Dept of ENR JUL 3 0 2015 r WINSTON-SALEM REGIONAL OFFICE This letter is in response to your letter dated June 17' 2015. I would like to address the non- compliance issues for the months of April and May 2015 in this letter. Due to the lack of rain we had in the months of April/May coupled with temperature variances above normal inhibited the conversion of cold water bacteria to warm water bacteria resulting in the nitrifing bacteria to be stressed and not able to recover in time to meet permit levels for the months. In March the 30 min. sludge volume index was 50% plant 1, and 40% plant 2 during the first 2 weeks in April it jumped to 50% plant 1, and 80% plant 2. The second two weeks the 30 min SVI jumped to 70% plant 1, and 80% plant 2. wasting averaged 15 min. per day the digesters were pumped by Keens Septic on April 17, 6000 gallons of sludge were hauled off site. During the first week of May the 30min. sludge volume index was 30% plant 1, and 40% plant 2, Wasting was reduced to 6 min. per day in second half the SVI jumped to 80% plant 1, and 80% plant 2. Wasting was increased to 14 min. per day the digesters were pumped by Keens Septic on May 30, 6000 gallons of sludge were hauled off site, also in May all the diffusers were repaired/replaced, a back flow valve on the no.1 blower failed allowing air to short circuit this was repaired/replaced. Blower timers were increased to allow the uptake of NH3-N and did accomplish this by months end. In closing I would like you to know that we at Monroe's MHP WWTP do everything possible to keep this facility in compliance with all permit requirements, all other parameters were within permit levels and we believe that we did everything possible to insure permit quality effluent to the receiving stream. Pocket colorimeters can only be used if the facility either does not have a permit limit or that limit is greater than 100 ug/L(0.1mg/L). Any facility with a limit less than 100 ug/L must utilize a spectrophotometer. I have attached a letter that Dana recently sent out to our certified labs that restates the requirement, since we do still find the question is asked by many facilities. Here is a cut and paste from the attached letter that is most relevant to your question. Acceptable EPA -approved methods for low-level TRC analyses include the Amperometric Titration Method and the DPD Colorimetric Method. [Note: Permit levels of 13, 17 and 28 µg/L require that a low-level spectrophotometric/colorimetric method be used.] • If a facility has no effluent limit for TRC (just a monitoring requirement), then use of a hand-held meter, sometimes described as a pocket colorimeter, and the reporting of <100 ,ugIL as a TRC value is acceptable. [Note: If a facility has a permit monitoring limit >0.1 mg/L (i.e., 100 µg/L), it is acceptable to use a pocket colorimeter.] I hope that helps. Let me know if you have any other questions. Monroe 5111 Mockingbird Road Greensboro, NC 27406 SUBJECT: Compliance Evaluation Inspection Monroe's Mobile Home'Park WWTP NPDES Permit No. NCO055913 Guilford County Dear Mr. Monroe: Donald van der Vaart Secretary On March 3, 2015, Mike Mickey of this office met with Richard Hughes, ORC, to perform a Compliance Evaluation Inspection on the wastewater treatment system serving Monroe's Mobile Home Park. The inspection findings are detailed below and an inspection checklist is attached. I. Permit The NPDES permit expires on September 30, 2016. Please note that at the next renewal the permit will require that the monthly self -monitoring reports (DMRs) for Monroe's MHP be submitted electronically per new EPA rules. H. Self -Monitoring Program The daily self -monitoring reports (DMRs) were reviewed for the period January 2014 through December 2014. The Monroe's MHP facility reported effluent violations in January, March and April (see data summary attached). The March and April violations occurred after the March 8t' ice storm and power outage event. The above violations were previously addressed in correspondence from this office. With regards to the permit monitoring requirements, it was noted that all sampling was performed per the frequencies specified in the permit. III. Flow Measurement The NPDES permit requires weekly instantaneous flow reporting of the effluent. An ultrasonic meter is used to report flow values on the DMRs. The meter was calibrated by Delta Systems on December 20, 2014. IV. Sludge Handling and Disposal Solids are removed from the digester by Keene Septic Tank Service. Operations and Maintenance The facility appeared to be adequately operated and maintained. It was noted that major maintenance was performed on the system in July 2014. VI. Facilitv Site Review The existing 0.03 MGD treatment system consists of the following: flow splitter box followed by parallel package plants with 15,000 gallon aeration units, clarifiers, sludge holding units, tablet chlorinators with contact tanks followed by a tertiary filter, dechlor unit and ultrasonic flow meter. VU. Records/Reports A comparison of the December 2014 self -monitoring report with the corresponding operator's