Good morning, Holley.
As per our discussion last week, we would like to place this project on hold. This will give us time to re-evaluate the
drainage feature and assign a stream origin point, based on current conditions. Please call me, at your earliest
opportunity, to schedule a date to do this.

Good afternoon Dana,
Please provide clarification on the Normal High Water and Mean High Water boundaries shown on the site plans and
reference the datum or responsible party for this determination. Additionally as labeled on the soils map submitted
with your PCN the extent of the surface waters within the stream should be labeled and appropriate setbacks shown. It
also appears based on our site visit Friday during high tide that the SA waters of Bogue Sound are influencing the stream
feature. The point A16 shown on the submitted soils map should be located in the field so that the origin of the stream
may be verified by DWR. Please feel free to call or email me if you have any questions or I may be of assistance to you in
any way.

Referencing your 6/17/2020 NWP# 18 request, you submitted for the Department of the Army (DA) authorization to
discharge fill material into approximately 1,050 square feet of jurisdictional waters of the U.S. for the construction of
new access to property.
Based on our review of the plans provided in the application and the Corps site visit on 7/23/2020 we believe that the
location of the new access with impacts to jurisdictional waters on the property could be avoidable by utilizing the
existing access. The Corps is moving to denial on your proposal, in its present form, does not comply with the conditions
of avoidance to waters of the US. As discussed with you, our recommendation is to utilize existing access on the
property. By avoiding impacts to Waters of the U.S. and utilizing the available access a permit from the Corps will not be
required.
