On March 19, 2015, Mike Mickey of this office met with Bobby Sands to perform a Compliance
Evaluation Inspection on the stormwater discharge from Magellan Terminal R located at 7109 West Market
Street. The facility was found to be compliant with the NPDES permit. The inspection findings are detailed
below and an inspection checklist is attached.
I. Permit
The permit expires on June 30, 2016. Please note that at renewal the permit will require that the monthly
Discharge Monitoring Reports (DMRs) for Terminal 11 be submitted electronically per new EPA rules.
H. Self -Monitoring Program
The DMRs were reviewed for the period February 2014 through January 2015. The facility was found to be
compliant with the permit effluent limits for the above period. In regards to the permit monitoring
requirements, it was noted that all sampling was performed per the frequencies specified in the permit.
III. Facility Site Review
The Magellan Terminal II facility has the following stormwater control structures:
• truck loading -rack drain area followed by an oil/water separator (OWS) which discharges into the
retention pond.

• four secondary containment dikes that surround the hydrocarbon fuel and ethanol AST's.
Stormwater releases from the lower two dikes to the retention pond are controlled manually by
locked valves.
• single retention pond that receives stormwater from the OWS and diked areas. The discharge from
the retention pond is controlled by a locked valve.

IV. Flow Measurement
The permit requires episodic flow monitoring. The discharge volume from the retention pond is calculated
using pipe diameter and flow duration. A log is kept to record the release date, flow duration and computed
discharge volume. It was noted that no discharge occurred in the months of February, September and
October.
V. Records/Reports
A review of the facility files showed that all records were being maintained according to the permit. A
comparison of the January 2015 DMR with the corresponding certified laboratory data sheets from R&A
Labs showed that all results were properly transcribed onto the self -monitoring report.
The only paperwork issue noted concerned the redundant listing of monitoring data on the May and
December DMRs. The May 21, 2014 sample results and the December 24, 2014 sample results were listed
twice on the respective monitoring reports (see attached). Please only list the sample data once on the DMR.
VI. Effluent/Receiving Waters
The system discharges outside the perimeter fence to a ditch that runs under the railroad tracks and W.
Market Street. The effluent eventually reaches a tributary of Horsepen Creek, class "WS-III; NSW" waters
of the Cape Fear River Basin. No effluent was being discharged on the day of the inspection.

Street. The facility was found to be in compliance with the NPDES permit. The inspection findings are detailed

The NPDES permit was issued effective February 1, 2013. The permit expires next on June 30, 2016.

The facility was found to be compliant with the final NPDES effluent limits for the above period. In regards to the
permit monitoring requirements, it was noted that all sampling was performed per the frequencies specified in the

using pipe diameter and flow duration. A log is kept that records the release date and computed discharge volume.

The Magellan Terminal H facility has the following stormwater control structures:
• The drain for the truck loading -rack is routed to an oil/water separator.
Four secondary containment dikessurround the AST's, each with a manually controlled locked release
valve.
A single retention pond that receives stormwater from the separator and diked areas. The discharge from
the retention pond at outfall 001 is controlled by a locked valve.

- On March 13, 2013, Mike Mickey of this office met with Bobby Sands, ORC, to perform a
Compliance Evaluation. Inspection on Magellan's Terminal II located off West Market Street. This type of
inspection consists of two basic parts: an in office file review and an on -site inspection of the treatment
facility. The inspection found Magellan to be in complete compliance with the above NPDES permit.
The inspection findings are detailed below and an inspection checklist is attached for your records.
I. Permit
The NPDES permit was reissued with an effective date of February 1,, 2013. The permit expires next on
June 30, 2016. The major changes in the new permit involved the MTBE monitoring going from monthly
to quarterly and total recoverable phenolics are now sampled instead of phenols.
II. Self -Monitoring Program ,
A review of the monthly self -monitoring reports (DMR's) submitted for the period January 2012 through
January 2013 found the facility to be in complete compliance with the final NPDES effluent limits for the
above period. In regards to the permit monitoring requirements, it was noted that all sampling was
performed per the frequencies specified in the permit.

using pipe diameter and flow duration (9,000 gallons/hour).