records and the laboratory data sheets from R&A Labs showed that all values were transcribed onto the DMR correctly. VIII. Effluent/Receiving Waters The system discharges into Polecat Creek, class "WS-III' waters in the Cape Fear River Basin. The effluent was observed to be clear. Comment: Maintenance was performed in July that included pressure washing and painting the dual train system, replacement of rubber hoses, cleaning of clarifier bottoms and reworking the splitter box. For process control, settleability tests are performed on each aeration basin to gauge solids inventory. The 0.030 MGD WWTP consists of the following: flow splitter box followed by parallel in -ground package plants with 15,000 gallon aeration units, clarifiers, sludge holding units tablet chlorinators and contact tanks followed by a tertiary filter, dechlor unit and ultrasonic flow meter. A portabale generator is housed at the plant for standby power. Record Keeping Are records kept and maintained as required by the permit? We did repairs to the equipment with the spare parts on hand and during normal conditions we would have had enough parts to replace the faulty equipment but due to the circumstances we were unable to predict what Duke Power was going to do next, the power infrastructure system was still being worked on in late May of 2014. We would like you to know that we at Monroe's MHP WWTP take compliance very serious and do our best to prepare for breakdowns of equipment etc but in this case we were faced with an unprecedented situation and we did everything we could to maintain compliance while not knowing what Duke Power was going to do The facility was in compliance with all NPDES permit levels before this incident and we are in compliance after this incident. To date we have done extensive repairs on our own electric equipment to help prevent this occurrence in the future, also we have made other upgrades to help the facility run more efficient. Due to the ice storm on March 08' 2014 and subsequent power outage the plant suffered from lack of waste water flow for five days due to the community well with no back up power being off line,when the power did come back on it was intermittent and with all park residents using all the water they could before the next outage resulted in slug/surge flows, over the next 5 to 10 days all this coupled with more snow on the 17' and 18`h of March resulted in the nitrifing bacteria to be stressed and not able to recover in time to meet permit levels for the month. On March,13.2014 I met with Mike Mickey of your office to go over storm damage and at that time he acknowledged that everything was being done that could be to keep the facility in compliance during this event. Looking back at the ORC log data this facility has cold weather spikes of (6-7 mg/1) for this parameter but always recovers (0.127mg/1) to meet monthly permit levels. In March with the ice/snow storms and subsequent slug/surge flows this facility was overcome and was not able to recover as it would have under operating normal conditions. In closing I would like you to know that we at Monroe's MHP WWTP do everything possible to keep this facility in compliance with all permit requirements, this facility has a back up generator and was placed online soon after the power outage occurred and was operated throughout the event, all other parameters were within permit levels and we believe that we did everything possible to insure permit quality effluent to the receiving stream during a month when we could not control the weather. Skvarla, III Secretary On December 3, 2013, Mike Mickey of this office met with Richard Hughes, ORC, to perform a Compliance Evaluation Inspection of the wastewater treatment system serving Monroe's Mobile Home Park. The treatment facility was found to be compliant with the effluent limits of the NPDES permit. The inspection findings are detailed below and an inspection checklist is attached for your records. I. Permit It was noted that repairs had just been completed on the clear well, meter well and tertiary sandfilters. Additionally, the v-notch weir plate and the dechlorination unit were replaced. The NPDES permit expires next on September 30, 2016. The annual fee for 2013 has been paid. The annual fee invoice for 2014 should be mailed from Raleigh in the very near future. II. Self -Monitoring Program The daily self -monitoring reports (DMR's) were reviewed for the period January 2013 through October 2013. The facility was found to be compliant with the NPDES effluent limits (see data summary attached). With regards to the permit monitoring requirements, one daily temperature measurement was omitted on February 1, 2013. This omission was previously addressed in a Notice of Deficiency letter from this office. III. Flow Measurement The NPDES permit requires weekly instantaneous flow reporting for the effluent. An ultrasonic meter is used to report flow values on the DMR's. The meter was being serviced by Delta Systems on the day of the inspection. The previous calibration occurred on March 23, 2013. Sludge handling and