Mr. Ronnie Smith (USAGE representative) originally field verified the delineation on June 16, 2005 (AID 200500906), and Lillette Granade signed the original jurisdictional determination. The wetland delineation has since been re- verified by Mr. Brad Shaver, on February 15, 2007. A total of approximately 7.11-acres of jurisdictional wetlands (Tract "A" approximately 0.93-acres; Tract "C" approximately 6.18-acres) were identified on the project site. Wetland area "D" is shown incorrectly on the preliminary survey by Gary Keyes. The upland island within wetland area "D" (~1.3-acres) was subtracted from the 7.4-acre depicted on the survey to achieve the 6.1-acre total of wetland area "D". Ms. Lia Myott Hampstead Commercial Center March 8, 2007 Page 2 of 4 PROPOSED PROJECT: The project site consists of two tracts of land (Tract "A" 14.12-acres and Tract "C" 18.34-acres) totaling 32.46-acres. Tract "B" is not owned by the applicant; however, there is an access easement from tract "A" to tract "C". Currently the project site is undeveloped and consists of emergent vegetation located within the southern half of Tract "A" and forested areas in the remaining areas of Tract "A" and continuing into Tract "C". The proposed development is consistent with current zoning of the project site (Planned Development District (PD)) and the surrounding land uses within the vicinity. The proposed development consists of the construction of an approximately 80,000 square foot retail shopping center with an approximately 48,000 square foot grocery anchor, associated parking facilities, utilities, sanitary septic drainage fields, and stormwater management infiltration basins (see Overall Site Plan Tracts "A" and "C"). This commercial center is proposed to provide goods and services to the growing Hampstead community and surrounding area. Tract "A" will also contain two commercial out-parcels facing US Highway 17. Proper sedimentation and erosion control methods will be utilized during construction of the project. Wastewater will be treated in septic drainage fields located within Tracts "A" and "C". Stormwater management infiltration basins will be constructed in Tract "C" and a permanent access road from Tract "A" to Tract "C" will be constructed to the basin in the southern section of Tract "C". PROPOSED IMPACTS: INSET 1: Construction of the parking facilities on Tract "A" are proposed to permanently impact approximately 0.38-acres and temporarily impact approximately 0.04-acres of jurisdictional wetlands (see Inset 1). The original layout proposed 0.49-acre of wetland impact associated with the parking lot, but to minimize impact to the wetland complex at this location, the corner of the parking lot was re-designed and needed spaces were moved to the side of the anchor tenant (original layout attached). Limiting the amount of required parking spaces for the retail shopping center has been done to maximum extent practicable in an effort to minimize impacts to jurisdictional wetlands. INSET 2: A permanent access road from tract "'A" to tract "C" is proposed that would result in 0.08-acre of permanent wetland impact to tract "C" to construct the stormwater infiltration basin. As well, there is a proposed temporary impact of 0.03-acre of wetlands associated with the excavation and burial of the stormwater pipes directed to the infiltration basin. Ms. Lia Myott Hampstead Commercial Center March 8, 2007 Page 3 of 4 The nearest receiving body of water is Old Topsail Creek, which is located approximately 200-feet north of the project site. Old Topsail Creek has been classified as a SA/HQW waters (High Quality Shellfish Waters) at Factory Road in the Town of Hampstead (approximately 0.25-mile south of the project site). The project as a whole is approximately 27% impervious, as such; stormwater management is required to accommodate a high density development as defined by DWQ. The high density stormwater management option requires an infiltration basin be located within area in the southern section of Tract "C" outside of jurisdictional wetlands (approximately 50-feet away from the nearest wetland boundary). An area located within the southern section of Tract "A" was examined as a potential location for the infiltration basin. However, sanitary septic drainage fields are also required as part of the project, and based on soil permeability testing, it was determined that the only location for the drainage fields was within the southern section of Tract "A" and the northern section of Tract "C". Consequently, an infiltration basin must be located within the southern section of Tract "C" with a supplemental basin also located within the northern section of the Tract "C". To gain access to the location of the proposed stormwater management infiltration basin located in the southern section of Tract "C", an access road is required to be constructed (see Inset 2). As a result, 0.08-acre of jurisdictional wetland is proposed to be impacted due to constructing the access road. To minimize impacts to the wetland system as a whole, three 12-inch reinforced concrete pipes (RCP) will be installed for aquatic life passage. The proposed location of the access road has been aligned to cross the narrowest point of the wetland system to minimize impacts. As well, there is a proposed temporary impact of 0.03-acre of wetlands associated with the excavation and burial of the stormwater pipes directed to the infiltration basin. MITIGATION: The project site was designed to minimize impacts to aquatic resources, while utilizing the remaining parcel for commercial development. In total, there are approximately 7.11-acres of jurisdictional wetlands located on the project site (Tracts "A" and "C" combined); of which, a total of approximately 0.46-acres of wetlands are proposed to be permanently impacted. Approximately 6.65-acres of existing wetlands will not be impacted by the proposed site plan. The applicant proposes to preserve the remaining 6.65-acres of wetlands with deed restrictions. This would be a preservation mitigation ratio of 14.45 to 1. If further compensatory mitigation is required, the applicant proposes to make an in-lieu payment to the North Carolina Ecosystem Enhancement Program. Siyrce 199 THE JOHN R. McADAMS COMPANY, INC. The proposed development has proposed permanent wetland impacts totaling approximately 0.46-acres and proposes to temporarily impact approximately 0.07-acres of jurisdictional wetland to facilitate the development. The applicant proposes compensatory mitigation, at a 14.45 to 1 ratio, by preserving the remaining 6.65-acres of wetlands located at the project site. If further mitigation is required, the applicant proposes to make an in-lieu payment to the North Carolina Ecosystem Enhancement Program. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. Typical construction equipment will be used such as a front end loader, bulldozer, and paving equipment. Proper sedimentation and erosion control methods will be utilized during construction of the project. 11. Explain the purpose of the proposed work: This commercial center is proposed to provide goods and services to the growing Hampstead community and surrounding area. The purpose of the proposed work is to construct an approximately retail shopping center with an ~~roximately 48 000 square foot grocery anchor on Tract A. Tract A will also contain two commercial outparcels facing US Highway 17. The proposed site plan will minimize impacts to jurisdictional wetlands the most practicable extent possible. Avoidance measures include limiting the amount of required marking spaces for the retail shopping center within Tract A (see Inset 1). Within Tract C the proposed location of the access road has been aligned to cross the narrowest point of the wetland system and has been tapered down to minimize impacts. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to fteshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that maybe appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Updated l 1 / 1 /2005 Page 10 of 13 Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. Approximately 6.65-acres of existing wetlands will not be impacted by the with deed restrictions. This would be a preservation mitigation ratio of 14.45 to 1.