Magellan's Terminal II facility has truck loading -rack drains followed by an oil/water separator that is
routed directly to the retention pond. The diked secondary containment structure surrounding the above
ground storage tanks is .divided into four areas. The two upper areas drain by locked valves into the two
lower areas which then drain by locked valves into the retention pond.

waterbody (NSW), and since last renewal has been formally listed on the State's 303d List as

A. (2.) ACUTE TOXICITY - 24-HOUR STATIC TEST (ANNUAL)
The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A. Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine
Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test.
Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will
conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of
the permit.
The annual toxicity test must be performed by June 30. Should there be no discharge of flow from the facility
during the six month period January 1-June 30, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county and in the
comments section indicate "No Flow for January 1-June 30, {calendar yearl." The report must be signed and
submitted to the Environmental Sciences Section at the address noted below.

for the Magellan Terminals Holdings (MTH) Greensboro II Terminal facility. MTH is requesting renewal
of the permit. There have been two changes at the facility since issuance of the last permit however only
one could potentially affect storm water discharge. MTH added a butane offloading skid and began
storing butane in five 60,000 gallon bullets in 2008 and added an ethanol offloading skid and began
storing ethanol in 2009.

The Division of Water Quality (the Division) received your site plan and correspondence of December 5,
2008 stating your intent to store ethanol in bulk at the subject facility. A permit modification will not be
necessary.
We understand that you intend to store this new fuel product in existing Tank #5 serviced by a new
ethanol truck off-loading drive rack and appurtenant piping. Please monitor and report any potential
environmental impact by spill or leakage as mandated by your existing Water Pollution Prevention Plan
under the subject NPDES permit. Again, the Division feels that these facility addition's and alterations
do not warrant modifying. your existing permit to discharge to surface waters via permitted Outfall 002.

NCAC 2H.0105 (e)) regulations state that permit renewal applications must be filed at least 180 days prior
to expiration of the current permit. If you have already mailed your renewal application, you may
disregard this notice.
Your renewal package must be sent to the Division postmarked no later than January 1, 2011.
Failure to request renewal by this date may result in a civil penalty assessment. Larger penalties may be
assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after June 30, 2011, the current permit must be renewed.
Discharge of wastewater without a valid permit would violate North Carolina General Statute 143-215.1;
unpermitted discharges of wastewater may be assessed civil penalties of up to $25,000 per day.

A Compliance Evaluation Inspection was performed on Magellan Terminal Holdings, LP wastewater
treatment facilities on October 27, 2010 by Corey Basinger of the Winston-Salem Regional Office.
Ruben Qualls represented the subject facilities during the inspection. The inspection consisted of two
parts: an on -site inspection of the -treatment facility and an in -office file review. The following are -the
findings from the subject inspection.
I. Permits
The NPDES permit NC0003671 became effective on October 1, 2006 and expires on June 30, 2011.
The NPDES permit NCO074578 became effective on September 1, 2006 and expires on August 31,'
2011. You should receive a renewal package from the Division in the very near future.
II. Records/Reports
A review of the laboratory reports and Discharge Monitoring Reports (DMRs) revealed no discrepancy
between the generated data and the data submitted to DWQ. A copy of the laboratory data is kept on
file. All applicable data is collected as per the NPDES permit requirements.
III. Facility Site Review
NPDES Permit NC0003671 states that the treatment works consist of truck loading rack drains,
oil/water separator, waste holding tank (with optional pump -out for offsite disposal), gravity drains to
dike containment areas, discharge control valves (for pretested wastewater) and dry ditch drains to an
unnamed tributary to Horsepen Creek. Since the previous inspection, ethanol storage has been added
to this facility.