Disposal Solids are removed from the digester as necessary by Keene Septic Tank Service. V. Operations and Maintenance The facility appeared to be adequately operated and maintained. No concerns were noted. VI. Facility Site Review The existing 0.03 MGD treatment system consists of the following: splitter box, dual 15,000 GPD package plants with aeration basins, clarifiers and tablet chlorinators with contact tanks followed by a single tertiary filter, dechlorination unit and ultrasonic flow meter. VII. Records/Reports A comparison of the October 2013 self -monitoring report with the corresponding operator's records and the laboratory data sheets from R&A Labs showed that all values were transcribed onto the DMR correctly. VIII. Effluent/Receiving Waters The system discharges into Polecat Creek, class "WS-III' waters in the Cape Fear River Basin. The effluent was observed to be clear. Chlorine contact time in the contact basin is approximately two hours. 4. Back washed and cleaned the final filters 5. Pumped and cleaned the clear well/post air tanks 6. Pumped and cleaned the meter well. 7. Increased the chlorine feed. 8. Increased the sludge age to allow for more destruction of of fecal mater 9. Have changed chlorine tablet lot numbers/ manufactures. In closing I would like to note we take the compliance and the environment very seriously and strive to impact the receiving stream as little as possible, there was no visible impact on the receiving stream as a result of this violation and the monthly average was under the permit limit. This type of inspection consists of two basic parts: an in office file review and an on -site inspection of the treatment facility. The treatment facility was found to be noncompliant with the effluent limits and monitoring requirements of the NPDES permit. The attached EPA inspection form notes the eight (8) areas that were evaluated. The findings and observations are outlined below: I. Permit The NPDES permit was recently reissued with an effective date of October 1, 2011. II. Self -Monitoring Program The monthly self -monitoring reports (DMR's) were reviewed for the period January 2011 through December 2011. The facility was found to be noncompliant with final NPDES effluent limits for fecal coliform, TSS, NH3-N and flow for the above period (see data summary attached). These violations were previously addressed by correspondence from this office. In regards to the permit monitoring requirements, several sampling omissions occurred which are also listed on the attached summary. III. Flow Measurement The NPDES permit requires weekly instantaneous flow reporting for the effluent. Flow values are obtained using the ultrasonic meter. The meter was last calibrated by Delta Systems on 3/23/11. It was noted that the metal v-notch weir plate was severely corroded. It is our understanding that replacing the weir plate is planned. IV. Sludge Handling and Disposal Solids are removed from the digester by Carolina Septic Tank Service. Pumping last occurred the week of February 20, 2012. The only concerns 'noted involved the condition of the v-notch weir plate and the makeshift dechlorination tube. VI. Facility Site Review The existing treatment 0.03 MGD system consists splitter box, dual 15,000 GPD package plants with bar screens, aeration basins, clarifiers and tablet chlorinators with contact tanks followed by a single makeshift tablet dechlorination tube and ultrasonic flow meter that are located in the former tertiary filter tank. VII. Records/Reports A comparison of the December 2011 self -monitoring report with the corresponding laboratory data sheets from R&A Labs showed that all values were transcribed onto the DMR correctly. A copy of the Division's guidance for holiday reporting on the DMR was provided to the ORC. VIII. Effluent/Receivinct Waters The system discharges into Polecat Creek, class "WS-III' waters in the Cape Fear River Basin. The effluent was observed to be clear. This assessment is based upon the following facts: the December 2008 discharge monitoring report ("DMR") was not filed with the Division of Water Quality within the thirty (30) day reporting period in accordance with the monitoring and reporting requirements contained in the subject NPDES permit. A Notice of Violation was sent to the facility dated February 26, 2008 (NOV-2009-LR-0009), for failure to submit the December 2008 DMR. Within said notice, you were informed that future reports not received within the required timeframe would result in a recommendation for assessment of civil penalties. In addition, the DMR for May 2009 was also late but received by DWQ on August 7, 2009. As of the date of this document, DWQ has not received the September 2009 DMR. The State's enforcement costs in this matter may be assessed against Monroe's Mobile Home Park WWTP pursuant to NCGS. 143-215.3(a)(9) and NCGS 143B-282.1(b)(8). Based upon the above facts, I conclude as a matter of law that Monroe's Mobile Home Park WWTP violated the terms, conditions or requirements of NPDES Permit NC0055913 and G.S. 143-215.65 in the manner and extent shown above.
