Madison County Response deadline: March 5, 2010 Dear Mr. and Mrs. Young: The Division of Water Quality (DWQ) has performed a preliminary review of a 401 Water Quality Certification application submitted for the above referenced property. Additional information will be required in order to complete the review process. Please provide the following information so that we may continue to review your project. Additional Information Requested: Based on the Army Corp of Engineer description, the culvert and associated driveway appear to be proposed for the purpose of commercial development, not an existing or future residential driveway. As required in Part B.3.d of the application, please fully describe the purpose of the proposed project (and attach any detailed drawings necessary to show the footprint of the project and associated drainage area(s)). 2. If the project is to be used for commercial purposes, you must indicate the percent imperviousness of the project. The unnamed tributary to Middle Fork of Little Ivy Creek is a Class WS-I1, HQW stream. Please contact Madison County regarding their water supply watershed stormwater and density maximum requirements (Madison County Planning, Ryan Cody). You will need to clarify the questions in Part D.2. and 3. In order to fill the area over the culvert, you must first fill over the culvert with material from sources other than NCDOT. You must fill over the culvert and bring the fill material up to bank full before any material from the NCDOT can be placed over the culvert. Due to mitigation restrictions, NCDOT would be required to provide additional mitigation for impacts to streams on your property (if you attempted to use NCDOT fill material in the immediate area of the culvert). You may use NCDOT fill outside the immediate area of the culvert (and use fill from your own property for the area immediately surrounding the culvert). Please contact Mr. Mike Parker of this office (828) 296 - 4500 if you need further guidance on allowable fill. Please provide your response in writing to the addresses below prior to March 5, 2010. Four copies of the required information should be provided to the 401 Permitting Unit at: Ms. Cyndi Karoly 401 Permitting Unit 1650 Mail Service Center Raleigh, NC 27699-1650 and a single copy to the Asheville Regional Office at: Susan A. Wilson Surface Water Protection Section 2090 US HWY 70 Swannanoa, NC 28778 If we do not hear from you by the deadline, we will assume that you no longer want to pursue this project and we will consider the project withdrawn. This letter only addresses the preliminary application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ. Please call Ms. Wilson at (828) 296-4500, if you have any questions.
