Dear 'Mr. Gatewood:
On March 6, 2015, Mike Mickey of this office met with Barry Furr- and 'Johnny Tapia to
perform a Compliance Evaluation Inspection on Kinder Morgan's Greensboro Terminal #1 located
at 6907 West Market„Street. The facility.was found to be compliant with the NPDES permit. The
inspection findings are detailed below and an inspection checklist is attached.
I. Permit
The permit expires next on August 31, 2016. A renewal notice should be mailed to you
approximately 8 months prior to expiration.
II. Self -Monitoring Program
The monthly self -monitoring reports (DMRs) were reviewed for the period January 2014 through
December 2014. The facility was found to be compliant .with final NPDES effluent limits for the
above period. In regards to the permit monitoring requirements, it was noted that all sampling was
performed per the frequencies specified in the permit. If
III. Flow Measurement
The permit requires episodic flow monitoring. Flow is measured using a totalizing meter after the
effluent pump at the settling lagoon. The release valve on the force main is locked. Records are
kept documenting the effluent release dates and totalizer readings. It was noted that no discharge
occurred in the months of February, May, June, August, November and December..' . _
VI. Facility Site Review
Stormwater from the truck loading -rack drain area is routed to a 10,000 gallon oil/water separator
unit prior to` being pumped -to the lined settling pond. Stormwater from the secondary containment
structure that surrounds the ASTs is also collected in the settling pond. The discharge from the pond
is controlled by an effluent pump. The facility appeared to be competently operated and
maintained.

V. Records/Reports
A comparison of the October 2014 DMR with corresponding certified laboratory data sheets from
R&A Labs showed that the results were properly transcribed onto the self -monitoring report.
VI. Effluent/Receiving Waters
The system discharges just outside the perimeter fence into a ditch that flows under the downslope
Transmontaigne facility. The discharge eventually reaches a tributary of East Fork Deep River,
class "WS-IV *" waters of the Cape Fear River Basin. No effluent was being discharged on the day Y
of the inspection.

Comment: The stormwater treatment system for Kinder Morgan Terminal #1 was found to be compliant
with the NPDES permit for the review period January 2014 through December 2014.
The stormwater managment system consists of the following:
*truck loading -rack drains.
*10,000 qallon oil/water separatorw/hvdrocarbon sensor (Dumped to lined settlina Dond
*diked 'secondary containment structure with lined settling pond for ASTs.
*effluent pump, locked force main valve and totalizing meter.
*emergency 12" discharge pipe for gravity release if necessary (also locked).

Greensboro # 1 location. In the.past Kinder Morgan has provided notifications when discharges are planned from this
pond. The purpose of the discharge is to bring the water level to normal operating pond'design levels. The water
discharge will start today. As always, KM will record the volume discharged and report in the next DMR cycle.

to submit my December 2014 EDMR for (NC0000795); although, I was able to submit the EDMR for
facility (NC042501) today. The document was signed by a G. McLoud at your 1618 Mail Service Ctr.

I have three concerns:
1. 1 cannot submit my NC0000795 EDMR.

This is a follow up to the call I made to you on October 20, 2014 about water discharge from the pond at the Kinder
Morgan Greensboro 1 facility.
As previously shared with you, we needed to discharge water from the pond for maintenance activities. The discharge is
complete and a sample was collected during this time. All the volume of water discharged did not pass through the
meter but we have recorded volume from pumps used.
The water discharge will be reported in the monthly DMR along with flow.

Mike: Regarding the GN1 (NC0000795) inspection -Upon closer scrutiny on the December 2013 NPDES discharge test
results, I identified that the test results were for GN2 (0042501), NOT GN1. See the attached results, both for what you
observed yesterday,.and the actual GN1 test results.
GN1 4th quarter MTBE test results were reported in October (1st month of the quarter) as required. The December GN1
EDMR is correct with the indication of no MTBE testing for December 2013.

On February 11, 2014, Mike Mickey of this office met with Barry Furr, ORC, to perform a
Compliance Evaluation Inspection of Kinder Morgan's Greensboro Terminal #1 located at 6907 West
Market Street. The facility was found to be in compliance with the NPDES permit. The inspection
findings are detailed below and aninspection checklist is attached for your records.
I. Permit
The NPDES permit was reissued with an effective date of October 1, 2011. The permit expires next on
August 31, 2016.
II. Self -Monitoring Program
Monthly self -monitoring reports (DMRs) were reviewed for the period January 2013 through December
2013. The facility was found to be compliant with final NPDES effluent limits for the above period. In
regards to the permit monitoring requirements, it was noted that all sampling was performed per the
frequencies specified in the permit.
III. Flow Measurement
The permit requires. episodic flow monitoring. Flow is measured using a totalizing meter .after the
effluent pump. The release valve on the force main is locked. Records are keptdocumenting the effluent
release dates with totalizer readings. It was noted that no discharge occurred in the months of February,
April, September and November.
VI. Facility Site Review
Stormwater from the truck loading -rack drain area is routed to an oil/water separator prior to being
pumped to the diked containment structure. Stormwater from the secondary containment structure
surrounding the AST's collects in the settling pond. The discharge from the settling pond is controlled by
an effluent pump. The facility appeared to be competently operated and maintained.

