Salisbury Street Wake Forest, NC 27615 Raleigh, NC 27603 Re: River Dell Company, Inc., The Village at Flowers Plantation, Clayton, NC INDIVIDUAL PERMIT APPLICATION AID No. SAW-2008-01712; DWQ Project #20061804, Ver.3/Certification No. 3766 Modification Request of The Village at Flowers Plantation -Harris Teeter Fuel #229 and of Special Condition "L" Dear Mr. Hopper & Mr. Wojoski Please consider this letter a formal request on behalf of the Permittee for modifications to the impacts to waters of the US/State with the addition of proposed Impact #22, along with a modification of Special Condition "L" of the approved Individual Permit No. SAW-2008-01712 issued on April 22, 2010, January 9, 2013, October 3, 2016, December 14, 2016, July 12, 2017, and October 4, 2019 and Individual Certification No. 3766 (DWQ Project #20061804, Ver.3) issued on March 15, 2010, February 22, 2013, November 10, 2016, December 22, 2016, July 10, 2017 and November 5, 2019. In 2010 during the review of the initial permit application, it was discussed that the project engineer would not be able to provide a detailed design of the stream crossings. As such, it was agreed upon by Jean Gibby with the US Army Corps of Engineers (USACE) and the permittee that if the detailed design differed from the original design authorized, and the changes were minimal, that the modification of the road crossings could come in for a final administrative review. This request includes an impact in a new location (i.e. Impact #22) and the modification of Special Condition "L". Impact #22: This impact was not included within the initial permit application. This proposed impact area is within the "Existing Development" area and is an outparcel within the Flowers Crossroads commercial development. Harris Teeter is within the "Existing Development" area of Flowers Plantation and was constructed and opened in 2013. Per the applicant, over the past several years, the growth and demand has generated the need for additional fueling stations in the Flowers Crossroads area. The population within the Village at Flowers Plantation alone has grown from 1,500 to approximately 5,000. Because Harris Teeter was already servicing the area with grocery, it was determined a good location for the Harris Teeter to expand and provide a fuel service. Harris Teeter looked at several sites, but this site was the only ne that met their siting criteria. A site meeting took place with Jean Gibby and Chris Hopper on January 24, 2020 to review the existing wetland area and discuss the proposed fuel station. As a follow up to that meeting, Chris Hopper provided two questions that would be necessary information for this IP modification request. These questions are below with responses. 1) Please provide justification for not using existing undeveloped areas (avoidance and minimization). I recall we discussed an optometrist moving into the area just to the west? The curved lawn area just west of Harris Teeter may also be worth discussing. The parcel to the west is to be Heartland Dental. It has been permitted by Johnston County, bid and contract awarded for construction. The vacant lot to the west of the previously referenced Heartland Dental has been approved for a McDonalds site. It has been preliminarily approved, but not bid for construction. The next outparcel is the existing UNC Med Site. The site immediately to the west of the Harris Teeter (i.e. the parcel piece with the curved lawn) and it was determined to be too small based on shape. Additionally, it was not the preferred option by Harris Teeter. Ideally, Harris Teeter want the fuel station site to be in front of the store and off a major road. They selected the only remaining outparcel on NC 42 in front of the existing Harris Teeter Building. There is a small undeveloped piece of land immediately to the east of the Harris Teeter. It is also too small in size for the Harris Teeter fuel station site and it is reserved for HT Grocery Expansion. 2) Below the existing stormwater feature the pipe under NC 42 has eroded and failed, as noted on the wetland sketch you attached. Please explain why this modification wouldn't create similar impacts in wetland areas immediately south of NC 42, or detail measures proposed to mitigate the potential for future impact. The pipe you are referring to is within the NCDOT r/w and it is being repaired/fixed/modified with the NC 42 road widening project by NCDOT (R-3825B), currently under construction. NCDOT is abandoning the existing 60" RCP and replacing it with a 66" Welded Steel Pipe. The 66" pipe will extend about 13' on the upstream end and about 22' on the downstream end. The upstream end is armored with 15 tons of Class B Rip Rap and 35 SY of Geotextile Fabric (See Sheet 22 and Detail 53). The Flowers Plantation -Harris Teeter Fuel #229 within this modification request include Phase 8 in the above table. The proposed mitigation plan includes 0.026 acres of wetland mitigation. This compensatory mitigation is proposed at a 1:1 mitigation ratio. The 1:1 mitigation ratio is being proposed because of the low -quality wetland that exists onsite. This wetland has been impacted by stormwater runoff and erosion through the years. To assess this wetland quality, an NCWAM was completed. The NCWAM resulted in the hydrology function, the water quality function and the habitat function all rating "low" and with an overall wetland rating as "low". Please see attached NCWAM Wetland Rating Sheet and photos. In an effort to follow current mitigation policies, the Permittee authorized us to contact private mitigation banks seeking compensatory mitigation wetland credits. Requests for confirmation of available credits were sent to Resource Environmental Solutions, Restoration Systems and Wildlands Engineering, Inc. requesting wetland credits within the Neuse Basin-03020201 HUC. A Statement of Availability request for wetland credits was sent to Resource Environmental Solutions, see attached Statement of Availability letter with the sponsor of the EBX-Neu-Con Wetland & Stream Umbrella Mitigation Bank, specifically from the Hannah Bridge Site for 0.06 wetland credits. This included assessing the physical characteristics of the wetland, identifying the forest types and looking for evidence of the listed species onsite. Additionally, S&EC completed a Self -Certification through the USFWS and submitted a project review through the North Carolina Natural Heritage Program. The results of the above was sent to USFWS on April 22, 2020 requesting concurrence of our Page 3 of 4 findings. The USFWS has provided no response to our request. Per John Ellis of USFWS a no response means that they concur with our findings. A copy of our report and concurrence request is attached for reference.
