C. Wildlife Resources Commission (NCWRC) have reviewed the proposed project description, Our comments are provided in accordance with certain provisions of the North Carolina Environmental Policy Act (G.S. 113A-1 through 1 13A-10; 1 NCAC 25) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661et seq.). The United States Army Corps of Engineers is assessing the feasibility of Federal coastal storm damage risk reduction for the Towns of Surf City and North Topsail Beach, which are located on Topsail island in Pender and Onslow Counties. The preferred alternative as described in the Environmental Impact Statement (EIS) will be to dispose 11.5 mcy of beach compatible material from acceptable offshore sand sources to nourish approximately 52,150 if in length of ocean front beach with a long dune a berm design constructed to a height of 15 ft NGVD fronted by a 7 ft NGVD (50 ft wide) beach berm. As proposed, the renourishment cycle would be every 6 years after the initial constructions phases for a 50 year project. The NCWRC have the following concerns and recommendations: ■ The NCWRC recommends that all work to be conducted outside of the established moratoriums for nesting shorebirds (01 April-31 Aug) and nesting sea turtles (01 May — 15 Nov or until the ]at known nest hatches). Any encroachment in these time frames will increase the chances for significant, adverse impacts to important wildlife species and would require further consultation with NCWRC biologists before the project can proceed. • The NCWRC is continually concerned with the impacts of beach nourishment on benthic invertebrates. Benthic invertebrates are important food sources for foraging shorebirds and continued, frequent nourishment events can potentially have significant adverse impacts on these populations if they are not provided enough time to recover their populations to sustainable numbers. To reduce impacts to benthic invertebrates, the NCWRC supports staggering the renourishment areas so that the first renourishment event would start at the section of the project area where initial construction began: avoiding the most recent beach disposal area. Staggering these areas will allow a greater time for benthic invertebrates to adequately recover to sustainable levels. Thank you for the opportunity to review and comment on this project. These include the Federally listed seabeach amaranth (Amaranthus pumilus), loggerhead seaturtle (Caretta caretta), and other seaturtles. However, as the dredging window for the project is December 1 through March 31, to comply with regulations to avoid seaturtle nestings, our Program does not believe that these species will be impacted by the project, and we concur with the statements on pages 196-197 of the main report regarding these species. In addition, the material for the beach renourishment is proposed to be taken from offshore zones, rather than from channels, existing, islands, or the mainland. Thus, there will be no impact to any significant natural heritage areas from this project. As soon as practicable, but not later than six months after the date such information becomes available, a community shall notes the Administrator of the changes by submitting technical or scientific data in accordance with this part. Such a submission is necessary so that upon confirmation of those physical changes affecting flooding conditions, risk premium rates and flood plain management requirements will be based upon current data. " The documents provided as support for 11,E-000-0098 do not include documentation of expected impacts to the effective Flood Insurance Rate Maps or a reference to plans to update the effective FEMA Flood Insurance Rate Maps for the project area. 2) The NCFMP provided comments on NC State Clearinghouse 09-E-0000-0040 including a formal request for the USAGE Wilmington District to coordinate information and data for the 09-E-0000-0040 project with the on -going NCFMP coastal surge study, as well as a formal request for the USALE Wilmington District to assist with outreach regarding the 09-E-0000- 0040 project during the NCFMP's outreach of the new coastal surge study. EST Analysis 2) Modifications to EST Frequency Curves states "Water level frequency curves generated by EST for low frequency events (50-, 100-, and 500 year events) were unreasonable and exceed FERIA surge level estimates for Topsail Beach by .10 to 20 percent. Adjustments were made to these response curves so that they better reflected the FEAIA surge elevations. Also, the EST erosion distance frequency curves were "smoothed" in some cases to result in more uniform and expected erosion responses. An additional analysis using Automated Coastal Engineering System (ACES) software module Extremal Significant Wave Height Analysis corroborated the FEAIA extrapolated values. " The effective FEMA surge was published circa 1980 and exclude post-1980 storm events including the hindcast storms listed in Appendix D (Bertha, Fran, Dennis, Floyd, Bonnie and Irene). The coastal storm surge study is currently being updated by the NC Floodplain Mapping Program in partnership with FEMA, the Renaissance Computing Institute, USACE Duck Field Research Facility and the UNC Chapel Hill Institute of Marine Sciences and will supersede the effective flood study. The NCFMP is concerned that adjusting the response curves to "better reflect the FEMA surge elevations" is inappropriate and ignores any changes in expected surge levels resulting from inclusion post- 1980 to present coastal storm events. The NCFMP requests copies of the EST analysis and ADCIRC results for review and potential inclusion in the NCFMP coastal surge restudy. Thank you for your cooperation and consideration. However, the beachfront is the site for nesting by the Federal and State Threatened loggerhead seaturtle (Caretta caretta). The Biological Assessment (Appendix I) provides considerable information on nesting by seaturtles. Our Program concurs with the proposed hopper dredging window of December I to March 31. We also strongly hope that all placement of sediment on the beach can be done within this window, as well. . The Federal and State Threatened seabeach amaranth (Rmaranthus pumilus) is typically an annual that grows on accreting sand beaches, and thus is found mostly on ends of islands. As Iong. as the dredging and beach renourishment can be done/completed within the December 1 to March 31 period, the impacts to the amaranth should be negligible. Both the northeastern and southwestern ends of Topsail Island are used by birds for nesting. Appendix I discusses these species. In general, increasing the amount of sand on the middle portion of an island, through ocean dredging and sand renourishment, will favor build-up of'sand on the downdrift end of the island and be favorable to nesting by birds (by providing more extensive habitat), though this might take several years. Impacts to the "updrift" end of an island are probably not clear. Nonetheless, it aright be too speculative to comment on the positive or negative impacts to birds nesting on either end of the island, in regard to this project.