V. Records/Reports
A comparison of the December 2013 DMR with corresponding certified laboratory data sheets from R&A
Labs showed that all of the results were properly transcribed onto the self -monitoring report.
VI. Effluent/Receiving Waters
The system discharges outside the perimeter fence to a ditch that flows under the downslope
Transmontaigne facility. The discharge eventually reaches a tributary of East Fork Deep River, class
"WS-IV *" waters of the Cape Fear River Basin. No effluent was being discharged on the day of the,
inspection.

On February 27,' 2013, Mike Mickey of this office met with Barry Furr and Cliff McCowan to
perform a Compliance Evaluation Inspection of Kinder Morgan's Greensboro Terminal #1 .located at
6907 West Market Street. This type of inspection consists of two basic parts: an in office file review and
an on -site inspectionof the facility-. The inspection found Kinder Morgan to be in complete compliance
with the NPDES permit. The inspection findings are detailed below and an inspection checklist is
attached for your records.
I. Permit
The-NPDES-permit Was -reissued -with -an -effective -date -of October_1_,201.1_.She-permit expires next on
August 31, 2016.
II. Self -Monitoring Program

2012. The facility was found to be in complete compliance with final NPDES effluent limits for the above

VI. Facility Site Review

as well as a diked secondary containment area for the above ground storage tanks. Both of these areas
drain into the main settling pond prior to discharge. Although referenced on the Supplement to Permit
Cover Sheet, there is no groundwater rerhediation treatment system present.

After lookln8 at this, it appears there is problem when the data is uploaded.into SIMS. The DiVIR is reflected correctly
in the eDMR system as NO DISCHARGE. When Bli'stlS uploads the data [t gets marked as NIQ DATA and this gets
calculated as FREQUENCYviolations.
We vJIll have to fix this in BIMS Which vrill require a code fix. -1 have a. developer looking into this,

After looking at this, it appears there is a problem when the data is uploaded into BIMS. The DMR is reflected correctly
in the eDMR system as NO DISCHARGE. When BIMS uploads the data it gets marked as NO DATA and this gets
calculated as FREQUENCY violations.
We will have to fix this in BIMS which will require a code fix. I have a developer looking into this.

In response to your request of March 1, 2011 to renew the subject NPDES permit, the Division of Water
Quality (the Division) hereby transmits this draft for your review and comment. Please review this document
to assure your understanding of the permit limits and monitoring conditions, and to correct errors, if any.
Concurrent with this notification, the Division will solicit public comment on this draft by publishing a
notice in newspapers having circulation in the general Guilford County area, as required by the NPDES
Program. Please provide your written comments, if any, to me via email Doe.corporon@ncdenr.gov] or write
to my attention care of DENR / DWQ / NPDES Program no later than July 22, 2011.
The Division understands that you have made no significant alterations to your wastewater treatment
facilities during the previous permit cycle except to add ethanol storage and mixing. We have therefore made
minimal changes to your permit by updating your facility map, treatment -component description, and have
added parameter codes to the effluent monitoring page for your convenience [see Supplement to Cover Sheet
and Section A. (1.)]. We have also revised your monitoring for Phenol to Total Recoverable Phenolic
Compounds (no limit) in accord with revised permitting guidance for water supply (WS) waters. However,
the Division is concerned about your monthly Discharge Monitoring Reports (DMRs) and, based on data
submitted, has added permit limits for Benzene and Toluene.
EPA's mandated reasonable potential analysis (RPA) requires the Division to apply'/2 the reported practical
guantitation level (PQL) to evaluate your permit compliance, and to calculate permit limits reflected in this
draft. The current RPA dictates that we limit both Benzene (L 19 ug/L) and Toluene (11 ug/L), each to its
respective water -quality stream standard, consistent with your discharge to the environment under "zero -
flow" receiving -stream conditions (no dilution); see permit Section A. (1.).

