Box 1067 Aberdeen, NC 28315 Dear Ms. Simon: You have our approval, in accordance with the attached conditions and those listed below, to permanently impact 36 linear feet of an unnamed tributary to South Crowders Creek in order to replace a pipe on SR 1102 (Unity Church Road) in Gaston County. The project should be constructed in accordance with your application dated September 18, 2001 (received 24 September 2001). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification No. 3289 corresponding to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us, in writing, and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if stream impacts exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. All pipes required for this project shall be installed in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions are to be maintained above and below locations of pipe extensions. Pipes shall be installed one foot below the stream to allow for fish and other wildlife movement. 2. All work shall be performed during low flow conditions. 3. Heavy equipment shall -be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream 4. Existing vegetated buffers shall not be mowed in order to utilize it for storm water sheet flow. 5. Stringent erosion control measures shall be installed where soil is disturbed. Erosion control shall be maintained until the project is completed. NCDOT is encouraged to use on-site vegetation and material for streambank stabilization where practicable. 6. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted when practical. If necessary, rip-rap must be limited to the stream bank below the high water mark, and vegetation must be used for stabilization above high water. 7. Rock silt screens at culvert outlets shall be removed at project completion. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The NCDOT proposes to improve and pave the referenced roadway. The project will require pipe replacement of an existing 24-foot, 48" CMP at Station 38+50. This pipe will be replaced with a 40-foot 112"x75" CMPA with concrete headwalls. A small section of stream will be relocated away from the existing road to facilitate widening to meet current safety standards. We will not object to the project as proposed by Ms. Trish Simon in her application of September 18, 2001 providing that the project construction follow the design and methods indicated. The relocated channel will mimic existing channel patterns and dimensions. 1. The CMPA should be designed and constructed large enough so that it can be installed one foot below streambed grade so that all waters can flow through uninterrupted and without freefalling or damming on either end during low flow conditions to maintain fish passage. The dimension, pattern, and profile of the stream and floodplain above and below the pipe should not be modified by widening the stream channel or reducing the depth of the stream. SR1102, NWP 14 2 September 21, 2001 2. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3. We believe this project can be accomplished under NWP # 14, Linear Transportation Crossing. I have enclosed a straight line diagram with erosion control plan, a PCN application for NWP #14, a sketch of planned activities, and a location map relative to the secondary road paving project/pipe replacement project on SR 1102, Unity Church Road, Gaston County, NC. The secondary road paving project consists of 9.1 acres of NC DOT right of way and the pipe replacement project encompasses 0.20 acres of this acreage, also within NCDOT right of way. Unity Church Road is currently a partially unpaved 18-foot wide gravel road. NCDOT plans to pave the road from SR 1104 to SR 1112 for a length of 1.3 miles. It will be graded and paved to current standards and typical section using bulldozers, pans, backhoes, rollers, and pavers. The majority of the work will consist of reshaping the existing alignment with one area of new alignment to shift the road away from a paralleling stream. The stream parallels the road (1-5 feet) for a distance of approximately 90 feet south of an existing crosspipe at Station 38+50..x, A Mr. John Hendrix Page 2- SRI 102, Gaston County September 18, 2001 DOT also proposes to remove an existing 24-foot, 48" CMP and replace it with a 40-foot long 112"05" CMPA with concrete headwalls at the inlet and outlet and a 5-foot riprap apron at the pipe inlet. Ten feet of riprap will be used around the inlet and outlet of the pipe for bank stabilization. DOT proposes to fill 60 feet of the existing channel and relocate it approximately 10 feet west (still within NCDOT right of way). The shift of the road alignment and the stream relocation is being done to provide an'increased buffer area between the roadway and the tributary. An on-site field meeting was held on 8/29/01 between representatives of NCDOT, Wildlife Resources Commission (Ron Linville & Mary Ellen Haggard) and the Division of Water Quality (Pete Colwell) to determine an acceptable design for the stream relocation. The relocated stream will be constructed in such a way as to mimic the existing stream channel's pattern and dimensions. The existing large vegetation on the east streambank will remain undisturbed and the streambank between the stream channel and roadway will be seeded and mulched. The road alignment changes and the stream relocation are shown on the enclosed sketches and maps. The pipe will be placed one foot below the existing streambed elevation and existing channel morphology will be maintained at the inlet and outlet. It is proposed that the watercourse be blocked using sandbags and pumped around the construction area during the pipe installation following NCDOT best management practices for pipe placement activities. The diversion will extend approximately 5 feet upstream of the channel change and 5 feet below the riprap at the pipe outlet. The stream impacted by the proposed project is an unnamed tributary to South Crowders Creek, which is classified Class C waters and is located in the Catawba River Basin. There are no wetlands involved in the project. The stream is not located within a watershed area nor is the road a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the NCDOT hazardous spill basin checklist for this project. The USGS Kings Mountain Quadrangle topographical map indicates a second unnamed tributary crossing SR 1102; however, possibly due to the land use changes in the area, this stream no longer exists. A USACE and DWQ stream classification form has been completed for both tributaries shown on the USGS map. A review of the Natural Heritage information for the threatened/endangered species listed for Gaston County, the bog turtle (Clemmys