APPROVAL OF STORMWATER MANAGEMENT PLAN (SMP)
Dear Mr. Fletcher:
On January 4, 2010, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to
you to place fill within or otherwise impact 226 linear feet of unnamed stream to Kerr Branch for the
purpose of constructing the proposed development, Troutman Towne Center in Iredell County.
On January 20, 2010 and January 25, 2010, the 401 Oversight/Express Review Permitting Unit of the
Division of Water Quality (DWQ) received your stormwater management plan (SMP) application dated
January 22, 2009, along with supporting information including stormwater management plan sheets dated
January 19, 2009 (Engineer's Seal), design calculations, subsurface (soil) investigation report and
operation and maintenance (O & M) agreements dated January 7, 2010 for the two wet detention ponds
from Ms. Beverly Rosenbloom, El and Mr. Matt Edwards, PE of Kimley-Horn and Associates for the
purpose of meeting Condition 7 of the 401 Water Quality Certification for this project. On February 3,
2010 and February 11, 2010, the DWQ received additional information including revised SMP sheets
dated February 2, 2010 and February 8, 2010, and O &M agreement dated February 10, 2010 for the level
spreader - filter strip system.
After carefully reviewing the information, the DWQ approves the revised SMPs dated February 2, 2010
and February 8, 2010 to satisfy the stormwater condition required by the Water Quality Certification. You
are required to meet the following conditions:
The stormwater management system consisting of two (2) wet detention ponds and a level
spreader-filter strip system, and all associated appurtenances, stormwater conveyances, and the
grading and drainage patterns depicted on the final revised plans, as approved by this office must
be maintained in perpetuity. No changes to the structural stormwater practices shall be made
without written authorization from the Division of Water Quality. The stormwater management
structures shall have maintenance access and at least a 10-foot drainage easement on each side to
allow for the ability to maintain the structures, and to perform corrective actions. The stormwater
easements shall be recorded to provide protection of the structures from potential alterations by
future property owners.

2. You must submit two (2) copies of an executed Declaration of Deed Restrictions and Protective
Covenants within thirty (30) days of recording with the Register of Deeds, Iredell County, North
Carolina. The recorded deed shall include the language in the DWQ 401/Express Permitting
Unit's Sample DEED RESTRICTIONS AND PROTECTIVE COVENANTS signed and
notarized on January 22, 2009 and received with your application on January 25, 2010. These
shall include, but not limited to, the maximum allowable built upon areas for the various lots,
parking areas, streets and roads draining to stormwater wet detention ponds 1 and 2.
3. All operation and maintenance activities shall be followed as stipulated in the operation and
maintenance agreements for the wet detention basins and level spreader-filter strip system
received in our office on January 20, 2010 and February 11, 2010 respectively.
4. Notification of Construction: The applicant and/or authorized agent shall contact the DWQ
Express Review Program in writing at the letterhead address within ten (10) days of the
commencement of construction.
This letter completes the review of your application by the Division of Water Quality under Section 401