DMR Data Review. After reviewing your monthly DMR data for the reporting period 2006 through 2010,
we note discrepancies in analytical "units of measure" for fuel -related hydrocarbon parameters only (BTEX
and Naphthalene). For Naphthalene, you submitted 10 consecutive monthly reports (during 2008 and 2009)
indicating "<10 mg/L" as the test -method minimum PQL. These data imply "not detected," but at a level
1,000 times less sensitive than the laboratory test -method PQL of 10 µg/L, a permit violation (see permit
Part II, Section D Monitoring and Reporting, #4, paragraph 3). In all, we find 47 discrepancies in the units
for 161 data points (about 29%).
If these Discharge Monitoring Reports are in error, please submit amended DMRs to the Division, including
analytical backup documentation. In the absence of amended DMRs, we will issue a permit final, as drafted
according to the required reasonable potential analysis calculated on the existing database.
Following the mandatory 30-day public comment period, the Division will review all pertinent written
comments and take appropriate action prior to issuing your NPDES permit final. If you have questions

A. (2.) MTBE MONITORING - SPECIAL CONDITION
Based on data submitted by the Permittee, the Division currently requires MTBE monitoring Quarterly. If MTBE
is detected at Outfall 001, the Permittee shall immediately increase monitoring for MTBE to Monthly, and the
Permittee shall submit to the Division an MTBE Action Plan to identify the sources of MTBE contamination.
This Action Plan is due to the Division within 180 days of the first detection of MTBE.
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead.Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes -must be obtained below all waste
treatment. The permittee will conduct one test annually, with'the'annual period beginning in January of
the calendar year of the effective date of the permit. The,annua�l test requirement must be performed and
reported by June 30. If no discharge occurs by June 30'.0otification will blmade to the Division by this

Completed Aquatic Toxicity,Test Form's shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the'reporti6g period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

sensitive than the test -method PQL (I0µg/L). Discrepancies are restricted to fuel -
hydrocarbon parameters only.
The Division will therefore ask for amended DMRs with laboratory backup for data
from 2006-2010. In the absence of these amended data, the RPA dictates permit limits for
Benzene (1.19 ug/L) and Toluene (I I ug/L) reflecting surface water -quality standards for
a discharge under zero -flow conditions. This draft permit includes these limits.
o Phenol has been changed to Total Recoverable Phenolic Compounds [code 32730] to
address chlorinated phenols, in accord with discharge to WS waters (no phenol [single]
detected during the previous permit cycle).

A Compliance Evaluation Inspection was performed on Kinder Morgan Southeast Terminals, LLC —
Greensboro Terminal wastewater treatment facility on October 13, 2010 by Corey Basinger of the
Winston-Salem Regional Office. The inspection consisted of two parts: an on -site inspection of the
treatment facility and an in -office file review. The following are the findings from the subject
inspection.
I. Permit
The NPDES permit for Kinder Morgan Southeast Terminals, LLC — Greensboro Terminal became
effective on September 1, 2006 and expires on August 31, 201 l:
II. Records/Reports
A review of the laboratory reports and Discharge Monitoring Reports (DMRs) revealed no discrepancy
between the generated data and the data submitted to DWQ. A copy of the laboratory data is kept on
file. All applicable data is collected as per the NPDES permit requirements.
III.. Facility Site Review
The permit states that the treatment works consist of a bermed secondary containment area, truck
loading racks, vapor recovery unit, pump manifold, pump -back area, hydrostatic testing, fire
suppression system testing, driveway rinse down and a settling pond with discharge to an unnamed
tributary to the East Fork Deep River.
IV. Effluent & Receivinv Waters
The Kinder Morgan Southeast Terminals, LLC-Greensboro Terminal discharges to an unnamed
tributary to East Fork Deep River (Class WS-IV waters in the Cape Fear River Basin). On the date of
the inspection, the stream was free of solids, grease, and foam.

VI. Self -Monitoring Program
A review of the discharge monitoring reports (DMRs) for the time period of August 2009 through July
2010 showed that the Kinder Morgan Southeast Terminals, LLC-Greensboro Terminal experienced no
permit effluent limitation violations.

No problems noted with respect to operation. Maintenance is performed as needed.

Dear Mr. Sullivan:
The Division of Water Quality (the Division) received your site map and letter of July 30 stating your
intent to store ethanol in bulk at the subject facility. A permit modification is not required.
We understand that you intend to store this new fuel product in existing Tank #6 and monitor any
potential environmental impact utilizing your existing Water Pollution Prevention Plan under the
subject NPDES permit. The Division concurs with your assessment that changing the contents from
petroleum to ethanol in Tank #6, as monitored through permitted Outfall 001, does not require a
formal modification of your existing permit.
