Salisbury Street Raleigh, NC 27604 Re: Countryside Road Property – SAW-2007-01923 Request for NWP 39/GC 4139 On behalf of Lawndale Sand, LLC (applicant and owner), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the Countryside Road Property (Project) may proceed under Nationwide Permit (NWP) 39 and General Certification (GC) 4139. The ePCN submittal is designated as “For the Record Only” to USACE because a hard copy has already been submitted to the Charlotte Regulatory Office. Project Summary and Purpose The proposed Project includes the construction of a single driveway crossing to access the property from Countryside Road. The +/- 39-acre project is located at 450 Countryside Road west of Kings Mountain in Cleveland County, NC. Cleveland County lists the parcel PIN as 2585-23- 7581. The approximate center of the property is located at Latitude: 35.247536° N; Longitude: 81.402423° W. The purpose of the proposed project is to prepare the vacant lot for commercial development. Project Detail The Project consists of a driveway access to the property from Countryside Road. Facilities onsite will be connected to adjacent utilities. Heavy equipment typically used for road and utility installation projects (e.g. back hoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur within 1 mile of the site according to the NC Natural Heritage Program (NCNHP) Database. See attached letter from NHP dated September 12, 2019. No historic properties are listed on or adjacent to the project based on a query of the NC State Historic Preservation Office (NCSHPO). Three properties are designated as Surveyed Only within 0.5-mile of the project. Project History The parcel was previously forested and undeveloped since sometime prior to the earliest reviewed orthophotography (1993). A large portion was cleared sometime between late 2015 and early 2017. The parcel remains undeveloped. Countryside Road Project – SAW-2017-01923 Page 2 of 2 Avoidance and Minimization The proposed driveway was aligned to avoid and minimize impacts to streams. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. Project Impacts The project proposes permanent impacts to streams. Proposed stream impacts will result from permanent culverting associated with road construction. Proposed permanent stream impacts total 146 Linear Feet (LF) as a result of culverting for a driveway crossing. No wetlands are present on the site. Mitigation Permanent stream impacts have been minimized to less than 150 LF, however, prior permanent stream impacts on an adjacent parcel were determined to be included as a single and complete project by USACE. Therefore, 146 LF of cool water stream credits has been purchased from the Box Creek Wilderness Mitigation Site. The Letter of Credit Availability is included with this application.