muhlenbergii), the bald eagle (Haliaeetus leucocephalus), and Schweinitz's sunflower (Helianthus schweinitzii), did not reveal any known sites in the vicinity of the proposed project. I have conducted a surveys for the bog turtle (Clemmys muhlenbergii), the bald eagle (Haliaeetus leucocephalus), and Schweinitz's sunflower (Helianthus schweinitzii) in the project area on July 5 and July 26, 2001. None were observed. It was determined that none of these species or suitable habitats were located in the proposed project area. No significant effect on this species is At Mr. John Hendrix Page 3- SRI 102, Gaston County September 19, 2001 anticipated. A review of the National Register of Historic Places was also conducted. It is anticipated that no site listed on the National Register will be affected by the proposed project. A concurrence form from the N.C. State Historic Preservation Office for this project is enclosed. By copy of this letter, we are asking Neil Trivette, Area Roadside Environmental Engineer to comment on the above project. By copy of this letter, we are also requesting concurrence from the Wildlife Resources Commission and the U.S. Fish & Wildlife Service. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Describe the purpose of the proposed work: The project consists of the upgrade of an existing unpaved road to current paved road standards by secondary road construction department for the safety of the travelling public. At Station 3 8+50, the bridge department will remove an existing 24-foot, 48 CMP and replace it with a 40 foot long, 112"05" CMPA with concrete headwalls at inlet and outlet and a 5 foot riprap apron at inlet. Ten feet of riprap will be used around the inlet and outlet of pipe for bank stabilization. Due to the close proximity of the stream and the existing road, the road will be reali ned slightly and 60 feet of stream will be filled and relocated. The proposed relocated channel will also be 60 feet; therefore, there will be no net loss of linear stream footage. 11. List the type of equipment to be used to construct the project: Secondary road construction will be done using typical heavy construction: bulldozers, pans, backhoes rollers, and pavers. The bridge department will use a trackhoe for excavation, pipe lag, and riprap work. 12. Describe the land use in the vicinity of this project:The surrounding area is partially wooded, however, has been heavily cutover recently. There are several parcels of land for sale along the road. Due to the recent logging and land for sale signs, development in this area is anticipated. IV. Prior Project History If jurisdictional determinations and/or permits have been,, requested and/or obtained for this project (including all prior phases of the same subdivision,, the-past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. NCDOT will be ading and paving SR 1102 in order to improve safety and reduce maintenance The creek parallels the road (1-5 feet) from for a distance of approximately 90 feet south of the replaced and extended 16 ft. Sixty feet of the existing stream channel will be filled and sixty feet of channel will be relocated approximately 10 feet to the west of the existing channel. The shift of the road alignment and the stream relocation is to provide an increased buffer area between the tributary and the roadway. The area along SR 1102 is being developed and the developers have already platted lots to be sold. Due to the development that is occurring in this area, there was concern that if the stream were relocated off of the DOT right of way, it would be more difficult to prevent future impacts. NCDOT has chosen to replace pipe in existing location and to relocate the stream on existing right of way. The new stream channel will be constructed in such a way as to mimic the existing stream channel pattern and dimensions. The existing large vegetation on the west streambank will remain undisturbed, the streambank between the stream channel and the roadway will be seeded and mulched, as shown on the enclosed sketch. This option was chosen to reduce the amount of fill in the stream and to maintain the existing Page 7 of 12 meander that can be observed at this location. An on-site field meeting was conducted between representatives of NCDOT. Wildlife Resources Commission (Ron Linville and Marv Ellen Haggard), and Division of Water Quality (Pete Colwell) on 8/29/01 to determine an acceptable design option. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strrngide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. PERMANENT IMPACTS DUE TO FILL < 150 FEET. The impacts of the 60 feet of fill in the existing stream is being mitigated by the relocating 60 feet of the stream channel. The relocation is being done in such a way as to mimic the dimensions and pattern of the existing channel and will remain on NCDOT right of way to prevent future impacts to the relocated section. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. The construction will take place with its intersection with SR 1104 Pinnacle Road and Lewis Road SR 1112. Construction will consist of the installation of pavement and storm drainage. The construction will be performed on new roadway; the majority of the land adjacent to the proposed construction area is made up of undeveloped wooded land. The total area to be denuded for the project is 6.0 acres. The erosion control for this project will be in the form of 35 checkdams. The dams will be placed at several locations along the roadway. Silt fences will be placed along the toe of sloped where sediment-laden runoff cannot be directed into sediment basins. In addition, temporary diversion ridge will be used to contain run off, which will be discharged periodically at various checkdams. Rock checkdams shall also be used along the ditch sections. The plans shall show the exact location, type and size of each erosion control device. There are 7 points of discharge from cross lines with this project, which discharge into an existing system, which will have outlet protection installed at the outlets. Inlet protection will be placed at all inlets where a sediment basin cannot be placed at the discharge points. Rock check dams will be installed at all inlet headwalls. Silt fences will be installed at the toe of all fills where there is potential for erosion. The soil erosion and sedimentation control structures and devices should be done in accordance with the specifications and designs as shown on the plans. All devices should be maintained until vegetation has been stabilized until the black base has been placed. Other erosion control measures of field modifications maybe required as site conditions dictate.