oil/water separator, waste holding tank (with optional pump -out for offsite disposal), gravity drains to

IV. Effluent & Receiving Waters
Magellan Terminal Holdings, LP discharges to an unnamed tributary to Horsepen Creels (Class WS-III
NSW waters in the Cape Fear River Basin) and to an unnamed tributary to Long Branch (Class
WS-IV waters in the Cape Fear River Basin). On the date of the inspection, the streams were free of
solids, grease, foam or sheen.
V. Flow Measurement
Flow is measured by the rational method at the NC0003671 facility and by a flow meter at the
NC0074578 facility.
VI. Self -Monitoring Program
A review of the discharge monitoring reports (DMRs) for the time period of July 2009 through July
2010 showed that the Magellan Terminal Holdings, LP experienced no permit effluent limitation
violations. No problems were noted with respect to the self -monitoring programs at the facilities.
VII. Operations and Maintenance
No problems noted with respect to operation. Maintenance is performed as needed.

A Compliance Evaluation Inspection was performed on Magellan Terminal Holdings, LP wastewater
treatment facilities on November 6, 2008 by Corey Basinger of the Winston-Salem Regional Office.
Ruben Qualls represented the subject facilities during the inspection. The inspection consisted of two
parts: an on -site inspection of the treatment facility and an in -office file review. The following are the
findings from the subject inspection.
I. Permits
The NPDES permit NC0003671 became effective on October 1, 2006 and expires on June 30, 2011.
The NPDES permit NCO074578 became effective on September 1, 2006 and expires on August 31,
2011.
II. Records/Reports
A review of the laboratory reports and Discharge Monitoring Reports (DMRs) revealed no discrepancy
between the generated data and the data submitted to DWQ. A copy of the laboratory data is kept on
file. All applicable data is collected as per the NPDES permit requirements.
III. Facility Site Review
NPDES Permit NC0003671 states that the treatment works consist of truck loading rack drains,
oil/water separator, waste holding tank (with optional pump -out for offsite disposal), gravity drains to
dike containment areas, discharge control valves (for pretested wastewater) and dry ditch drains to an
unnamed tributary to Horsepen Creek.
NPDES Permit NCO074578 states that the treatment works consist of truck loading rack drains,

WS-IV waters in the Cape Fear River Basin). On the date of the inspection, the streams were free of
solids, grease, foam or sheen.
V. Flow Measurement
Flow is measured by the rational method at the NC0003671 facility and by a flow meter at the
NCO074578 facility.
VI. Self -Monitoring Program
A review of the discharge monitoring reports (DMRs) for the time period of June 2007 through August
2008 showed that the Magellan Terminal Holdings, LP experienced no permit effluent limitation
violations. No problems were noted with respect to the self -monitoring programs at the facilities.
VII. Operations and Maintenance
No problems noted with respect to operation. Maintenance is performed as needed.

On October 1, 2008, I issued a Notice of Violation ("NOV") against Magellan Terminals Holdings LP.
The NOV was based upon a violation of the reporting requirement by failing to file the July 2008
discharge monitoring report with the Division of Water Quality within the thirty (30) day reporting
period. Subsequent to your receipt of the penalty, Susie Bareta contacted Division staff indicating you
submitted a discharge monitoring report for July 2008 on August 27, 2008 and was received by the
Division on September 1, 2008.
As a result, I have withdrawn the NOV against Magellan Terminals Holdings LP for the cited violation
and directed that the record of this assessment be removed from our files.

monitoring report for July 2008. This is in violation of Part II, Condition D(2) of the NPDES permit, as
well as 15A NCAC 2B .506(a), which requires the submittal of Discharge Monitoring Reports no later
than the thirtieth (30fl') day following the reporting period. Failure to submit reports as required will
subject the violator to the assessment of a civil penalty of up to $25,000 per violation. You will be
considered noncompliant with the self -monitoring requirements of your NPDES permit until the report
