Permit 31-20 Attachments: oak island min mod. 31-20-08122020165821.pdf Hi all, Please see the minor modification for Oak Island's upcoming winter beach nourishment project (Permit #31-20) which allows for removal of potential debris within the magnetic anomaly buffer. If it confirmed to be debris and can be successfully removed (and properly disposed of), this mod removes the previously required buffer. Please let me know if you have any questions. Permit Class MODIFICATION/MINOR Permit Number 31-20 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to the Town of Oak Island, 4601 E. Oak Island Drive, Oak Island, NC 28465 Authorizing development in Brunswick County at the Atlantic Ocean, & the oceanfront shoreline of Oak Island , as requested in the permittee's application letter dated 6/5/20, including the attached workplan drawings, labeled Sheets 1, 20, and 21 of 22, dated revised 5/4/20. This permit, issued on August 12, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Provided the applicant can fully remove the possible marine debris and dispose of it in an upland location with no remaining debris to be dredged that may result in disposal on the beach, this Minor Modification eliminates the 50-foot dredge buffer previously required, as expressly and specifically set forth in the attached letter of request. 2) In the case that the marine debris cannot be fully removed from the borrow area and disposed of at an upland location, or the magnetic anomaly is a linear geologic feature, the 50-foot dredge buffer shall remain in effect. 3) Written confirmation of the completed debris removal shall be provided to DCM prior to any dredging in the buffer area. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Town of Oak Island ADDITIONAL CONDITIONS Permit No. 31-20 Page 2 of 2 4) Should dredging operations encounter sand deemed non -compatible with 15A NCAC 07H .0312 (Technical Standards for Beach Fill Projects), the dredge operator shall immediately cease operation and contact the Division of Coastal Management. Dredge operations shall resume after resolution of the issue of sand compatibility. 5) The permittee shall exercise all precautions to avoid damage to any potential historic structures or shipwrecks. If such materials are encountered, the permittee shall immediately stop work and notify the N.C. Division of Coastal Management at (910) 796-7302. 6) This Minor Modification shall be attached to the original of Permit No. 31-20, which was issued on 3/6/20, and copies of both documents shall be readily available on site when a Division representative inspects the project for compliance. 7) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. 8) The permittee and/or his or her contractor shall schedule a pre -construction conference with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project Action ID No. SAW-2018- 02230. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR No. 2018-1344 v2. NOTE: A minor modification processing fee of $100 was received by DCM for this project.
