached an application for Wastewater Pump and Haul
operations.

Documents shall be prepared in accordance with i5A NCAC 02T .0100. 15A NCAC 02T.0200, and Division policies. Failure to submit
all required items will necessitate additional processing and review time. For more information, visit the Wastewater Branch's
website or contact the Regional Office serving your county.
General -This permit application applies to all pump and haul activities of wastewater under the authority of the Division on Water
Resources. Permit coverage is required for the system producing the wastewater. This permit does not apply to the transport of
animal waste from an animal waste management systems, not the transport of wastewater residuals or biosolids.
NOTE: Pump and haul permits are not acceptable long term domestic wastewater treatment alternatives and shall only be issued
in cases of environmental emergencies, nuisance conditions, health problems, or for unavoidable delays in construction of system
previously permitted by the Division.

Industrial Pump and Haul Activities
Per 15A NCAC 02T .02031A1121, Industrial pump and haul activities are deemed permitted provided the following criteria is met:
➢ The facility notifies the appropriate Division regional office in writing advising of the type of operation, type and quantity of
wastewater generated, location, and the receiving wastewater treatment facility. A letter from the facility accepting the
wastewater (type and quantity) specifically agreeing to accept wastewater from the applicant shall be included.
➢ The wastewater does not contain any human waste.
➢ The waste is collected and discharged into a sewer or treatment system designed and permitted to accept the type of
wastewater being pumped and hauled.
➢ The pump and haul activity is not to alleviate a failing wastewater system.

The Wilmington Regional Office reviewed the application for the pump and haul permit requested June
301 2020. To continue processing the application, we request additional information to satisfy the
requirements stipulated in 15A NCAC 02T .0204.
(aJ Permits for domestic wastewater shall only be issued in cases of environmental emergencies,
nuisance conditions such as odors and vectors, health problems, or for unavoidable delays in
construction of systems previously permitted under this Section.
It seems that the justification for this permit would be the occurrence of environmental circumstances
(i.e. excessive rainfall, other?). Please identify under what circumstances or when and how the decision
will be made to begin pump and haul activities for each month or any given day in the absence of chronic
or excessively acute rainfall. Use historical rainfall and wastewater flow data to provide an estimation in
support of the request.
Regarding flow estimations, the pump and haul application stated the maximum amount to haul would
be 150,000 bpd while the Brunswick County Public Utilities letter of flow acceptance indicates that they
can receive up to 1.2 MGD on an intermittent basis. Recent email correspondence that we have been
copied on indicates that the value of 150,000 gpd has being exceeded by over 100% (308,000 + gallons
off-load to Rice Creek LS). As indicated, provide an estimate of the wastewater flow to be hauled, based
on historical flow records. The WiRO recommends that both parties determine the approximate
maximum flow, as exceedance of that value would result in violation notices and likely civil penalties.

Brunswick County is willing to accept a reasonable amount of wastewater at the West Brunswick Regional Water Reclamation Facility to facilitate H2G0's
wastewater management strategy. However, we neither endorse nor oppose their strategy. Brunswick County is obligated to treat an average of 684,970 gpd
of wastewater from H2GO and, has and will, treat wastewater flows in excess of this amount until the Northeast WWTP's total permitted amount is substantially
reached. H2GO billed flows into the Northeast Regional System are around one million gallons per day average over the last several months.
Please note that your July 22, 2020 letter contains a notable discrepancy when it states "Brunswick County Public Utilities letter of flow acceptance indicates that
they can receive up to 1.2 MGD on an intermittent basis." The flow acceptance letter from Donald Dixon (enclosed) states "...50,000 gallons per hour of
domestic wastewater by pump and haul from the Belville WWTP on an intermittent basis to meet treatment demands...". It is our understanding that H2GO
would like to maximize the amount of wastewater they can treat at the Northeast WWTP and they are willing to treat a monthly average of 400,000 gpd at the
Chappell Loop Road WWTP. The leftover volume that H2GO seeks to haul is limited and will vary month to month. The "50,000 gallons per hour" amount has
been provided because the limiting factor is the additional instantaneous flow that we believe the West Brunswick System can effectively handle. The total
volume transferred is self -limited. H2GO can provide hauled values for the month of June to assist in providing this context and I believe that once you see those
numbers it will be apparent that a hauled amount of 1.2 million gallons per day would be excessive. In his email below, Bob Walker is recommending a
maximum pump and haul volume of 350,000 gpd which is acceptable to us. It would certainly not be expected that this amount would be transferred each and
every day of the month. Brunswick County staff reviews total treated flow volumes throughout the month along with weather patterns and provides this
information to 1-12GO. Based on this information, it is determined how much wastewater can be accepted from H2GO in excess of their allocation. H2GO then
must determine how best to manage any excessive flows (if they exist) from their collections system towards the latter part of the month — either by hauling to
the West Brunswick WWTP or treating at the Chappell Loop Road WWTP (see attached email correspondence). Please contact us if you would like further

Northeast Participant Meeting Question
During our participant meeting earlier today, there was discussion regarding exceedance of hydraulic treatment capacity at the wastewater treatment
plants. Discussion centered around the efficacy of exceeding hydraulic treatment capacity versus hauling operations. (Through 14 days of operations in the
month, the Northeast WWTP is over its permitted capacity by around two million gallons.) You asked if Brunswick County would permit H2GO to exceed its
monthly hydraulic permit average of 400,000 per day at the Chappell Loop WWTP, citing concerns regarding Judge Hook's 2010 court order.
Noting the urgency of the situation, I spoke with Attorney Bob Shaver this afternoon in an effort to provide you an answer. It appears that the court order
enjoins "the building at Belville a new wastewater treatment plant with a capacity greater than 400,000 gallons per day." It seems that the amount of flow that
may actually be treated at the Chappell Loop Road WWTP is a function of the NCDEQ operating permit and its provisions would apply; the County is not in a
position to grant permission for H2GO to exceed its operating permit hydraulic limits. However, Mr. Shaver also indicated it was not his intent to recommend to
the Board of Commissioners pursuit of any legal action with regard to the court order should H2GO exceed its monthly permitted hydraulic capacity of 400,000
gallons per day in order to minimize hauling operations during the period remaining until the Northeast WWTP is expanded to 4.975 mgd. I also share his
sentiments.
I am available if you would like to discuss further. Also, as you have requested, I have directed staff to provide you cumulative monthly flow amounts treated at
the Northeast WWTP (ADF's can be derived from this information) on a periodic basis.

Brunswick County agrees to receive up to 50,000 gallons par hour of domestic wastewater by
pump and haul from the Belville WWTP on an intermittent basis to meet treatment demands of
the H2GO system. The domestic wastewater will be accepted at the Rice's Creek sewage pump
station which is tributary to the West Brunswick Regional WWTP. The receiving treatment facility
for this domestic wastewater is the West Brunswick Regional WWTP (WQ0023693).
